HomeMy WebLinkAbout68-095RESOLUTION 68-95 AUTHORIZING CONDEMNATION OF REAL PROPERTY FOR THE CONSTRUCTION OF NORTHEAST BOULEVARD FROM SANTIAGO STREET TO GRAND AVENUE WHEREAS, in order to facilitate the flow of vehicular traffic from the Civic Center area onto arterial surface streets within the City of Santa Ana and onto the Santa Ana Freeway, it has become necessary to construct a new highway within the City; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha does hereby find and declare that public interest and necessity require the acquisition of rights of way from Santiago Street to Grand Avenue for all the purposes of a public street in, through, and over that certain land in the City of Santa Ana, County of Orange, State of california, described as follows: PARCEL iA: The Southeasterly 12.00 feet of Lot 16, Block 52, of Santa Ana East, as shown on a map recorded in Book 10, Pages 43 and 44 of Miscellaneous Records of Los Angeles County, California; including all~hicular access rights to the lands lying Southeasterly of the Northwest line of the above described property. PARCEL lB: That portion of Lots 15 and 16, Block 52, of Santa Ana East, as shown on a map recorded in Book 10, Pages 43 and 44 of Miscellaneous Records of Los Angeles County, California, described as follows: A spandrel shaped parcel of land bounded Southwesterly by the Southwest line of said Lots 15 and 16; bounded South- easterly by the Northwest line of Parcel lA above described, and bounded Southerly by the arc of a curve concave Northerly having a radius of 25.00 feet and tangent to said Southwesterly and Southeasterly lines. PARCEL lC: Those portions of Lot 1, Block 51, of Santa Ana East, as shown on a map recorded in Book 10, Pages 43 and 44 of Miscellaneous Records of Los Angeles County, California, and of that portion of Fruit Street as vacated by the Board of Trustees of the City of Santa Ana, in Resolution No. 1809, a certified copy of which was recorded August 25, 1927, in Book 73, Page 308, of Official Records of Orange County, California, described as follows: Beginning at the most Southerly corner of Block 52 of said Santa Ana East, and running thence Northeasterly along the Southeasterly line of said Block 52 to the most Easterly corner thereof; thence Southeasterly along a straight line drawn between the most Easterly corner of said Block 52 and the most Northerly corner of said Block 51, and the continuation~ of said line a distance of 94.27 feet, more or less, to a point in the Northerly line of Fruit Street as it now exists, 60.00 feet in width; thence westerly along said Northerly line to a point in the Southeasterly prolongation of the Southwesterly line of said Block 52; thence Northwesterly along said South- easterly prolongation and along said Southwesterly line to the point of beginning. PARCEL Lot 8, Block D, Hawkin's Addition to Santa Ana, in the City of Santa Ana, as shown on a map recorded in Book 13, Page 26, of Miscellaneous Records of Los Angeles County, California. -1- PARCEL An easement for street purposes over that portion of Lot 15, Block E, Hawkin's Addition to Santa Aha, in the City of Santa Ana, as shown on a map recorded in Book 13, Page 26, of Miscellaneous Records of Los Angeles County, California, described as follows: Beginning at the Northwest corner of said Lot 15; thence Southerly along the West line of said Lot 15 a distance of 42.99 feet; thence Northeasterly in a straight line to a point on the North line of said Lot 15 which is 92.18 feet Easterly from said Northwest corner; thence Westerly along the North line of said Lot 15 a distance of 92.18 feet to the point of beginning; including all vehicular access rights to the lands lying Northwesterly of the Southeasterly line of the above-described property. PARCEL 3A: A temporary easement to be used in conjunction with the demolition of existing improvements over the following described property: That portion of Lot 15, Block E, Hawkin's Addition to Santa Ana, in the City of Santa Ana, as shown on a map recorded in Book 13, Page 26, of Miscellaneous Records of Los Angeles County, California, described as follows: Beginning at a point on the West line of said Lot 15 distant Southerly 42.99 feet from the Northwest corner of said Lot 15; thence Northeasterly in a straight line to a point on the North line of said Lot 15 which is 92.18 feet Easterly from said Northwest corner; thence Easterly a distance of 32.82 feet to the Northeast corner of said Lot 15; thence Southerly a distance of 50.00.feet; thence Westerly a distance of 125.00 feet; thence Northerly along the West line of said Lot 15 a distance of 7.01 feet to the point of beginning; Said temporary easement shall cease to exist and all rights thereto will revert to the record owners as their interests appear of record upon completion and acceptance by the City of Santa Ana of said demolition of existing improvements, and in any event not later than June 1, 1969. PARCEL Lot 13, Block E, Hawkin's Addition to Santa Ana, in the City of Santa Ana, as shown on a map recorded in Book 13, Page 26, of Miscellaneous Records of Los Angeles County, California. PARCEL Lot 8, Block E, Hawkin's Addition to Santa Ana, in the City of Santa Ana, as shown on a map recorded in Book 13, Page 26, of Miscellaneous Records of Los Angeles County, California. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City of Santa Ana to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; 2. That the public interest, necessity, and convenience require, and it is hereby ordered, that said City take immediate possession and use of the property herein ordered to be acquired, upon compliance with the requirements of law applicable thereto, as rights of way for public use; 3. That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury; -2- 4. That the City of Santa Ana, a municipal corporation, is authorized and empowered to provide for the opening, extension, widening, construction, and maintenance of public streets and high- ways within the City; and 5'. That said action in condemnation shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain.
