TO ABATE A PUBLIC NUISANCE EXISTING UPON A PUBLIC
RIGHT OF WAY
WHEREAS, there exists an encroachment upon a public right
of way in the City of Santa Ana; and
WHEREAS, the encroachment exists on the north side of
Seventeenth Street at or about its intersection with French Street,
and the encroachment consists of a building within the public
right of way; the common description of this building is 325 to 331 East
Seventeenth Street, Santa Ana, California; and i
WHEREAS, Section 731 of the Code of civil Procedure of the
State of California authorizes an action to be brought by the
City Attorney in the name of the people of the State of California
to abate said nuisance;
NOW, THEREFORE, BE IT RESOLVED: That the City Attorney is
hereby directed to institute such action as is authorized by law
to abate the nuisance existing within the public right of way
forthwith.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 21st day of October, 1968.
