HomeMy WebLinkAbout68-152RESOLUTION 68-152 AUTHORIZING EXECUTION OF QUITCLAIM DEEDS TO OWNERS OF RECORD WITH NO CASH CONSIDERATION WHEREAS, that portion of Alton Street lying between the Pacific Electric Railway and MacArthur Boulevard has been abandoned for street purposes and is of no further value to the City and should be released to the owners of the underlying fee; and WHEREAS, heretofore, the Santa Ana Valley Irrigation Company conveyed to the City of Santa Ana all right, title, and interest to easements and water facilities on the south side of Seventeenth Street and the east side of Sycamore Street, and it has been determined that said easement is of no further use to the City and should be quitelaimed to the owners of the underlying fee; and W}{EREAS, the owners of certain property located on the North side of Edinger Avenue, east of Main Street dedicated vehicular access rights to the City, and the present owners have now requested access rights at said location, which the City has determined should be granted; NOW, THEREFORE, BE IT RESOLVED: That the Mayor and the Clerk of the Council are hereby authorized and directed to execute a deed quitclaiming to THE VARIOUS OWNERS OF THE UNDEP~LYING FEE, AS THEIR RESPECTIVE INTERESTS MAY APPEAR OF RECORD, the following described property in the City of Santa Ana, County of Orange, State of California; Ail that portion of Alton Street, formerly Talbert Avenue, in the City of Santa Ana, County of Orange, State of California, lying between the easterly prolongation of the North line of the land described in the deed to said City recorded October 22, 1962, in Book 6292, Page 63, of Official Records, and the curved westerly line of the land described in the deed to Pacific Electric Railway Company, a corporation, recorded July 28, 1958, in Book 4364, Page 69, of Official Records. RESERVING an easement to construct, place, operate, inspect, maintain, repair, replace, and remove such aerial and under- ground telephone, telegraph, and communication structures as the Pacific Telephone Company may, from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, markers, and necessary fixtures and appurtenances over the northwesterly 5.00 feet of that portion of Alton Street above described. ALSO RESERVING THEREIN an easement for existing and proposed sewer facilities for use by the County Sanitation Districts of Orange County, California. ALSO RESERVING THEREIN for the City of Santa Aha an easement for a potable water main over the southeasterly 10.00 feet of the northwesterly 50.00 feet of that portion of Alton Street above described; and deliver the same to the Clerk of the Council. BE IT FURTHER RESOLVED: That the Mayor and the Clerk of the Council are hereby authorized and directed to execute a deed quit- claiming IN SEVERALTY TO THE VARIOUS OWNERS OF THE UNDERLYING FEE AS THEIR RESPECTIVE INTERESTS MAY APPEAR OF RECORD the following described real property in the City of Santa Ana, County of Orange, State of California: -1- Ail right, title and interest in and to the easements and water facilities conveyed by the Santa Ann Valley Irrigation Company to the City of Santa Ann by deed recorded June 5, 1964, in Book 7076 at Page 239, that is lying within the following described property: The West 100 feet of that portion of Section 12, Township 5 South, Range 10 West, in the land allotted to Jacob Ross in decree of partition on the Rancho Santiago de Santa Ann, recorded in Book B of Judgments of the 17th Judicial District Court, in the City of Santa Ann, County of Orange, State of California, described as follows: Beginning at the northeast corner of said Section 12; thence West 289.6 feet; thence South 177.5 feet; thence East 289.6 feet; thence North 177.5 feet to the point of beginning; and deliver the same to the Clerk of the Council. BE IT FURTHER RESOLVED: That the Mayor and the Clerk of the Council are hereby authorized and directed to execute a deed quit- claiming IN SEVERALTY TO THE VARIOUS OWNERS OF THE UNDERLYING FEE, AS THEIR RESPECTIVE INTEREST MAY APPEAR OF RECORD the following described real property in the City of Santa Ann, County of Orange, State of California: Parcel 1: Ail vehicular access rights to Edinger Avenue across the Easterly 10.96 feet of the Westerly 138.96 feet from the lands lying North of the South line of the following described land: The North 9.00 feet of Lot 35 in Block C of Tract 245, McFadden Home Place, Number 1, as shown on a map recorded in Book 13, Page 22 of Miscellaneous Maps, records of said County. Parcel 2: Ail vehicular access rights to Main Street across the Southerly 9.00 feet of the North 39.00 feet from the lands lying East of the East line of the following described land: The West 5.00 feet of Lot 29 Block C of Tract 245, McFadden Home Place, Number 1, as shown on a Map recorded in Book 13, Page 22 of Miscellaneous Maps, records of said County; and deliver the same to the Clerk of the Council.
