HomeMy WebLinkAbout68-094RESOLUTION 68-94 AUTHORIZING CONDEMNATION OF REAL PROPERTY FOR THE WIDENING OF SEVENTEENTH STREET BETWEEN BAKER STREET AND THE SANTA ANA FREEWAY WHEREAS, in order to provide for a more orderly flow of traffic on Seventeenth Street in the City of Santa Ana it has become necessary to widen and improve said street from Baker Street to the Santa Ana Freeway; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby find and declare that the public interest and necessity require that Seventeenth Street be widened and improved from Baker Street to the Santa Ana Freeway to provide for a more orderly flow of east-west traffic, and further require that said City do have, take,~and acquire for street purposes that certain real property in the City of Santa Ana, County of Orange, State of California, described as: PARCEL iA: That portion of the Wiley's Addition as shown on a map recorded in Book 1, Page 86, of Miscellaneous Maps, Record of Orange County, California, described as follows: Beginning at a point on the center line of Seventeenth Street, said point being 1169.98 feet east of the southwest corner of Section 6, Township 5 South, Range 9 West, San Bernardino Base and Meridian; thence North 0° 25' 00" West 179.09 feet to the Westerly line of the Southern Pacific Railroad reservation, 100 feet wide; thence Southeasterly along said reservation to the center line of Seventeenth Street; thence Westerly along the center line of Seventeenth Street a distance of 84.17 feet to the point of beginning. PARCEL lB: An easement for street purposes over the Southerly 50 feet of the following described property: The West 58 feet of the South 150 feet of the following: Beginning 15.53 chains East of the Southwest corner of Section 6, Township 5 South, Range 9 West, S.B.M.; thence East 3.52 chains, more or less, to the Westerly line of the Southern Pacific Railroad reservation; thence Northwesterly along said reservation to a point 6.21 chains due north of the South line of said Section 6; thence .5 of a chain; thence South 6.21 chains to the point of beginning. PARCEL lC: An easement for street purposes over the Southerly 52.00 feet of the following: That portion of the 7.48 acre parcel of land as shown on a Map of Wiley's Addition, said Map recorded in Book 1, Page 86, Miscellaneous Maps, Records of said Orange County, together with the portion of 17th Street adjoining said parcel On the South described as a whole as follows: BEGINNING at a point 1024.98 feet East of the Southwest corner of Section 6, in Township 5 South, Range 9 West, San Bernardino Base and Meridian, said point also being the Southwest corner of the land described in the deed to George B. MacGillivray recorded December 5, 1898 in Book 41, Page 21, Deeds, Records of said Orange County and running thence West 114 feet; thence North 380 feet; thence East 114 feet to the West line of said land of MacGillivray; thence South 380 feet; to the point of beginning. EXCEPT the West 54 feet. -1- PARCEL 2A: PARCEL 2B: PARCEL 3A: PARCEL 3B: PARCEL 4A: PARCEL 4B: PARCEL 5A: An easement for street purposes over the Southerly 10.00 feet of Lot 13 of Tract 1069, in the City of Santa Ana, County of Orange, State of california, as per map recorded in Book 34, Page 33, of Miscel- laneous Maps, in the office of the County Recorder of said County. An easement for street purposes over a spandrel shaped parcel of land bounded on the East by the East line of said Lot 13; bounded on the South by the North line of the the above mentioned Parcel 2A; and bounded Northwesterly by the arc of a curve concave Northwesterly, having a radius of 25.00 feet and tangent to said East and South boundaries. An easement for street purposes over the Northerly 10.00 feet of the West 90 feet of Lot 36, Tract 1196, in the City of Santa Ana, County of Orange, State of California, as show~a on a map recorded in Book 37, Pages 3 and 4 of Miscellaneous Maps, in the office of the County Recorder of said County. An easement for street purposes over a spandrel shaped parcel of land bounded on the West by the West line of said Lot 36; bounded on the South by the South line of above mentioned Parcel 3A; and bounded Southeasterly by the arc of a curve concave Southeasterly, having a radius of 25.00 feet and tangent to said North and West boundaries. An easement for street purposes over the Southerly 20.00 feet of Lot 8 of the Bush Street Tract, in the City of Santa Ana, County of Orange, State of California, as per map recorded in Book 6, Page 35, of Miscellaneous Maps, in the office of the County Recorder of said County; EXCEPTING THEREFROM that portion previously dedicated for street purposes. An easement for street purposes over a spandrel shaped parcel of land bounded on the East by the East line of said Lot 8; bounded on the South by the North line of the above-mentioned Parcel 4A; and bounded Northwesterly by the arc of a curve concave Northwesterly, having a radius of 25.00 feet and tangent to said East and South boundaries. An easement for street purposes over the Northerly 22.00 feet of that portion of that 7.48 acre parcel of land shown on a map of Wiley's Addition to Santa Ana City, City of Santa Ana, County of Orange, State of California, as per map recorded in Book 1, Page 86, of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows: Beginning at the intersection of the North line of Seventeenth Street as shown on said map and the East line of Spurgeon Street, as said street is described in'deed to the City of Santa Ana, recorded Noven%ber 26, 1906, ~n Book 139, Page 111 of~D~eds; thence North 55?00 feet along said east line of Spurgeon Street; thence East 158.00 feet parallel with said North line of Seventeenth Street; thence South 55.00 feet parallel with said East line of Spurgeon Street to said North line of Seventeenth Street; thence South 55.00 feet parallel with said East line of Spurgeon Street to said North line of Seventeenth Street; thence West 158.00 feet to the point of beginning. -2- PARCEL 5B: PARCEL 6: PARCEL 7: An easement for street purposes over a spandrel shaped parcel of land bounded on the West by the East line of Spurgeon Street; bounded on the South by a line parallel with and 52.00 feet Northerly, measured at right angles from the center line of Seventeenth Street; and bounded Northeasterly by the arc of a curve concave Northeasterly, having a radius of 25.00 feet and tangent to said West and South boundaries. An easement for street purposes over the North 50.00 feet of the following described property: Ail that certain real property situated in Section 12, Township 5 South, Range 10 West, San Bernardino Base and Meridian, described as follows: Beginning at the intersection of the northerly extension of the Westerly line of Lot 1 of Tract 1228, as shown on a map thereof recorded in Book 38, Page 42, Miscel- laneous Maps, records of said Orange County, with the northerly line of the land described in Parcel 1 in the deed to Emmet C. Rogers and wife, filed April 24, 1944, as Documents 11257 in the office of the Registrar of Titles of said Orange County, and running thence Southerly along said Northerly extension of Lot 1, and along the Westerly lines of Lots 1 and 2 of said Tract 1228, 180 feet to the Southwest corner of Lot 2 of said Tract 1228; thence Westerly, parallel with the center line of Seventeenth Street, as shown on the map of said Tract 1228, 144.54 feet, more or less, to the Westerly line of the land described in Parcel 1 in said deed to Rogers; thence Northerly along said Westerly line, 180 feet, more or less, to the Northerly line of the land described in Parcel 1 in said deed to Rogers; thence Easterly along said Northerly line 144.54 feet, more or less, to the point of beginning; EXCEPTING THEREFROM that portion previously dedicated for street purposes. Lot 7 of the Bush Street Tract, in the City of Santa Ana, County of Orange, State of California, as per map recorded in Book 6, Page 35, of Miscellaneous Maps, in the office of the County Recorder of said County. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City of Santa Ana to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; 2. That the public interest, necessity, and convenience require, and it is hereby ordered, that said City take immediate possession and use of the property herein ordered to be acquired upon compliance with the requirements of law applicable thereto as a right of way for public use; 3. That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury. 4. That the City of Santa Ana, a municipal corporation, is authorized and empowered to provide for the opening, extension, widening, construction, and maintenance of public streets and high- ways within the City; and -3- 5. That said action in condemnation shall be gaken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain.
