OF THE PLANNING COMMISSION AND GRANTING
A VARIANCE ON VARIANCE APPLICATION 71-7

SUBJECT TO APPLICABLE CONDITIONS
WHEREAS, after Public Hearing on notice the Planning
Commission granted a variance on Variance application 71-7
filed by First Western Bank and Trust Company, to waive a
portion of the off-street parking requirements to allow an
automobile service station, tire and battery store and two
restaurants in a shopping center on the east side of Bristol
Street from Sunflower to MacArthur in the CR and A1 Districts
at 3751 South Bristol Street, Santa Ana, California; and
WHEREAS, appeal application 264 was duly filed by the
applicant appealing condition 17 imposed by the Planning
Commission; and presenting the matter to the City Council;
and
WHEREAS, appeal application 263 was duly filed by
Segerstrom Republic Homeowners, Inc. appealing decision of
the Planning Commission to eliminate sidewalks along Bristol
Street and presenting the matter to the City Council;
NOW, THEREFORE, BE IT RESOLVED: That based upon the
Findings of Fact of the Planning Commission the City Council
of the City of Santa Ana does hereby uphold the decision of
the Planning Commission, and appeals 263 and 264, filed by
Segerstrom Republic Homeowners, Inc. and First Western Bank
and Trust Company are hereby approved.
BE IT FURTHER RESOLVED: That the City Council of the
City of Santa Ana does hereby uphold the decision of the
Planning Commission and does hereby grant a Variance on
Variance Application 71-7 filed by First Western Bank and
Trust Company to waive a portion of off-street parking, permit
two service stations, an automobile service facility, and two
restaurants in a shopping center in the CR District, and parking
in the A1 District at 3751 South Bristol Street; said Variance
is granted subject to the following conditions:
That development be according to the approved
plot plan except for minor modifications approved
by the Planning Department.
That a 6' high solid masonry wall (measured from
the highest finished grade) be constructed along
the easterly property line of Parcel I, except
along the 15' adjacent to MacArthur Boulevard
where the wall shall be reduced to 4'
3. That a landscape plan be submitted to and approved
by the Planning Department indicating:
a)
A minimum five-foot wide landscaped planter
along all street frontages, except at approved
driveways.
b) 3% of the offstreet parking area be landscaped
with trees, shrubs, and ground covers.
c) one-fifteen (15) gallon tree for each ten (10)
offstreet parking spaces, or portion thereof.
Said landscaping shall be implemented according
to the landscape plan, be permanently maintained
and be provided with automatic irrigation devices.

That the proposed service stations be archi-
tecturally coordinated with other buildings on
the site, and that the service bays face the
rear of the buildings.
The following conditions are to be complied with
prior to the issuance of a building permit:
File a parcel map with the Planning Department
showing severance of this area and Sunflower
frontage, and comply with Council approved
conditions.
Submit a revised plot plan to the Departments of
Planning and Public Works for their approval
showing the following changes from the original
plot plan:
Median openings for Bristol Street to be
coordinated with openings as approved for
VA 70-68.
10 feet deceleration lanes for the drives
located at the return type entries for a
distance of 70 feet.
c. Show median on MacArthur Boulevard.
d. Standard eight-foot full width sidewalk on
Bristol Street and MacArthur Boulevard.
7. Furnish the Department of Public Works for their
approval the following:
a. A sanitary sewer study. (Sanitation District
No. 7 approval required.)
A final grading plan and an on-site drainage
flow plan showing the direction of flow to
the adjacent streets when this property is
developed. Plan is to include existing and
proposed elevations at the property lines.
c. A plan showing proposed on-site water system.
Provide a street easement for Bristol Street for
a width of 60 feet from center line to property
line. A 10-foot wider-width including a variable
transition width will be required for deceleration
lanes at the return type entries.
NOTE: The City agrees to pay for the additional paving
in deceleration lanes.
Provide for vehicular access rights to Bristol
Street and MacArthur Boulevard except at approved
driveway openings.
NOTE: There will be no curb side parking on Bristol
Street or MacArthur Boulevard.
NOTE: Dedication shall be initiated by owner, through
the Department of Public Works, at least four weeks
prior to application for a building permit to avoid
delay.

Submit street improvement plans by a civil engineer
for Bristol Street. (NOTE: Plans are in progress)
and for culvert at F-2 channel as required by
Department of Public Works and Orange County Flood
Control District. (All elevations to be on 1958
Orange County Survey Datum.)

Ail plans and surveys for the required improvements
shall be completed by the engineer and submitted to
the Department of Public Works for approval.
12.
Install approved ornamental street lights (with
underground connections) along all frontages in
accord~ce with approved systems.
The following conditions are to be complied with prior
to issuance of utilities release by the Department of
Building Safety and Housing:
13. Provide sanitary sewer facilities as required by
the Department of Public Works.
14. Provide storm drain facilities as required by the
Department of Public Works.
15. On MacArthur Boulevard place full width 8 foot side-
walk with tree wells and trees at $17.50 each.

Improve Bristol Street to include pavement to meet
existing pavement, curb and gutter located according
to design of street and an eight-foot wide sidewalk
with tree wells and trees at $17.50 each. Work
also to include culvert widening with sidewalk as
required by Department of Public Works and Orange
County Flood Control District.
17.
To share in the cost of the installation of a
traffic control signal system to be located at the
median break on Bristol Street midway between
Sunflower Avenue and MacArthur Boulevard. Signal
to be installed by the developer under VA 70-68
on the west side of Bristol Street at the time of
the development of The Treasury. The total cost of
the signal system is to be shared between the
developer on the east side of Bristol Street and
the developer on the west side of Bristol Street,
with their shares being in proportion to t_he sizes
of the two properties being served by the median
break. The administration of this condition,
including the assigning of proportionate costs and
the providing of a method ofr reimbursement to the
installing developer, shall be the responsibility
of the Public Works Department.
NOTE: For VA70-68 the City Council granted an appeal
to developer on the west side of Bristol.
18.
Construct a six foot chain link fence along the
right of way for the F-2 channel. (Some fencing
exists.)

1. Drainage assessment.
2. Sanitation District ~7.
3. Water main and ser¥ice connection charges.
PASSED AND ADOPTED by the City Council of the City of
Santa Ana at its regular meeting held on the 3rd of May,
1971.
