HomeMy WebLinkAbout70-038RESOLUTION 70-38 AFFIRMING THE DECISION OF THE PLANNING COMMISSION AND GRANTING A VARIANCE ON VARIANCE APPLICATION 69-102, SUBJECT TO CERTAIN APPLICABLE CONDITIONS WHEREAS, after public hearing on notice, the Planning Commission granted a variance on Variance Application 69-102, filed by JOSEPH R. CALLENS, to permit the construction of a garden apartment complex and a commercial building in the R-1 District at 3771 South Greenville Street, Santa Ana; and WHEREAS, the City Council on its own motion set the matter for hearing; and WHEREAS, the City Council, after public hearing on notice has determined that said Variance Application meets the requirements of Section 41-638 of the Santa Ana Municipal Code and that said Variance should be granted with the modification that there shall be no commercial buildings or enterprises within said development subject to certain applicable conditions: NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby affirm the decision of the Planning commission and does hereby grant a variance on Variance Application 69-102, filed by JOSEPH R. CALLENS, to permit the construction of a garden apartment complex in the R-1 District. The application to include within the garden apartment complex buildings for commercial use is denied. Said Variance is granted subject to the following conditions: That a revised plot plan be submitted to the approved by the Planning Department indicating the following: (a) Fire Department approval of access to interior apartments; (b) location of trash areas; o That development be according to the approved revised plot plan except for minor modifications to be approved by the Planning Department, and except for the deletion of commercial structures. o That a detailed landscape plan be submitted to and approved by the Planning Department, and the approved plan be implemented and all landscaping be continuously maintained. Trash and storage areas shall be screened from the apart- ments with a minimum 6-foot high opaque wall or fence and a solid gate with adequate access to and from these areas for collection vehicles. 5. That there is a minimum of 15 feet between main buildings clear of balconies, landings, or stairways. 6. That a floor plan for the proposed child day care center be submitted to and approved by the Planning Department; 7e A concrete block wall 6 feet in height measured from the lowest finished grade on either side of the wall be constructed along the north and east property lines; Be Additional units may be added with the removal of the convenience center. Said additional units shall meet with the approval of the Planning Department. THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE OF A BUILDING PERMIT: -1- o Furnish the Department of Public Works a run-off study based on a storm of a ten-year frequency by a civil engineer showing existing and proposed facilities and methods of draining this area and tributary areas without exceeding the capacity of a street on-site or off-site; 10. Furnish the Department of Public Works a final grading plan and an on-site drainage flow plan showing the direction of flow to the adjacent streets when this property is developed; 11. Provide a street easement for Sunflower Avenue for a width of 40 feet center line to property line and to include a 25-foot radius property line spandrel at the northeast corner of Sunflower Avenue and Greenville Street and to include vehicular access rights to Sunflower Avenue except at approved drives; NOTE: Dedication shall be initiated by owner, through the Department of Public Works, at least four weeks prior to application for a building permit to avoid delay. 12. Submit street improvement plans by a civil engineer for Sunflower Avenue and Greenville Street. (See improvement plans for Tract 6690, 1-59-8 and 1-20); (Ail elevations to be on 1958 Orange County Survey Datum.) 13. Pay drainage assessment fee; 14. Ail plans and surveys for the required improvements shall be completed by the engineer and submitted to the Department of Public Works for approval; 15. Install ornamental street lights as required by the Traffic Engineer. THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO ISSUANCE OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: 16. Provide storm drain and sanitary sewer facilities as required by the Department of Public Works; 17. Pay Sanitary District 7 fees when sewer facilities become available; NOTE: The developer will have to contact Sanitation District No. 7 and arrange for the c~nstruction of a proposed master trunk sewer main in this area to allow any development at this time. 18. Improve Sunflower Avenue to include curb and gutter, pavement as required and full width sidewalk with tree wells and trees. Curb to be at 32 feet north of center line of Sunflower Avenue. Improvement of Sunflower Avenue is alsb~to include storm drain facilities as required. 19. Improve Greenville Street to include curb and gutter, pavement to meet existing good pavement and sidewalk. From Sunflower Avenue to 300 feet north, the curb to be at 22 feet east of the center line of Greenville Street with full width sidewalk with tree wells and trees. From 300 feet north of Sunflower Avenue to the north, curb to be at 20 feet east of the center line of Greenville Street. (Construction of storm drain in Greenville Street may be required.) 20. Provide on-site underground utility connections per Ordinance NS-903. -2- PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 20th day of April, 1970.
