HomeMy WebLinkAbout69-107RESOLUTION 69-107 AUTHORIZING CONDEMI~ATION OF EASEMENTS FOR STREET PURPOSES ON THE WEST SIDE OF MAIN STREET, SOUTH OF WARNER AVENUE WHEREAS, in order to provide for a more orderly flow of traffic on Main Street in the City of Santa Ana it has become necessary to widen and improve said street between Warner Avenue and the Pacific Electric Railway right of way; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby find and declare that the public interest and necessity require that Main Street be widened and improved between Warner Avenue and the Pacific Electric Railway right of way to provide for a more orderly flow of north-south traffic, and further require that said City do have, take, and acquire for street purposes that certain real property in the city of Santa Ana, County of Orange, State of California, described as: PARCEL 1: An easement for street purposes over the Easterly 27.00 feet of that portion of Section 25, Township 5 South, Range 10 West, S.B.B.& M., described as follows: Beginning at the intersection of the West line of South Main Street, as described in the deed to the County of Orange, recorded February 17, 1914 in Book 250, Page 73 of deeds, with the Northwesterly line of the strip of land 80 feet wide conveyed by James McFadden to H. E. Huntington, Trustee, by deed recorded June 7, 1909 in Book 174, Page 253 of deeds; thence North along the West line of Main Street 300 feet; thence at right angles West 292 feet; thence South parallel to the West line of said South Main Street to the northwesterly line of the land described in said deed to H. E. Huntington, Trustee, and thence northeasterly along said northwesterly line to the point of beginning. PARCEL 2: An easement for street purposes over the Easterly 60.00 feet of the North 475 feet of the East 322 feet of the following described land: Commencing at the Northeast corner of Section 25, Township 5 South, Range 10 West, S.B.B.&M.; running thence West along the North line of said Section, 990 feet; thence South 0° 39' 15" West, parallel to the East line of said Section 2146.96 feet to a point in the Northwesterly line of the strip of land 80 feet wide conveyed by James McFadden to H. E. Huntington, Trustee, by deed recorded June 7, 1909 in Book 174, Page 253 of Deeds; thence Northeasterly along the North- westerly line of said 80-foot strip to a point in the East line of said Section; thence North 0° 39' 15" East along the East line of said Section 1580 feet to the point of beginning. Excepting therefrom those portions previously dedicated for street purposes. BE IT FURTHER RESOLVED: 1. That the City Attorney is hereby ordered to bring an action in the name of the City of Santa Ana to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; -1- 2. That the public interest, necessity, and convenience require, and it is hereby ordered, that said city take immediate possession and use of the property herein ordered to be acquired upon compliance with the requirements of law applicable thereto as a right of way for public use; 3. That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury. 4. That the City of Santa Aha, a municipal corporation, is authorized and empowered to provide for the opening, extension, widening, construction and maintenance of public streets and high- ways within the City; and 5. That said action in condemnation shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain. PASSED AND ADOPTED by the city Council of the City of Santa Ana at its regular meeting held on the 2~hd day of July, 1969.
