HomeMy WebLinkAbout68-144RESOLUTION 68-144 OVERRULING THE DECISION OF THE ZONING ADMINISTRATORAND GRANTING A VARIANCE ON APPLICATION 68-82 FILED BY GLEN C. J. FREESE SUBJECT TO APPLICABLE CONDITIONS WHEREAS, after public hearing on notice, the Zoning Adminis- trator DENIED a variance on Variance Application 68-82 filed by GLEN C. J. FREESE proposing to use the recently relocated building as a triplex rather than as a duplex as stipplated in Condition 6 of VA 67-6 at 5007 West Fifth Street, Santa Ana, California, in an R-1 District; and WHEREAS, Appeal Application No. 214 was filed by the applicant appealing the decision of the Zoning Administrator and presenting the matter to the City Council; and W}{EREAS, the City Council, after public hearing on notice, has determined that said Variance Application meets the requirements of Section 9250.8 of the Santa Aha Municipal Code and that said Variance should be granted subject to conditions imposed in the granting of Variance 67-6 and other applicable conditions; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha does hereby grant a variance on Variance Application 68-82, filed by GLEN C. J. FREESE to permit three dwellings in addition to two existing dwellings on an R-1 lot located at 5007 West Fifth Street, Santa Ana, california; said Variance is granted subject to the following conditions: 1. That development be according to the approved plot plan except for minor modifications approved by the Planning Department. 2. That the parking be according to City standards. That a full landscape plan be submitted to and approved by the Planning Department; all approved landscaping shall be planted and maintained. 4. That the move-in structure be placed three (3) feet more to the east than shown on the plot plan. 5. That paving be completed between existing house and garage at 5005 West Fifth Street. THE FOLLOWING CONDITION IS TO BE COMPLIED WITH PRIOR TO THE ISSUANCE OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: That the owner place curb, gutter, and sidewalk and pave up to the edge of existing pavement on Fifth and Sixth Streets. The new curb and gutter to be placed 18 feet north of the center lines of said streets. Note: city Plan No. 1-11-16 can be used. NOTE: In the event it is determined by the Director of Public Works that improvement is not feasible at this time, a cash bond or cash must be submitted in lieu of said improvements.
