HomeMy WebLinkAbout71-027RESOLUTION 71-27 OVERRULING THE DECISION OF THE PLANNING COMMISSION AND GRANTING A VARIANCE ON VARIANCE APPLICATION 70-77, FILED BY YSIDRO AND ANITA RUVALCAVA, SUBJECT TO APPLICABLE CONDITIONS WHEREAS, after public hearing on notice, the Planning Commission DENIED a variance on Variance Application 70-77 filed by YSIDRO and ANITA RUVALCAVA proposing to permit open storage of construction equipment and material in the A-1 District at 937 and 941 South Lyon Street, Santa Ana, California; and WHEREAS, Appeal Application No. 260 was duly filed by the applicant, appealing the decision of the Planning Commission and presenting the matter to the City Council; and WHEREAS, the City Council, after public hearing on notice, has determined that said Variance Application meets the require- ments of Section 41-638 of the Santa Ana Municipal Code and that said Variance is granted subject to certain applicable conditions; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby overrules the decision of the Planning Commission and does hereby grant a variance on variance application 70-77, filed by YSIDRO and ANITA RUVALCAVA, to permit open storage of construction equipment and material in the A-1 District at 937 and 941 South Lyon Street, Santa Ana, California; Said Variance is granted subject to the following conditions: That development be according to the approved plot plan except for minor modifications to be approved by the Department; Planning 2. That materials stored not extend above the 6' high solid wooden fence; That equipment which is more than 6' high be stored toward the middle of the property (away from the kennel on the north and the residence on the south); 4. That all material and equipment be kept within the storage area at all times; Se That on the northerly lot, the 6' high solid wooden fence be extended from the side property line southerly to the existing storage shed and a solid gate be installed at this access point; e That if either of the lots be sold and the storage thereon discontinued, the storage yard on the remaining lot be completely enclosed with a 6' high solid fence or wall; 7. That all requirements of the Building and Fire Departments be met; That this variance shall become null and void two (2) years from the date of approval unless extended for one (1) year by the Planning Department. 9. The following condition is to be complied with prior to the above use: Provide a street easement for Lyon Street for a width of 30 feet from monumented center line to property line. -1- PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 15th day of March, 1971.
