OR REPEAL OF MANDATORY REQUIREMENTS OF SECTIONS
204, 205, and 206 OF TITLE II OF THE DEMON-
STRATION CITIES AND METROPOLITAN DEVELOPMENT
ACT OF 1965
WHEREkS, the 89th Congress enacted Public Law 89-754 entitled
"Demonstration Cities and Metropolitan Development Act of 1966"; and
WHEREAS, Title II of said Act, "Planned Metropolitan Development"
provides that after June 30, 1967, all applications for Federal loans
or grants-in-aid not only for open space land projects but also for
hospitals, airports, libraries, water supply and distribution facilities,
sewerage facilities and waste treatment works, highways, transportation
facilities, and water development and land conservation within any
Metropolitan Area shall be submitted and reviewed by an areawide agency
designated to perform Metropolitan and Regional Planning; and
WHEREAS, other Federal Acts, including but not limited to the
Housing and Urban Development Act of 1965, Federal Water Pollution
Control Act, the Urban Mass Transportation Act of 1964, and the Housing
Act of 1961 are subject to the same or similar requirements; and
WHEREAS, these mandatory requirements force Federal dictation and
control in strictly local affiars in violation of the principles and
concepts of home rule and in matters best left to the determination of
local elected officials who are more acquainted with and cognizant of
the needs and desires of their constituents; and
WHEREAS, it is believed that the advice and consent of officials
and persons in neighboring Cities and the County of Orange may not be
in the best interest nor necessary or advisable in determining the
best methods of procedures in fulfilling the needs of the City of Santa
Ana and its residents as required in said Federal Legislation;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana respectfully requests Congressmen Richard T. Hanna and
James B. Utt to prepare or cause to be prepared and support legislation
in the Congress of the United States, rescinding or repealing the
mandatory requirements in Sections 204, 205, and 206 of Title II of the
Demonstration Cities and Metropolitan Development Act of 1966, and
similar requirements in all other Federal Acts which make mandatory a
review by an Agency which is designated to perform metropolitan or
regional planning for an area as a prerequisite for Federal loans and
grants-in-aid to local agencies in constructing or providing vitally
needed public works projects and local facilities.
BE IT FURTHER RESOLVED: That the Clerk of the Council is hereby
directed and authorized to forward copies of this Resolution to the
Honorable Senator Thomas Kuchel; the Honorable George Murphy and
Congressmen Richard T. Hanna and James B. Utt, and to such other public
officials or agencies who believe in the concept and principle of home
rule and wish to join with the City of Santa Ana in its fight to retain
management and control of its own local affairs.
PASSED AND ADOPTED by the City Council of the City of Santa Aha
at its regular meeting held on the 3rd day of July, 1967.
