HomeMy WebLinkAbout69-146RESOLUTION 69-146 AUTHORIZING THE EXCHANGE OF EASEMENTS BETWEEN THE CITY AiqD LESTER AND VIVIAN ELBERT, ET AL., WHICH INVOLVES PROPERTY ON THE NORTH SIDE OF McFADDEN AVENUE, WEST OF SULLIVAN, RESULTING IN NO CASH CONSIDERATION WHEREAS, the parties hereto mutually desire to create community easements for mutual ingress to and egress from their respective properties; NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana hereby accepts a deed from LESTER ELBERT and VIVIAN ELBERT, husband and wife; SIDNEY PENN and BARBARA PENN, husband and wife; and ERNEST ROSS and DELORACE ROSS, husband and wife, conveying to the city the real property in the city of Santa Ana, County of Orange, State of california, described as follows: An easement for ingress and egress to and from the land hereinafter described as PARCEL Z over the Westerly 15.00 feet~f the Easterly 168 feet of the Northerly 150.00 feet of the Southerly 192.00 feet of those portions of Lots 38, 39, and 40 of Map of Replat of Santa Ana Acres, as shown on a map recorded in Book 5, Page 8 of Miscellaneous Maps, records of Orange County, california, described as follows: Beginning at a point on-the center line of McFadden Avenue distant South 89° 22' 58" West, 721.17 feet from the intersection of the center line of Sullivan Street and the center line of McFadden Avenue, as shown on the Map of Tract No. 4025, recorded in Book 146, Pages 46 through 50 of Miscellaneous Maps, records of Orange County california; thence North 0~ 46' 50" West a distance of 192.00 feet to a point on a line parallel with and distant 192.00 feet Northerly, measured at right angles from said center line of McFadden Avenue; thence North 89° 22' 58" East a distance of 153 feet to the West line of the land described in the deed to Lands and Buildings, Inc., recorded April 10, 1962 in Book 6069, Page 645 of Official Records; thence North 0° 46' 50" West a distance of 268.00 feet to a point on a line parallel with and distant 460.00 feet Northerly, measured at right angles, from said center line of McFadden Avenue; thence South 89° 22' 58" West a distance of 423.71 feet to a point on a line parallel with and distant 423.71 feet Westerly, measured at right angles, from said West line of Lands and Buildings Inc.; thence South 0° 46' 50" East a distance of 268.00 feet to a point on a line parallel with and distant 192.00 feet Northerly, measured at right angles, from 'the center line of said McFadden Avenue; thence North 89° 22' 50" East a distance of 77.08 feet to a point on a line parallel with and distant 346.65 feet Westerly, measured at right angles, from said West line of Lands and Buildings Inc.; thence South 0° 46' 50" East a distance of 192.00 feet to said center line of McFadden Avenue; thence along said center line, North 89° 22' 58" East, to the TRUE POINT OF BEGINNING; BE IT FURTHER RESOLVED: That the Mayor and the Clerk of the Council are hereby authorized and directed to execute a deed for and on behalf of the City quitclaiming to LESTER ELBERT and VIVIAN ELBERT, husband and wife; SIDNEY PENN and BARBARA PENN, husband and wife; and ERNEST ROSS and DELORACE ROSS, husband and wife, and to their successors or assigns, the real ~roperty in the city of Santa Ana, County of Orange, State of california, described as follows: An easement for ingress and egress to and from the land herein after described as Parcel Z over the Westerly 10.00 feet of the Easterly 153.00 feet of the Northerly 150.00 feet of the Southerly 192.00 feet of those portions of Lots 38 and 39 of map of replat of Santa Ana Acres, as per map recorded in Book 5, Page 8 of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows: -1- Beginning at the intersection of the center line of Sullivan Street and the center line of McFadden Avenue, as shown on a map of Tract No. 4025, recorded in Book 146, Pages 46 and 50 inclu- sive, of Miscellaneous Maps, records of Orange County, California; thence along said center line of McFadden Avenue, South 89° 22' 58" West, 568.17 feet to the Southwesterly corner of the land described in deed to Lands and Buildings, Inc., recorded April 10, 1962 in Book 6069, Page 645 of Official Records of said County, being also the TRUE POINT OF BEGINNING; thence along the Westerly line of said land, North 0° 46' 50" West to a line parallel with and distant Northerly 192.00 feet, measured at right angles, from said center line of McFadden Avenue; thence along said parallel line, South 89° 22' 58" West to a line parallel with and distant Westerly 153.00 feet, measured at right angles, from said Westerly line; thence Southerly along said last mentioned parallel line, 192.00 feet, to said center line of McFadden Avenue; thence along said center line, North 89° 22' 58" East, to the TRUE POINT OF BEGINNING.
