HomeMy WebLinkAbout71-013RESOLUTION 71-13 AFFIRMING THE DECISION OF THE PLANNING COMMISSION AND GRANTING A VARIANCE ON VARIANCE APPLICATION 70-68 FILED BY THE FIRST WESTERN BANK & TRUST COMPANY, SUBJECT TO APPLICABLE CONDITIONS WHEREAS, after public hearing on notice, the Planning Commission granted a variance on Variance Application 70-68 filed by FIRST WESTERN BANK & TRUST COMPANY to waive a portion of the required off-street parking and permit a service station and automobile service facility in a shopping center in the C R District at 3600 South Bristol Street, Santa Ana, California; and WHEREAS, Appeal Application 254 was duly filed by the Department of Public Works appealing conditions 4(e) and 4 (d) and presenting the matter to the City Council; and WHEREAS, Appeal Application 258 was duly filed by JAN L. VAIL and ROBERT EWING ASSOCIATES appealing the decision of the Planning Cormnission and presenting the matter to the City Council; and NOW, THEREFORE, BE IT RESOLVED: That based upon the Finding of Fact of the Planning Commission, the City Council of the City of Santa Ana hereby affirms the decision of the Planning Commission and Appeal 254 filed by the Director of Public Works is hereby DENIED; BE IT FURTHER RESOLVED: That the City Council of the City of Santa Ana does hereby affirm the decision of the Planning Commission and does hereby grant a variance on Variance Application 258 to permit the waiver of the required off-street parking and permit a service station and automobile service facility in a shopping center in the CR District at 3600 South Bristol Street, Santa Ana, California, in the CR District; said Variance is granted subject to the following conditions: That a revised plot plan be submitted to and approved by the the Planning Department indicating: (a) The proposed service station will be located on the corner with two curb cuts permitted to both Sunflower and Bristol Streets. The developer will also provide deceleration lanes along the service station frontage on both of these Streets. Landscaping is to be equal to or better than the service station installation at the Treasury located in the City of Orange at Manchester Street and Garden Grove Boulevard. (b) A 4-foot high solid wall or fence in front of the automobile service bays to screen the use from Sunflower Avenue. Development shall be according to the revised plot plan except for minor modifications approved by the Planning Department. e That a landscape plan he submitted to and approved by the Planning Department conforming to the landscape requirements in the CR District (one tree for each 20 parking spaces, 2% of gross uncovered parking area to be landscaped, etc.), but including minimum 5-foot wide landacaped planters adjacent to all street frontages and 8-foot wide landscaped planters in the public right of way in place of sidewalks which have been waived, except at approved driveways. Said landscaping shall be implemented according to the landscape plan, be permanently maintained and be provided with automatic irri- gation devices. -1- The following conditions are to be complied with prior to the issuance of a building permit: e File a parcel map with the Planning Department showing the severance of that area north of MacArthur Boulevard from this area and comply with all Council approved conditions. NOTE: Applicant may create separate parcels for the J. C. Penny Store and for the Winmar Company in addition to the parcel north of MacArthur Boulevard. Submit a revised plot plan to the Departments of Planning and Public Works for their approval showing the following changes from the original plot plan: (a) MacArthur Boulevard to be in accordance with plan ~1-17-9 on file in the Public Works Department. This plan provides for MacArthur Boulevard to be a 106-foot wide street tapering out to 118 feet, through approximately 260 feet, at Bristol Street to allow for a future double left hand turn pocket. (b) Plaza Drive, the proposed north-south street along the west property line, to be shown with the center line alignment in conformance with a boundary and topographic map prepared by Toups Engineering, Inc. dated January, 1970, on file in the Public Works Department. The minimum right of way required is 60 feet, but the City will accept a wider street, i.e. (80 feet in width from Sun- flower Avenue to a point approximately 517 feet from the center line of Sunflower avenue measured along the center line of Plaza Drive, to transition down to a 74-foot wide section through approximately 185 feet as measured along the center line with Plaza Drive, to remain as a 74-foot side section north to MacArthur Boulevard). NOTE: This wider street described above shall have raised medians providing for left turn pockets. Plaza Drive shall be entirely constructed at developer's expense regardless of width and is not to be considered as_part of the City's Select Street System. (c) Bristol Street to be 60 feet from center line to property line with curb and gutter located 52 feet from center line. The developer shall provide 10=foot deceleration lanes at all entrances of Bristol Street to the site and the applicant will dedicate the additional right of way. The right of way required adjacent to deceleration lanes will be 70 feet. The City agrees to pay for the additional paving in the deceleration lanes. (d) Bristol Street to show two median breaks to be approxi- mately 1,070 feet and 570 feet north of Sunflower Avenue, the latter left turn pocket to be coordinated with the property on the east side of Bristol Street and be a double lane north bound. (All median reconstruction to be at the developer's expense.) (e) Sidewalk requirement waived on Bristol and Sunflower Streets and MacArthur Boulevard and on Plaza Drive,and that the 8-foot wide strip be landscaped in place of sidewalks. (f) Ail driveways to City standards, except main driveways off Sunflower Avenue and Bristol Street and Plaza Drive may have curb returns. -2- (g) A 30-foot utility easement between Plaza Drive and Bristol Street in the area designated as the common driveway between J. C. Penny Store and Winmar Company. Furnish the Department~of Public Works for their approval the following: (a) A sewer study showing the proposed extension of all trunk sewer facilities through this entire area including the area north of MacArthur Boulevard. (Sanitation Dis- trict ~7 for approval) (b) A runoff study by a civil engineer based on a storm of a ten year frequency. Show existing and proposed facilities and methods of draining this area and tributary areas without exceeding the capacity of any street, on-site or off-site. (c) A final grading plan and an on-site drainage flow plan showing the direction of flow to the adjacent streets when this property is developed. Plan is to include existing and proposed elevations at the property lines. 6. Provide street easements for: (a) MacArthur Boulevard for a width of 52 feet from centerline to property line, plus extra width near the Bristol Street intersection as shown on a plan on file with the Public Works Department. (See condition 2a above). (b) Bristol Street for a width of 60 feet from center line to property line. A 10-foot wider width including a variable transition width will he required where deceleration lanes are requested. (c) Plaza Drive for a width of 30 or 37 feet from center line to property line.and a~ necessary to conform to condition (2b) above. See plan on file in Public Works. (d) Sunflower Avenue for a width of 60 feet center line to property line. (e) Spandrels with a 25-foot radius: at the northwest corner of Sunflower Avenue and Bristol Street, at the southwest corner of MacArthur Boulevard and Bristol Street and at the southeast corner of MacArthur Boulevard and Plaza Drive. (f) Vehicular access rights for MacArthur Boulevard, Bristol Street, Sunflower Avenue except at approved driveway openings. (g) A utility easement to City, 30 feet wide, between Bristol Street and Plaza Drive approximately 1000 feet north of center line of Sunflower Avenue. Submit street improvement plans by a civil engineer for MacArthur Boulevard, Bristol Street, Sunflower Avenue Plaza Drive. (See City plans 1-13-8 and 17-44). (All elevations to be on 1958 Orange County Survey Datum.) and 8. Pay drainage assessment fee. -3- 9. Pay Sanitation District VII fees. 10. Ail plans and surveys for the required improvements shall he completed by the engineer and submitted to the Department of Public Works for approval. 11. Install ornamental street lights (with underground connections) along all street frontages in accordance with approved system. 12. Developer shall submit a plan showing his proposal for an on- site water system. Developer shall pay all water main charges in public streets and easements and all service installation costs. Developer shall furnish on-site water main easements as required. It is recommended that the developer contact the Santa Ana Fire Department regarding fire hydrant location. THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE OF UTILITIES RE.T~SE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: 13. Provide sanitary sewer facilities as required by the Department of Public Works. 14. Provide storm drain facilities as required by the Department of Public Works. 15. Improve MacArthur Boulevard with pavement, curb and gutter as required and an 8-foot wide landscaped strip in place of sidewalks. 16. Improve Bristol Street with pavement, curb and gutter, and an 8-foot wide landscaped strip in place of sidewalks. 17. Improve Sunflower Avenue with pavement to meet existing pavement, curb and gutter at 52 feet north of the center line and an 8-foot wide landscaped strip in place of sidewalks. 18. Improve Plaza Drive with pavement, curb and gutter and an 8-foot wide landscaped strip in place of sidewalks. Location of curb face to be 8 feet from right of way line. NOTE: It is suggested that the owner investigate regular fees for drainage assessment, sanitary assessment, ornamental street lights, building permits, etc. 19. A traffic control signal light will be installed at the location of the existing median island break on Bristol Street approxi- mately 1,070 feet north of the intersection of Sunflower Avenue. The cost of this installation is to be shared equally by the developers of the properties on both sides of Bristol Street opposite the traffic control signal. The developers are to enter into an agreement with the City where- by the developer of the first property to be actually developed will be responsible for the installation of the signal and he reimbursed half the costs by the other developer at the time development of the other property takes place. If this is not legally possible, then the first developer shall pay entire cost.
