PLANNING COMMISSION AND GRANTING A VARIANCE
ON VARIANCE APPLICATION 70-54 FILED BY LAND
EVOLUTION, INC., SUBJECT TO APPLICABLE CONDITIONS
WHEREAS, after public hearing on notice, the Planning
Commission granted a variance on Variance Application 70-54,
filed by LAND EVOLUTION, INC. to permit the construction of a
17-unit garden apartment development in the R-1 District at
1636 East Sixth Street, Santa Ana, California; and
WHEREAS, Appeal Application No. 251 was duly filed by
MARGARITA E. CORTEZ appealing the decision of the Planning
Commission to grant said Variance and presenting the matter to
the City Council; and
WI~EREAS, the City Council, after public hearing on notice
has determined that said Variance Application meets the require-
ments of Section 41-638 of the Santa Ana Municipal Code and that
said Variance should be granted subject to certain applicable
conditions;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Ana does hereby affirm the decision of the
Planning Commission and does hereby grant a variance on Variance
Application 70-54, filed by LAND EVOLUTION, INC., to permit the
construction of a 17-unit garden apartment development in the
R-1 District at 1636 East Sixth Street, Santa Ana, California;
said variance is granted subject to the following conditions:
That development be according to the approved plot plan except
for minor modifications to be approved by the Planning
Department;
2. That the manager's two bedroom apartment have a floor area of
800 square feet or more;
3. That the proposed trash area, as indicated on the plot plan,be
enclosed by a 5-foot high solid wall or fence and solid gate;
That a 6-foot high solid fence or masonry wall be constructed
along the westerly property line, and terminate 19 feet back
from the front property line on Sixth Street;
That a landscape plan be submitted to and approved by the
Planning Department which will be implemented and will show
a balanced combination of trees, shrubs and ground cover;
said landscaping shall be provided with permanent watering
devices and be permanently maintained;
6. That all requirements of the Building Department be met.
The following conditions are to be complied with prior to the
issuance of a building permit:

Furnish the Department of Public Works a final grading plan and
an on-site drainage flow plan showing the direction of flow
to the adjacent streets when this property is developed.
Plan is to include existing and proposed elevations at
ge property lines;
8. Pay drainage assessment fee;
9. Pay sewer reimbursement;

10. Pay for ornamental street lights.
The following conditions are to be complied with prior to issuance
of utilities release by the Department of Building Safety and Housing:
11. Provide sanitary sewer facilities as required by the Depart-
ment of Public Works;

Improve Sixth Street to include pavement up to edge of
existing pavement, curb and gutter, sidewalk, and trees
at $17.50; the new curb and gutter to be placed from the
existing curb and gutter at the west property line to
meet the existing curb and gutter in the center of this
property.
NOTE: Existing City improvement plans are available (see Plan
11-22). Driveway on Sixth Street to be 26 feet top to top.
NOTE: It is suggested that the applicant investigate regular fees
for drainage assessment, building permits, etc.
PASSED AND ADOPTED by the City Council of the City of
Santa Ana at its regular meeting held on the 4th day of January,
1971.
