HomeMy WebLinkAbout67-078RESOLUTION 67-78 AUTHORIZING ACCEPTANCE OF A DEED AND EXECUTION OF A DEED EXCHANGING EASEMENTS BETWEEN THE CITY AND BERNICE B. HEFFERNAN WHEREAS, BERNICE BORCHARD HEFFERNAN has,by deed dated May 1, 1967, conveyed to the City of Santa Aha, without cash consideration, an easement for street purposes for Fairview Street, north of Alton Avenue, in exchange for which the City will quitclaim to said grantor the City's interest in and to an abandoned sewer easement on the east side of Fairview Street, south of Segerstrom Avenue; and WHEREAS, said transaction is to be handled through Escrow No. 262757 with Security Title Insurance Company, Santa Ana, California; NOW, THEP~EFORE, BE IT RESOLVED: That the City of Santa Ana accepts said deed from BERNICE BORCHARD HEFFERNAN granting to the City the following described property: An easement for street purposes over that portion of the North half of Lot 4 of the Williams Tract, as shown on a map thereof recorded in Book 30, Page 14, Deeds, records of Los Angeles County, California, lying within the following described property: A strip of land 104.00 feet in width, the center line of which is described as follows: Beginning at the intersection of the center line of Segerstrom Avenue and Fairview Street as shown on a map recorded in Book 66, page 8, Record of Surveys, Orange County, California, and running thence Southerly in a straight line to a point on the center line of Alton Street, formerly Talbert Avenue, which is 1115.00 feet Westerly measured along said center line of Alton Street, from the intersection of the center line of said Alton Street and Greenville Street, formerly Old Newport Road, as said intersection is shown on a map thereof recorded in book 6, page 40, Record of Surveys, Orange County, California, and Carl J. Thornton, the City's designated agent, is directed to place his Certificate of Acceptance on said deed. BE IT FLr~.THER RESOLVED: That the Mayor and the Clerk of the Council are hereby authorized and directed to execute a deed quit- claiming to BERNICE BORCHARD HEFFERNAN that certain real property in the City of Santa Ana, County of Orange, State of California, described as: A portion of that certain right of way for sewerage pipe lines as conveyed to the grantor herein by deed recorded February 4, 1924 in Book 505, page 337, Deeds, records of Orange County, california, more particularly described as follows: That portion of the North one-half of Lot 4 of the Williams Tract, as shown on a map recorded in Book 30, page 14, Deeds, records of Los Angeles County, California, described as follows: A strip of land 14.00 feet wide, being 7.00 feet wide on each side of and measured at right angles to a line which is the center line of said strip of land, and which center line is described as: Commencing at the common corner of Section 27, 28, 33 and 34, Township 5 South, Range 10 West, San Bernardino Base and Meridian, thence South 89° 21' East a distance of 577.03 feet to a point in -1- the surveyed center line of the outfall sewer of the City of Santa Aha, said point being designated as Engineer's Station 151+47; thence North 58° 59' East along said center line to its intersection with the West line of Lot 4 of the Williams Tract, as shown on a map recorded in Book 30, Page 14, Deeds, records of Los Angeles County, California, to the true point of beginning; thence continuing North 58" 59' East along said center line to its intersection with the North line of said Lot 4, containing .236 acre of land, more or less. EXCEPTING the Westerly 75.00 feet dedicated to the Orange County Flood Control District, and deliver the same into said Escrow Number 262757.
