HomeMy WebLinkAbout67-093RESOLUTION 67-93 INITIATING PROCEEDINGS FOR THE ANNEXATION OF TEPA%ITOR¥ TO THE CITY OF SANTA ANA, DESIGNATING AN APPROPRIATE NAME FOR SAID TERRITORY OF "TUSTIN AND FOURTH S.W. ANNEX NO. 1", AND GIVING NOTICE OF PROTEST HEARING THEREON W~I~REAS, heretofore, the Local Agency Formation Commission of Orange County approved tha map and description of the territory hereinbelow contained and the annexation of said territory to the City of Santa Ana, California; and the Planning Commission of the City of Santa Ana has approved said annexation; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby initiates proceedings for annexation of said territory to the City of Santa Ana for the following reasons: That said territory can best be served by the City of Santa Ana with municipal services of the highest quality anywhere obtainable at a cost for such services which is lower than can be obtained anywhere else in the County of Orange; That it is landowners City. to the mutual advantage of the City and the that said territory become a part of said BE IT FURTHER RESOLVED: That the City Council of the City of Santa Aha hereby declares its intention to annex all of the territory hereinbelow described under the provisions of the Annexation of Uninhabited Territory Act of 1939; hereby finds and declares that said territory is uninhabited within the meaning of the Government Code Section 35303 on the date of the adoption of this Resolution; and that said territory is contiguous to the City of Santa Ana, lies in the County of Orange, State of California, and is described as: Beginning at an angle point in the City boundary of the City of Santa Ana, California, as annexed by the Mabury Annex Number 1, NS 259, said point being at the intersection of a line that is parallel with and distant easterly, ~0.00 feet, measured at right angles, from the center line of Tustin Avenue with a line that is parallel with and distant southerly, 30.00 feet, measured at right angles, from the center line of Fourth Street, as shown in the Mabury Tract, recorded in Book 165, page 300, Deeds, Miscellaneous Records of Los Angeles County, California; thence south 89" 36' 45" west along said parallel line, south of the center line of Fourth Street, and along said City Boundary, 517.41 feet, to the east line of the west half of Lot 14 of said Mabury Tract and to an angle point in the City of Santa Ana boundary, as annexed by the First and Tustin Annex, NS 296; thence south 0° 16' 35" east along said east line of the west half of Lot 14 and along said City boundary, 270.00 feet, to an angle point in said City boundary and to a line that is parallel with and distant southerly, 300.00 feet, from the center line of Fourth Street; thence north 89" 36' 45" east along said parallel line and along said City boundary, 236.94 feet, to an angle point in said City boundary; thence south 0" 16' 35" east along said City boundary, 7.03 feet, to a point in said City boundary, said point lying in the north line of that certain parcel of land conveyed by J. F.Miller and wife to C. L. Cotant and Dixon W.Tubbs by deed recorded November 24, 1922 in Book 444, page 285 of Deeds; thence departing from said City boundary, north 89" 31' 15" east along said north line of that certain parcel conveyed to C. L. Cotant and Dixon W. Tubbs and along the easterly extension of said -1- north line, 280.62 feet, to a point in the City of Santa Ana boundary, as annexed by the Tustin and Fourth East Annex, NS 379, said point being distant southerly, 306.63 feet, from the center line of Fourth Street and distant easterly, 30.00 feet, measured at right angles, from the center line of Tustin Avenue; thence north 0° 18' 25" west along said City boundary and along a line parallel with and distant easterly, 30.00 feet, from said center line of Tustin Avenue 276.63 feet, more or less, to the point of beginning. BE IT FURTHER RESOLVED: That "TUSTIN AND FOURTH S.W. ANNEX NO. 1" is hereby designated as an appropriate name by which said territory shall be known for the purpose of this annexation. BE IT FURTHER BESOLVED: That notice is hereby given that August 7, 1967, at the hour of 7:30 P.M. in the Council Chambers, City Hall, Third and Main Streets, Santa Ana, California, is the time and place fixed at which said Council will hear written protests against this annexation made by any person owning property within said territory. At any time prior to the final adjournment of the hearing on protests, any owner of property within the territory may file written protest against this annexation. The protest shall state the name of the owner of the property affected and the street address or other description of the property sufficient to identify it on the last equalized assessment roll, all as provided for in California Government Code Section 35312. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 19th day of June, 1967.
