RESOLUTION DETERMINING THAT THE PUBLIC CONVENIENCE
AND NECESSITY REQUIRE IMPROVEMENT WORK
ASSESSMENT DISTRICT NO. 236
SANTA ANA, CALIFORNIA
WHEREAS, the City Council of the City of Santa Aha,
California did, on the 17th day of November~ 1969, in adopting
its Resolutions No. 69-173 and 69-174 in thxs assessment district,
order that a public hearing be held on.the 5th day of January,
1970 at 7:30 o'clock P.M. in the councxl chambers in the Cxty
Hall in said City of Sant9 Aha concurrently with the protest
hearing under its Resolutzon of Intention No. 69-174 for the pur-
pose of finding and determining whether the public convenience and
necessity require the improvements proposed to be constructed as
described in said Resolution of Intention No. 69-174; and
WHEREAS, notice of the adoption of said Resolution No.
69-173 and of said Resolution of Intention No. 69-174 by mailing,
posting and publication was given in the time, form and manner as
required by law, as shown by the affidavits of mailing, posting and
publication on file in the office of the Clerk of the Councxl of
said City of Santa Ana; and
WHEREAS, said City Council continued said hearings until
Monday, February 16, 1970 at 7:30 o'clock P.M., rejected bids
received for construction of said improvements, and ordered that
new bids therefor be sought, returnable on February 16, 1970; and
WHEREAS, protests or objections, in writing or otherwise,
made by the owners of more than half of the area of the property to
be assessed for said improvements against the proposed work and
improvement, the extent of the district to be assessed, or the grades
to which said work is proposed to be done, have not been made or
presented up to the hour set for hearing in and by said Resolution
of Intention No. 69-174, and no person, other than owners of pro-
perty within said assessment district, appeared at said public
hearings and made objections that the public convenience and
necessity did not require such improvement; and
WHEREAS, said City Council received testimony from the
Director of Public Works of said City of Santa Ana that said pro-
gosed work and improvement in the assessment district proposed to
e assessed for such work and improvement is, in his opinion,
required for the public convenience and necessity.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Santa Aha, California, in regular session assembled this
16th day of February, 1970, that said City Council hereby finds
and determines that said proposed work and improvement zs feasible,
and that the public interest, convenience and necessity requir? '
such impr?vement, and that all protests, both oral and in writzng,
to the dozng of said work be and the same hereby are overruled and
denied.
