HomeMy WebLinkAbout67-033RESOLUTION 67-33 INITIATING PROCEEDINGS FOR THE ANNEXATION OF TERRITORY TO THE CITY OF SANTA ANA, DESIGNATING AN APPROPRIATE NAME FOR SAID TERRITORY OF "LYON & McFADDEN N.E. ARNEX", AND GIVING NOTICE OF PROTEST HEARING THEREON WHEP. EAS, heretofore, the Local Agency Formation Commission of Orange County approved the map and description of the territory hereinbelow contained and the annexation of said territory to the City of Santa Aha, California; and the Planning Co~mission of the City of Santa Aha has approved said annexation; NOW, THEREFORE, BE IT RESOLVED: the City of Santa Aha hereby initiates of said territory to the City of Santa That the City Council of proceedings for annexation Aha for the following reasons: That said territory can best be served by the City of Santa Aha with municipal services of the highest quality anywhere obtainable at a cost for such services which is lower than can be obtained any- where else in the County of Orange; That it is to the mutual advantage of the City and the landownezsthat said territory become a part of said City. BE IT FURTHER RESOLVED: That the City Council of the City of Santa Ana hereby declares its intention to annex all of the territory hereinbelow described under the provisions of the Annexa- tion of UniD/%abited Territory Act of 1939; hereby finds and declares that said territory is uninhabited within the meaning of the Government Code Section 35303 on the date of the adoption of this Resolution; and that said territory is Contiguous to the City of Santa Aha, lies in the County of Orange, State of California, and is described as: Beginning at an angle point in the City boundary of the City of Santa Ana, said angle point being 10 feet Westerly from the monumented centerline of Lyon Street as established on October 3, 1955 by Ordinance Number NS-135, said point of beginning being a point on the East line of that certain territory annexed to the City of Santa Aha on August 20, 1888 by Ordinance Number 73, said point of beginning being on the North- west corner of the McFadden and Lyon S. E. Annex to the City of Santa Aha, which was annexed by Ordinance Number NS-312, on April 7, 1958, said point of begin- ning being 20 feet Northerly from the centerline of McFadden Street; and running thence North 88° 55' 45" East along a line parallel with and 20 feet Northerly, measured at right angles, from said centerline of McFadden Street and along the City boundary of the City of Santa Aha as annexed by Ordinance Number NS-312, a distance of 572.40 feet to the Southwesterly right of way line of the Atchison, Topeka and Santa Fe Rail- road; thence South 50° 44' 22,' East along said South- westerly line of the Railroad and along said City boundary 60.18 feet to the Northwest corner of the McFadden and Tustin S. W. Annex to the City of Santa Aha, by Ordinance Number NS-406, and to a point on a line parallel with and 20 feet South, measured at right angles from the centerline of McFadden Street; thence North 88° 55' 45" East along said parallel line and along said city boundary as annexed by Ordi- nance Number NS-406, a distance of 142 feet more or less to the Southwest corner of the Williams Street Annexation Number 2 to the City of Tustin, as annexed by Ordinance Number 233; thence departing from said City boundary North 0° 31' 31" East 1,032.13 feet along said City boundary of the City of Tustin as annexed by Ordinance Number 233 to an angle point in said City of Tustin boundary; thence North 88° 33' 15" East 75.24 feet along said City boundary of Tustin to an angle point in said City boundary; thence North 0° 33' 00" West 867.10 feet along said City boundary of Tustin~to an angle point into the West Main Street Annexation to the City of Tustin, as annexed by Ordi- nance Number 226; thence South 88° 33' 15" West 393.57 feet along said City boundary of the city of Tustin as annexed by Ordinance Number 226 to an angle point in said City boundary; thence North 0° 33' 00" West 247.08 feet along said City boundary of the City of Tustin tO the Southeast corner of the LYON AND MAIN S.E. ANNEX to the City of Santa Aha, as annexed by Ordinance Number NS-583; thence departing from the City boundary of the City of Tustin South 89° 07' 30" West 441.43 feet along the City boundary of the City of Santa Aha as annexed by Ordinance Number NS-583 to an angle point in the boundary of the City of Santa Aha, and to the East line of the territory annexed by said Ordinance Number 73, and to a point on a line which is parallel with and 10 feet West measured at right angles, from said monumented centerline of Lyon Street; thence South along said parallel line, and along said City boundary of the City of Santa Aha as annexed by said Ordinance Number 73, a distance of 2096 feet more or less to the point of beginning. BE IT FURTHER RESOLVED: That "LYON & McFADDEN N.E. ANNEX" is hereby designated as an appropriate name by which said terri~ tory shall be known for the purpose of this annexation. BE IT FURTHER RESOLVED: That notice is hereby given that May 1, 1967, at the hour of 7:30 P.M. in the Council Chambers, City Hall, Third and Main Streets, Santa Ana, California, is the time and place fixed at which said Council will hear written pro- tests against this annexation made by any person owning property within said territory. At any time prior to the final adjournment of the hearing on protests any owner of property within the terri- tory may file written protest against this annexation. The pro- test shall state the name of the owner of the property affected and the street address or other description of the property suffi- cient to identify it on the last equalized assessment roll, all as provided for in California Government Code Section 35312.
