CITY OF SANTA ANA EXPRESSING OPPOSITION TO
FURTHER EXTENSION OF THE "RALPH M. BROWN ACT"
BY THE ADDITION OF THE SECTION SET OUT IN
ASSEMBLY BILL NUMBER 202
WI{EREAS, the City Council of the City of Santa Ana has been
made aware of the content of Assembly Bill 202, which proposes to add
a section to the "Brown Act"; and
WHEREAS, the said City Council is desirous that its views upon
the subject of said Assembly Bill 202 be made known to the legislators
representing this area and to the League of California Cities;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana wishes it known that it is opposed to any further
extension of the so-called "Ralph M. Brown Act" by the addition of
the section set out in Assembly Bill 202, by reason of the fact that
such section would inhibit citizens' groups from meeting with "public
personnel" to discuss matters of mutual concern; and for the additional
reasons hereinafter set out:
1. The section proposed by Assembly Bill 202 would
carry the effect of the "Ralph M. Brown Act" too deep into
the community, perverting the apparent spirit and intent
of the original author.
2. The City Council is impressed with the fact that
the state legislative body apparently does not feel the
same "safeguards" are necessary to protect the public from
its own machinations, but that only "local agencies" threaten
the abuse the Ralph M. Brown Act is designed to prevent.
BE IT FURTHER RESOLVED: That copies of this resolution be
sent to legislators representing this area, to the League of California
Cities, and to the Orange County League of California Cities.
PASSED AND ADOPTED by the City Council of the City of Santa Ana
at its regular meeting held on the 18th day of March, 1968.
