ZONING ADMINISTRATOR AND GRANTING A VARIANCE ON
VARIANCE APPLICATION 67-119 FILED BY CHRISTESON
DEVELOPMENT CO., SUBJECT TO CERTAIN CONDITIONS
WHEREAS, after public hearing on notice the Zoning Administrator
granted a variance on Variance Application No. 67-119, filed by
CHRISTESON DEVELOPMENT CO., to permit the construction of single
family dwellings with less than the required street side yards on
property located on the north side of Santa Clara Avenue between
Olive Lane and Westwood Avenue, in an R-1 District; and
W~EREAS, Appeal Application No. 205 was filed by HAKOLD UTSLER
appealing the decision of the Zoning Administrator to grant said
Variance and presenting the matter to the City Council; and
W~EREAS, the City Council, after public hearing on notice,
has determined that said Variance Application meets the requirements
of Section 9250.8 of the Santa Ana Municipal Code and that said
variance should be granted subject to the applicable conditions.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana does hereby affirm the decision of the Zoning
Administrator and does hereby grant a variance on Variance Application
No. 67-119 to permit the construction of single family dwellings
with less than the required street side yards on property located on
the north side of Santa Clara Avenue between Olive Lane and Westwood
Avenue, in an R-1 District; said Variance is granted subject to the
following applicable conditions:
1. That the proposed single family dwellings maintain a street
side yard of not less than five feet;
2. That the development otherwise conform to all provisions of
the Zoning Ordinance;
3. That vehicular access shall not be permitted from Santa Clara
Avenue to the four lots in question; and
That this Variance be valid only if Tentative Tract 6540 is
approved by Council and the conditions imposed thereon are
adhered to by the developer.
