HomeMy WebLinkAbout67-117 RgSOL~TION OF INTENTION NO. 67-117 ASSESS T D ST ICT NO. 226 SANTA *mA, IFmN The City Council of the city 0f santa Aha, California, session assembled, does hereby resolve and determine in regular as follows: SECTION 1: It is the intention of said City Council, after acqUiring jurisdiction to do so pursuant to the provisions of Arti©le XIII, Section 17, of the Constitution, and Division 4 of the Streets and Highways Code of the State of California, and Sections 7230 to 7233, inclus.ive, of the Santa Ama Municipal Code, to order the following acquisxtion of property for. public use and work to be done and ~mprovements to be ma~e in saxd City of santa Ana, California, to wit: A. The acquisition of the following described permanent sewer easeme~nt_s over that portion of the North one-half of the Southeast one quarter of Section 9, Township 5 South, Range 10 West, in the Rancho Los Bolsas, as shown by map on file in Bpok 51 of Maps at Page 12 thereof, of Miscellaneous Maps, Records of Orange County, California, and being in the City of Santa Aha, California, described as follows: PARCEL 1: The West 15 feet of the following ~escribedproperty: Beginning at a point 380 feet East bf'a point 30 chains West of the South- east corner of the Northeast quarter of the Southeast quarter of said Section 9, the last said point being the Southwest corner of the Southeast quarter of the Northwest quarter of the Southeast quarter of said Section 9; thence North 660 feet; thence West 165 feet; thence South 660 feet; thence East 165 feet to the true point of beginning. EXCEPTING the West 75 feet thereof. PARCEL 2: A strip of land 10.00 feet in width, t~he center line of which is described as follows: Beginning at a point 61 feet North of the South- east corner of the Northwest quarter of the North- east quarter of the Southeast quarter of said Section 9; thence West 132 feet; thence North 1.00 foot; thence West 264 feet; thence North- westerly in a straight line to a point 15.00 feet North of the Northwest corner of the South 80 feet of the West 132 feet of the East 528 feet of the Northwes~ quarter of the Northeast quarter of the Southeast quarter of said Section 9; thence Southwesterly in a straight line to a point 12.00 feet North and 364.35 feet West from the Southeast corner of the Northeast quarter of the Northwest quarter of the Southeast quarter of said Section 9; thence South 12.00 feet. B. The construction and installation of an eight inch diameter extra strength vitrified clay pipe sewer line, with four inch diameter extra strength vitrified clay pipe sewer laterals, and including standard ma.nholes, ro?k bedding, vitrified clay %m/ms, pipe supports, trenchzng, backfzlling, pavement replacement, and -1- appurtenances and appurtenant work, in the following streets and easements in said City of Santa Ana: 1. Cc~aencing at a manhole to be constructed in the e~.isting sewer main line in Fifth Street in its c~on intersection wlth Huylar's Lane, a private street, thence northerly.in Fifth Street and Huylar's Lane, and the Sewer easements here~nbefor, e described as Parcels 1 and 2 to a manhole to be constructed in said sewer easement, Parcel 2, 667.22 feet north of said existing sewer main line in Fifth Street; thence continuing generally easterly in the sewer easement hereinbefore described as Parcel 2, 722.50 feet to a manhole to be constructed at the intersection of said sewer easement and t~e ~outherly terminus of Morse Drive, a private street; thence contxnu~ng northerly in Mm~se Drive592 f~et to a manhole to be constructed in the intersectzon of Morse Drmve and Hazard Avenue; thence continuing westerly in Hazard Avenue 140 feet to a manhole to be constructed in the intersection of Hazard Avenue and West Street; thence continuing northerly in West Street 1325.95 feet to a manhole to be constructed in West Street. 2. Easterly in Fay Circle for a distance of 165 feet from a manhole to be constructed in the main sewer line to be installed in West Street as hereinbefore set forth to the end of a sewer lateral to be constructed in Fay Circle at its easterly terminus. 3. Easterly in Mary Circle for a distance of 170 feet from a manhole to be constructed in the main sewer line to be in- stalled in West Street as hereinbefore set forth to the end of a sewer lateral to be constructed at the easterly terminus of Mary Circle. 4. C,....-.encing at a manhole robe constructed in the inter- section of West Street and Georgine Street in the main sewer line to be installed in West Street as hereinbefore set forth, thence easterly in West and Georgine Streets 400.55 feet to a manhole to be constructed in the intersection of Georgine Street and Elaine Drive; thence continulng southerly in Elaine Drive 887 feet to a manhole to be constructed in xts intersection.with Celeste Street, and thence continuing westerly in Celeste Street 400.27 feet to a manhole to be constructed in its intersection with West Street in the sewer main line to be installed in West Street as hereinbefore set forth. 5. Commencing at the manhole to be constructed in the intersection of Hazard Avenue and Morse Drive, as hereinbefore set forth, thence easterly in Hazard Avenue 400 feet to a manhole to be constructed with an eight inch stub facing east in its inter- section with La Vergn Way, a private street; thence continuing ~outherly in La Vergn Way 594 feet to a manhole to be constructed xn its intmrsectionwith the sewer easement hereinbefore described as Parcel 2; thence continuing westerly in said sewer easement 401 feet to the manhole to be constructed as hereinbefore set forth in the intersection of said sewer easement and Morse Drive. SECTION 2: All of the above mentioned work, including the grade to which said work shall be done and the location thereof in and upon the streets and rights of way above mentioned, shall be done upon the grades, along the lines, between the points, of the dimensions, at the places and in the manner described and set -2- forth in the p. lans, profiles and detailed drawings of said w.o~k and to specifzcattons for said work heretofore adopted_by sazd City Council on July 17, 1967 by its.Resolution No. 67 115, w.hich plans, profiles, detailed drawzngs and specificatio.ns are on fzle in the office of the Director of Public Works and whzch are hereby referred to for a more particular description of said work, grade of said work, and location of said work 'in and along the streets and rights of way hereinbefore mentioned. SECTION 3:. That said c.ontemplated work and improvement.s, in the opinion of said City Council, is of more than local or ordznary public benefit, and that the expenses and cost of said work and im- provem.ents shall be chargeable upon a district, which said district said Czty Council hereby_declares to be the district benefited by the work and improvements herein described and to be assessed to pay the cost and expenses thereof; said district shall include that territory in said City of Santa ~ which is shown upon that certain plat or map thereof on file ih the office of the Clerk of the Council of said City of Santa Ana, entitled '~)IAGRAM OF ASSESSMENT DISTRICT NO. 226," and which said map or plat.indicates by a boundary line the extent of the territor7 included in the proposed district and Covers all details as to the extent of the area to be assessed, and to which reference is hereby made. SECTION 4: NOTICE IS HEREBY GIVEN that serial bonds shall be issued in the manner and form provided in Part 5, Division 7 of the Streets and Highways Code of the State of California, the Improvement Act of 1911, to represent unpaid assessments of Fifty Dollars ($50.00) or over, which said bonds shall bear intereat at the rate of sixpercent (6%) per annum and the last installment of which bonds shall mature nine (9) years from the second day of January next succeeding the first day of September following their date. SECTION 5: NOTICE IS HEREBY FURTHER GIVEN that on Monday, the 21st day of August, 1967, at the hour of 7:30 o'clock P.M. of said day, in the council chambers in the City Hall in said City of Santa Arm, the maeti.ng, place of sa.id City Cou. nCil? any and all persons having a. ny objections to the proposeu work or ~mprovements, or any obo ections to the grades to Which said work is to be done, or any objections to the boundaries of the district proposed to be assessed to pay the cost and expenses of said work and im~.rovements may appear before said City Council and show why samd propose, d work or improvements shoul.d not be carried out in accordance wzth this resolution of intent~on, and may present written protests in the form and manner required b.y la.w not later than the hour hereinabove set for hearing ob3ectlons against the doing of said work, the grades to which said work is to be done, or the extent of the territory to be assessed to pay the cost and expenses thereof. SECTION 6: NOTICE IS HERE~Y FURTHER GIVEN that a public hearing will be held by said City Council,pursuant to the provisions of~rticle XIII, Sectmon 17, of the Constmtution, and Division 4 of the Streets and Highways Code of theState of California, Sections 7230 to 7233, inclusive, of the Santa Aha Municipal Code, and -3- Resolution No. 67-116 of this City Council adopted July 17, 1967 for the purpose of finding and determining whether the public ~convenien.ce and necessity require the aforesaid work and improvement. · ~aid publmc hearing shall be held concurrently and combined with the protest hearing provided for in Section 5 of this Resolution of Intention at 7:30 o'clock P.M. on Monday, August 21, 1967, or as soon thereafter as said public hearing can be held, in the council chambers in the City Hall in said City of Santa Aha, California, at which time any person desiring may appear and be heard. SECTION 7: The Clerk of the Council of said City of Santa Aha shall cause this resolution of intention to be publtshe, d twice in the Santa Aha Register, a newsPaper of genera.1 circulatmon, published and circulated in said City of Santa Aha, whmch said news- paper has heretofore been designated by said City Council.as the newspaper in which shall be printed and published all notzces, . resolutions, orders and other matters required to be published ~n the proceedings to be taken pursuant to this resolution and under the provisions of the Improvement Act of 1911; the first publica- tion of said notice shall be not less than ten (10) days prior to the date herein fixed for the public hearing fixed by this resolution of intention. SECTION 8: The Superintendent of Streets of said City of Santa Ana shall cause to be conspicuously posted along the line of sa~d.contemplated work and improvements, and on all the open streets withmn the assessment district, notice of the passage of this resolution of intention in the time, form and manner required by law. SECTION 9: The Clerk of the Council of said City of Santa Ama is herebydirected to mail notice? of the adoption of this resolution of intention, postage prepamd, to all persons owning real property proposed to be assessed to pay any part of the cost of said work, whose names and addresses appear on the last equalized assessment roll for real property taxes, or as known to said Clerk. Said mailing is to be completed at least fifteen (15) days prior to the day herein fixed for the public hearing on this~ resolution of intention, all in the time, form and manner prescribed in said Improvement Act of 1911. SECTION 10: NOTICE IS HEREBY FURTHER GIVEN that the grades to which said work is to be done are, or may be in part, new and different from those heretofore established, or may be and in some cases are different from existing ground levels. SECTION 11: The total estimated cost of said work and improvements, including estimated incidental costs, is in the amount of $103,041.00. SECTION 12: The estimated cost of said acquisition of property is $6,959.00 and is in addition to the total estimated cost of saidwork and improvements hereinabove set forth. SECTION 13: All of the lands, rights of way and ease- ments aforesaid, required in said work and improvements, shall be acquired by the City of Santa Arm, California by gift, purchase or condemnation. Said City Council shall advance the cost thereof -4- from the general fund of said Cit~ of Santa Ana, and shall assess such cost thereof, including the zncidental expenses thereof, as a part of the cost of said improvement. SECTION 14: NUfICE IS H~R~BY FURTHER GIVEN that the redemption provisions of the serialbonds above mentioned in Section 4 hereof shall provide, in addition to all other matters required by law, for the payment of a premium of five percent (5%) of the.u~-tured principal thereof, should the owner or anyperson interested.in any lot or parcel of land upon which such bonds have been xssued desire to pay off any of such bonds and discharge the land described an any of such bonds from the lien of said assessment prior to lts maturity and the commence- ment of proceedings for sale.
