HomeMy WebLinkAbout70-072RESOLUTION 70-72 APPROVING MAP AND DECLARING INTENTION TO VACATE SHERWOOD STREET AT MAPLE STREET AND GIVING NOTICE OF HEARING THEREON WHEREAS, a request for the vacation of Sherwood Street at Maple Street has been received by the City Council, and the Department of Public Works and the Planning Commission have recommended that a public hearing be set on the question of said vacation; NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby approve~ the map attached hereto and orders the same filed with the original of this Resolution in the office of the Clerk of the Council and reference is hereby made to said map for the exterior boundaries of said right of way proposed to be vacated; The City Council declares its intention to proceed under the provisions of the Street Vacation Act of 1941 (Sections 8300 through 8374 of the california Streets and Highways Code) to vacate Sherwood Street east of Main Street. Said right of way proposed to be vacated lies in the City of Santa A/la, County of Orange, State of california, and is described as follows: Parcel 1: The southerly 30.00 feet of that portion of the southwest quarter of Section 30, Township 5 South, Range 9 West, in the land allotted to James McFadden, in the city of Santa Ana, as described in the Final Decree of Partition of the Rancho Santiago de Santa Ana, which was entered September 12, 1868 in Book "B", Page 410 of Judgments of the District Court of the 17th Judicial District in and for Los Angeles County, California, described as follows: Beginning at the Southwest corner of Section 30, Township 5 South, Range 9 West, San Bernardino Base and Meridian, and running thence North 0" 39' 45" East 1158.04 feet; thence South 88" 52' 00' East 1023.00 feet to the true point of beginning; thence South 88" 52' 00" East 267.00 feet; thence South 0" 39' 45" West 169.70 feet; thence North 88" 55' 45" West 267.00 feet; thence North 0" 39' 45" East 169.99 feet to the true point of beginning. Parcel 2: A spandrel shaped parcel of land over that portion of said Southwest Quarter of Section 30 bounded Easterly by the Northerly extension of the East line of Parcel 1 above described, bounded Southerly by the North line of said Parcel 1, and Northwest- erly by the arc of a curve concave Northwesterly having a radius of 15.00 feet and tangent to said Easterly and Southerly boundaries. Parcel 3: The Northerly 30.00 feet of that portion of said South- west quarter of Section 30, described as follows: Beginning at the Southwest corner of said Section 30; thence North 0° 39' 45" East 986.94 feet; thence South 88" 55' 45" East 1023.00 feet to the true point of beginning; thence South 88° 55' 45" East 267.00 feet; thence South 0" 39' 45" West 169.70 feet; thence North 88° 59' 30" West 200.00 feet; thence South 0" 39' 45" West 169.67 feet; thence North 88" 59' 30" West 133.00 feet; thence North 0" 39' 45" East 170.06 feet; thence South 88" 59' 30" East 66.00 feet; thence North 0" 39' 45" East 169.98 feet to the true point of beginning. -1- Parcel 4. A spandrel shaped parcel of land over that portion of said Southwest quarter of Section 30 bounded northerly by the south line of Parcel 3 above described; bounded easterly by the southerly extension of the East'line of said Pa~el 3, and bounded southwesterly by the arc of a curve concave south- westerly having a radius of 15.00 feet and tangent to said northerly and easterly boundaries. Parcel 5. The northerly 30.00 feet of that portion of said southwest quarter of Section 30, described as follows: Beginning at the southwest corner of said Section 30; thence North 0" 39' 45" East 986.94 feet; thence South 88" 55' 45" East 1414.00 feet to the true point of beginning; thence South 88" 55' 45" East 64.00 feet; thence South 0" 39' 45" West 338.98 feet; thence North 89" 03' 15" West 128.00 feet; thence North 0° 39' 45" East 169.64 feet; thence South 88" 59' 30" East 64.00 feet; thence North 0" 39' 45" East 169.41 feet to the true point of beginning. BE IT FURTHER RESOLVED: That September ~, 1970, at the hour of 7:30 P.M. in the Council Chambers, city Hall Annex, 500 West Sixth Street, Santa Ana0 California, is hereby fixed as the time and place for hearing all persons interested in or objecting to said proposed street vacation; BE IT FURTHER RESOLVED: That the Clerk of the Council of the city of Santa Ana is hereby ordered to publish this Resolution one time in the Register, and the Director of Public Works is ordered to post notices of street vacation conspicuously along the line of said street, stating the passage of this Resolution of Intention to vacate and the time and place of hearing thereon. Said notices shall be posted not more than 300 feet apart and at least three (3) such notices shall be posted. Both publication and posting shall be completed at least ten (10) days before the date of hearing.
