HomeMy WebLinkAbout71-045RESOLUTION 71-45 OVERRULING THE DECISION OF THE PLANNING COMMISSION AND GRANTING A VARIANCE ON VARIANCE APPLICATION 71-12 FILED BY SAN BERNARDINO-RIVERSIDE COUNCIL OF CHURCHES, SUBJECT TO APPLICABLE CONDITIONS WHEREAS, after public hearing on notice, the Planning Commission denied a variance on Variance Application 71-12 filed by SAN BERNARDINO-RIVERSIDE COUNCIL OF CHURCHES to construct a twelve story, 250 unit residential development for elderly people in the C 4 District less than 140 feet from the R-1 District at 711 North Bristol Street, Santa Ana, California; and WHEREAS, Appeal Application 266 was duly filed by S. ARTHUR MARTINEZ, appealing the decision of the Planning Commission and presenting the matter to the City Council; and WP~EREAS, The City Council, after public hearing, on notice, has determined that the decision of the Planning Commission should be overruled and that said Variance is granted, subject to certain applicable conditions; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby overrules the decision of the Planning Commission and does hereby grant a variance on Variance Application 71-12, filed bySAN BERNARD INO-RIVERSIDE COUNCIL OF CHURCHES, to to permit the construction of a twelve story, 250 unit residential development for elderly people at 711 North Bristol Street, Santa Ana, California, in the C-4 District, less than 140 feet from the R-1 District; said Variance is granted subject to the following conditions: 1. That development be according to'the approved plot plan except for minor modifications approved by the Planning Department; That a landscape plan be submitted to and approved by the Planning Department. Said landscaping shall be implemented according to the landscape plan and be continuously maintained; 3. That the development be surrounded by a solid masonry wall, ~ except along street frontages, the height of which shall be i in accordance with Section 41-610 of the Santa Ana Municipal Code; 4. That all units meet the minimum square footage of gross floor area of the R 3 District (i.e. 300 Square feet for bachelor units, 500 Square feet for one bedroom units); That additional offstreet parking stalls may be required on the site if the complex is not utilized as a residence for the elderly. 6. That all conditions of the Building and Fire Departments be met. THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE OF A BUILDING PERMIT: 7. Submit a revised plot plan showing only one drive on Bristol Street to be over the southerly 40 feet of this property; NOTE: Bristol Street has an existing median island left turn pocket to provide for left turn movement into this property only at the location mentioned above. Seventh Street is -1- opposite this location and the short distance to Civic Center Drive creates a hazardous traffic situation should any other drives be allowed. e Furnish the Department of Public Works a final grading plan and an on-site drainage flow plan showing the direction of flow to the adjacent streets when this property is developed. Plan is to include existing and proposed eleva- tions at the property lines. Provide a street easement for Bristol Street for a width of 50 feet center line to property line together with vehicular access rights, except over the southerly 40 feet. 10. Provide a deed for vehicular access rights to Civic Center Drive except as shown on the approved plot plan. NOTE: Existing drive may be relocated to fit approved plot plan. NOTE: Dedication shall be initiated by owner, through the Depart- ment of Public Works, at least four weeks prior to application for a building permit to avoid delay. 11. Submit street improvement plans by a civil engineer for Bristol Street. 12. Pay for future ornamental street lights (with underground distribution) on Bristol Street and Civic Center Drive. THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO ISSUANCE OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: 13. Provide sanitary sewer facilities as required by th~ Department of Public Works. 14. Improve Bristol Street to include relocation of existing curb and gutter to ultimate location with pavement as required and full width sidewalk with tree wells and trees at $17.50 each. 15. Remove existing drive and reconstruct a 40-foot driveway on Civic Center Drive.
