HomeMy WebLinkAbout68-001RESOLUTION 68-1 OVERRULING THE DECISION OF THE PLANNING COMMISSION AND GRANTING A VARIANCE ON APPLICATION 67-102 FILED BY WESTMARK DEVELOPMENT CO., SUBJECT TO APPLICABLE CONDITIONS W~EREAS, after hearing on notice, the Planning Commission DENIED a variance on Variance Application 67-102 filed by WESTMARK DEVELOPMENT COMPANY, and Appeal Application No. 202 was duly filed by the applicant presenting the matter to the City Council; and WHEREAS, the City Council, after public hearing on notice, and on the basis of the revised plan submitted by the applicant, has determined that said variance meets the requirements of Section 9250.8 of the Santa Ana Municipal Code; that the decision of the Planning Commission should be overruled; and that said variance should be granted subject to applicable conditions; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby overrule the decision of the Planning Cor~mission and does hereby grant a variance on Variance Application 67-102 to permit the construction of a 48-unit apartment complex in a C-1 Dis trict located at 1313 West Memory Lane, Santa Ana, California. said Variance is granted subject to the following applicable conditions: That a detailed landscaped plan be submitted to and approved by the Planning Department, said plan to be implemented and continuously maintained. THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE OF A BUILDING PERMIT: 2e That the subdivider's engineer furnish the Department of Public Works a runoff study based on a storm of a ten-year frequency. This study to show existing and proposed facilities and method of draining this area and tributary areas without exceeding the capacity of any street on-site or off-site. e That an easement be provided for Memory Lane for a width of 50 feet, center line to property line, for street purposes and vehicular access rights to Memory Lane except at approved drives. NOTE: Access can be determined and approved prior to dedication. NOTE: Dedication shall be initiated by owner, through the Department of Public Works, at least two weeks prior to application for a building permit to avoid delay. 4. That all elevations be on 1958 Orange County Survey Datum. 5. That the subdivider submit street improvement plans for Memory Lane. 6e That all plans and surveys for the required improvements be completed by the owner's engineer and submitted to the Department of Public Works for approval. THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: 7. That the owner provide sanitary sewer and storm drain facilities to meet with the approval of the Department of Public Works. Be That the owner place curb, gutter, and sidewalk and pave up to the edge of existing pavement on Memory Lane. The new curb and gutter to be placed 42 feet north of the center of Memory Lane. -1- PASSED AND ADOPTED by the City Council of the City of Santa Aha at its regular meeting held on the 2nd day of January, 1968.
