HomeMy WebLinkAbout67-140RESOLUTION 67-140 AUTHORIZING CONDEMNATION OF REAL PROPERTY FOR THE WIDENING AND IMPROVEMENT OF FIRST STREET FROM HESPERIAN STREET TO BAKER STREET WHEREAS, portions of First Street as they now exist within the City of Santa Ana are inadequate in width to accommodate the increasing flow of east-west traffic and it has become necessary to widen and improve those portions of said street; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby find and declare that the public interest and necessity require that First Street be widened and improved from Hesperian Street to Baker Street to accommodate the increased flow of east-west traffic and further require that said City do have, take, and acquire for street purposes that certain real property in the City of Santa Aha, County of Orange, State of California, described as: PARCEL 1: Lot One in Block "A" of the Bessonett Tract, as shown on a map recorded in Book 24, Page 73, Miscellaneous Records of Los Angeles County, California. PARCEL 2: An easement for street purposes over the southerly 40 feet of the easterly 50 feet of Lot Three in Block "A" of the Bessonett Tract, as shown on a map recorded in Book 24, Page 73, Miscellaneous Records of Los Angeles County, California. PARCEL 4: The easterly one-half of Lot Seven and the westerly 13 feet of Lot Five in Block "A" of the Bessonett Tract, as shown on a map recorded in Book 24, Page 73, Miscellaneous Records of Los Angeles County, California. PARCEL 5A: An easement for street purposes over the southerly 40 feet of the west 40 feet of Lot Nine in Block "A" of the Bessonett Tract, as shown on a map recorded in Book 24, Page 73, Miscellaneous Records of Los Angeles County, California. PARCEL 5B: An easement for street purposes over the southerly 40 feet of Lot Eleven in Block "A" of the Bessonett Tract, as shown on a map recorded in Book 24, Page 73, Miscellaneous Records of Los Angeles County, California. PARCEL 6A: An easement for street purposes over the southerly 40 feet of Lot Thirteen in Block "A" of the Bessonett Tract, as shown on a map recorded in Book 24, Page 73, Miscellaneous Records of Los Angeles County, California. PARCEL 10: An easement for street purposes over those portions of Lot Twenty-Three and Lot TWenty-Five in Block "A" of the Bessonett Tract, as shown on a map recorded in Book 24, Page 73, Miscellaneous Records of Los Angeles County, California, described as follows: Parcel 1: The southerly 40 feet of Lots 23 and 25. EXCEPTING from Lot 25 those portions previously dedicated for street purposes. Parcel 2. The southerly 65 feet of the westerly 20 feet of Lot 25. EXCEPTING those portions previously dedicated for street purposes. ALSO EXCEPTING the southerly 40 feet included within Parcel 1 above-described. Parcel 3. A spandrel shaped parcel bounded southerly by the north line of Parcel 1, bounded westerly by the east line of Parcel 2, and bounded north- easterly by the arc of a curve concave north- easterly, having a radius of 25 feet and being tangent to the north line of Parcel 1 and the east line of Parcel 2. PAI%CEL llA: An easement for street purposes over those portions of the southerly 82 feet of Lots Seventeen and Eighteen in Block "D" of Goldsmith's Addition to the Town of Santa Ana, as shown on a map recorded in Book 31, page 23, of Miscellaneous Records of Los Angeles County, California, described as follows: Parcel 1: The southerly 40 feet. EXCEPTING from Lot 18 those portions previously dedicated for street purposes. Parcel 2: The southerly 65 feet of the easterly 20 feet. EXCEPTING from Lot 18 those portions previously dedicated for street purposes. ALSO EXCEPTING the southerly 40 feet included within Parcel 1 above-described. Parcel 3: A spandrel shaped parcel bounded southerly by the north line of Parcel 1, bounded easterly by the west line of Parcel 2, and bounded northwesterly by the arc of a curve concave northwesterly, having a radius of 25 feet, and being tangent to the north line of Parcel 1 and the west line of Parcel 2. PARCEL llAA: A temporary easement to be used in conjunction with the demolition of existing improvements over those portions of the southerly 82 feet of Lots Seventeen and Eighteen in Block "D" of Goldsmith's Addition to the Town of Santa Ana as shown on a map recorded in Book 31, page 23, Miscellaneous Records of Los Angeles County, California, described as follows: -2- PARCEL liB: PARCEL 12A: PARCEL 12B: PARCEL 13: PARCEL 14: PARCEL 15A: Parcel 1: The northerly 42 feet. EXCEPTING from Lot 18, those portions previously dedicated for street purposes. ALSO EXCEPTING from Lot 18, the westerly 10 feet of the easterly 20 feet of the southerly 25 feet. ALSO EXCEPTING from Lot 18, a spandrel shaped parcel bounded southerly by a line parallel with and distant northerly, 40 feet, measured at right angles, from the south line of Lot 18, bounded easterly by a line parallel with and distant westerly, 20 feet, measured at right angles, from the east line of Lot 18, and bounded northwesterly by the arc of a curve concave northwesterly, having a radius of 25 feet, and being tangent to said line that is parallel with and distant westerly, 20 feet, and being tangent to said line that is parallel with and distant northerly, 40 feet. Said temporary easement shall cease to exist and all rights thereto will revert to the recorded owners as their interest appears of record upon completion and acceptance by the City of Santa Aha of said demolition of existing improvements, but not later than August 1, 1968. An easement for street purposes over those portions of Lot Sixteen and the northerly 40 feet of Lots Seventeen and Eighteen in Block "D" of Goldsmith's Addition to the Town of Santa Ana, as shown on a map recorded in Book 31, Page 23, of Miscellaneous Records of Los Angeles County, California, described as follows: The Southerly 40 feet of Lot 16. Lot Fifteen in Block "D" of Goldsmith's Addition to the Town of Santa Ana, as shown on a map recorded in Book 31, Page 23, Miscellaneous Records of Los Angeles County, California. Lot Fourteen in Block "D" of Goldsmith's Addition to the Town of Santa Ana, as shown on a map recorded in Book 31, Page 23, Miscellaneous Records of Los Angeles County, California. E~CEPTING THEREFROM the West 9 feet. Lot Thirteen and the west 9 feet of Lot Fourteen in Block "D" of Goldsmith's Addition to the Town of Santa Ana, as shown on a map recorded in Book 31, Page 23, of Miscellaneous Records of Los Angeles County, California, EXCEPTING THEREFROM the West 18 feet of said Lot Thirteen. EXCEPTING THEREFROM the West 27 feet of said Lot 12. An easement for street purposes over the southerly 40 feet of the east 16 feet of Lot Eleven and the southerly 40 feet of the west 27 feet of Lot Twelve in Block "D" of GoldsmitP~s Addition to the Town of_Santa Ana, as shown on a map recorded in Book 31, Page 23, Miscellaneous Records of Los Angeles County, California. -3- PARCEL 15AA: A temporary easement to be used in conjunction with the demolition of existing improvements over the northerly 82 feet of the east 16 feet of Lot Eleven and the northerly 82 feet of the west 27 feet of Lot Twelve in Block "D" of Goldsmith's Addition to the Town of Santa Ana, as shown on a map recorded in Book 31, Page 23, Miscellaneous Records of Los Angeles County, California. Said temporary easement shall cease to exist and all rights thereto will revert to the recorded owners as their interest appears of record upon completion and acceptance, by the City of San~ Ana, of said demolition of existing improvements, but not later than August 1, 1968. PARCEL 15B: An easement for street purposes over the Southerly 40 feet of the east 8 feet of Lot Ten and the southerly 40 feet of the west 36 feet of Lot Eleven in Block "D" of Gold- smith's Addition to the Town of Santa Ana, as shown on a Map recorded in Book 31, Page 23, Miscellaneous Records of Los Angeles County, California. PARCEL 15C: An easement for street purposes over those portions of the west 44 feet of Lot Ten in Block "D" of Goldsmith's Addition to the Town of Santa Ana, as shown on a map recorded in Book 31, Page 23, Miscellaneous Records of Los Angeles County, California, described as follows: Parcel 1: The Southerly 40 feet. Parcel 2: A spandrel shaped parcel bounded southerly by the north line of Parcel 1, bounded westerly by the west line of said Lot Ten, and bounded northeasterly by the arc of a curve concave northeasterly having a radius of 25 feet and being tangent to the north line of Parcel 1 and the west line of Lot Ten. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City of Santa Ana to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; 2. That the public interest, necessity, and convenience require, and it is hereby ordered, that said City take immediate possession and use of the property herein ordered to be acquired upon compliance with the requirements of law applicable thereto as rights of way for public use; 3. That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury. 4. That the City of Santa Ana, a municipal corporation, is authorized and empowered to provide for the opening, extension, widening, construction, and maintenance of public streets and highways within the City; and 5. That said action in condemnation shall be taken in accord- ance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain.
