HomeMy WebLinkAbout71-036RESOLUTION 71-36 UPHOLDING THE DECISION OF THE PLANNING COMMISSION AND GRANTING A VARIANCE ON VARIANCE APPLICATION 71-1, FILED BY LES-SIM INC., SUBJECT TO APPLICABLE CONDITIONS WHEREAS, after public hearing on notice, the Planning Commission granted a variance on Variance Application 71-1, filed by LES-SIMS INC. to construct a retail package liquor mart in the A-1 District at 2638 North Glassell Street, Santa Ana, California; and WHEREAS, Appeal Application 262 was duly filed by the applicant appealing the decision of the Planning Commission and presenting the matter to the City Council; and WHEREAS, the City Council, after public hearing, on notice, has determined that the decision of the Planning Commission should be upheld; that said Variance Application meets the require- ments of Section 41-638 of the Santa Ana Municipal Code and that said Variance should be granted subject to certain applicable conditions; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby affirm the decision of the Planning Commission and does hereby grant a variance on Variance Application 71-1, filed by LES-SIM INC. to permit the construction of a retail package liquor mart in the A-1 District at 2638 North Glassell Street, Santa Ana, California; said Variance is granted subject to the following conditions: 1. That a revised plot plan be submitted to and approved by the Planning Department indicating: the propQsed driveway having a maximum width of 28.6'. (The design and the location of the driveway shall be approved by the Public Works Department.) NOTE: City has vehicular access rights to Fairhaven Avenue and Glassell Street except at existing drives. City will quitclaim driveway location back to owner. a five foot wide landscaped strip along Glassell from the existing southerly driveway to the southerly property line, except at the proposed driveway. c. the elimination of the proposed pole sign at the southeast corner of the subject property. d. nine (9) offstreet parking stalls that conform to the standards of the Ordinance. Development shall be according to the approved revised plot plan except for minor modifications approved by the Planning Department. 3. That no wall signs on the southerly facade of the building or any roof signs shall be permitted. e That a landscaped plan for the planter strip be submitted to and approved by the Planning Department, and that said land- scaping be implemented and be continuously maintained. -1- THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE OF A BUILDING PERMIT: Se Furnish the Department of Public Works a final grading plan and an on-site drainage flow plan showing the direction of flow to the adjacent streets. 6. Pay sanitary sewer main assessment on Glassell Avenue. 7. Pay drainage assessment fee. 8. Pay for future ornamental street lights (with underground connections). THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO ISSUANCE OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: 9. Provide sanitary sewer facilities as required by the Department of Public Works. 10. Replace any black top in the sidewalk area, broken sidewalk and holes with P.C.C. sidewalk on Fairhaven Avenue. NOTE: It is suggested the owner investigate regular fees for sewer assessment, drainage assessment, future ornamental street lights, etc. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 19th day of April, 1971.
