FROM CONDITIONS IMPOSED BY THE PLANNING COMMISSION
IN GR3~NTING CONDITIONAL USE PERMIT ON APPLICATION
NO. 67-12 FILED BY DAVID AND PATRICK PRIZIO
WHEP~EAS, after public hearing on notice, the Planning
Commission has granted Conditional Use Permit No. 67-12 on appli-
cation filed by DAVID and PATRICK PRIZIO to permit the use of an
industrial building at 1521-1535 South Grand Avenue, Santa Aha,
in an M-1 District, for office purposes; said Conditional Use
Permit was granted subject to certain conditions; and
WHEREAS, Appeal Application No. 203 was duly filed by the
applicants, appealing the condition imposed by the Planning
Commission requiring the dedication of a 5-foot easement for Grand
Avenue, and presenting the matter to the City Council; and
WHEREAS, after public hearing on notice, the City Council
found Condition No. 4 to be unreasonable under existing circumstances
and that it should be deleted from the conditions imposed by the
Planning Commission in granting said Conditional Use Permit;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana does hereby overrule the decision of the Planning
Commission and deletes Condition No. 4 imposed by the Planning
Commission in granting said Conditional Use Permit. Said Conditional
Use Permit is granted subject to the following conditions:
That a revised plot plan of the off-street parking spaces on
the west side of the building be submitted to the Planning
Department for approval and that the development be according
to the revised plot plan, except for minor modifications
approved by the Planning Department;
That this approval does not permit any commercial retail sales
or activities on the subject property unless clearly secondary
to a permitted use; and
That the recorded easement be provided for ingress and egress
over that portion of the westerly 20 feet of Lot 12, Tract
4471, for use by the subject property for a period equal to
the life of the office use.
