HomeMy WebLinkAbout71-057RESOLUTION 71-57 OVERRULING THE DECISION OF THE PLANNING COMMISSION AND GRANTING A VARIANCE ON VARIANCE APPLICATION 71-17, SUBJECT TO CERTAIN APPLICABLE CONDITIONS WHEREAS, after public hearing on notice, the Planning Commission denied a variance on Variance application 71-17 filed by H & J MABURY COMPANY to construct two-story garden apartment development in the R-4 District within 150 feet of R-1 zoned property, to waive a portion of the required 50% open space, and to permit off-street parking in the R-1 District at 1851 East Fruit Street, Santa Ana, California; and WHEREAS, Appeal Application 265 was duly filed by the applicant, appealing the decision of the Planning Commission and presenting the matter to the City Council; and WHEREAS, the City Council, after public hearing, on notice, has determined that said Variance should be granted, subject to certain applicable conditions; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby overrule the decision of the Planning Commission and does hereby grant a variance on Variance Application 71-17, filed by H & J MABURY COMPAN~ to permit the construction of a 2-story garden apartment development in the R-4 District within 150 feet of R-1 zoned property,to waive a portion of the required 50% open space and to permit off-street parking in the R-1 District at 1851 East Fruit Street, Santa Ana, California; said variance is granted subject to the following conditions: That the revised plot plan approved by the Council action be submitted to the Planning Department indicating all approved changes; and that the development be according to the approved revised plot plan except for minor modifications approved by the Planning Department; 2. That there be a minimum 15 feet between main dwellings, clear of balconies, landings or stairways; That a landscape plan be submitted to and approved by the Planning Department; and that said landscaping be implemented and be continuously maintained. 4. That the trash areas be enclosed in accordance with the Planning Department standards; THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE I ISSUANCE OF A BUILDING PERMIT: 5. File and record a parcel map with the City of Santa Ana and comply with all conditions of Council approval; e Furnish to the Department of Public Works the following: a. A runoff study by a civil engineer based on a storm of a ten-year frequency. Show existing and proposed facilities and methods of draining this area and tributary areas without exceeding the capacity of any street, on-site or off-site. -1- Cw A final grading plan and an on-site drainage flow plan showing the direction of flow to adjacent streets when this property is developed. Plan is to include existing and proposed elevations at the property lines. A sanitary sewer study showing existing and proposed facilities and their capacities for this area and other contributary adjacent land. Street improvement plans by a civil engineer for Fruit Street and Sherry Boulevard. (All elevations are to be on 1958 Orange County Survey Datum.) Provide street easements for: a. Fruit Street for a width of 30 feet, property line; center line to Sherry Boulevard for a width of 80 feet property line to property line in accordance with Specific Plan of Street Alignment ~39. c. Vehicular access rights to Sherry Boulevard except at the approved driveway location. NOTE: It is recommended that the driveway on Sherry Boulevard be revised so that there will be one lane for ingress and two lanes for egress with the nose of the private median island pulled back away from Sherry Boulevard, an approximate distance of 50 feet. Also, Public Works will allow 24-foot curb return radii in lieu of the standard driveway. No parking will be allowed on Fruit Street between Sherry Boulevard and the driveway as shown on the plot plan. NOTE: Dedication shall be initiated by owner,through the Department of Public Works, at least four weeks prior to application for a building permit to avoid delay. Install approved street lighting system of ornamental street lights (with underground connections) on Sherry Boulevard and pay for future lights on Fruit Street; THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO ISSUANCE OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: 9. Provide storm drain and sanitary sewer facilities as required by the Department of Public Works; 10. Improve Fruit Street to include pavement to meet existing pavement, curb and gutter, trees and sidewalk; 11. Improve Sherry Boulevard between Fruit Street and Seventeenth Street to include curb and gutter, pavement and full width sidewalk with tree wells and trees, and a raised median. Required fees: 1. Drainage assessment; 2. Sanitation District No. 7; -2- 3. Sewer main assessment for S.P. "B". 4. Water main charges for: a. Mabury Street b. Fruit Street c. Sherry Boulevard 5. Cost of water service connection 6. Trees. PASSED AND ADOPTED by the City Council of the City of Santa Ana At its regular meeting held on the 21st day of June, 1971.
