HomeMy WebLinkAbout71-067RESOLUTION 71-67 ORDERING THE VACATION OF A PORTION OF ALTON AVENUE BETWEEN SUSAN STREET AND THE PACIFIC ELECTRIC RAILWAY CROSSING AIqD ~ESERVING AN EASEMENT THEREIN FOR PUBLIC UTILITIES WHEREAS, on recommendation of the Department of Public Works and the Planning Commission of the City of Santa Ana, Resolution 71-51 was adopted giving notice of intention to vacate that certain street right of way herein described; and WHEREAS, on July 6, 1971, a public hearing was duly held on said street vacation on posted notice and the publication of Resolution 71-51; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby find that Alton Avenue, as it exists between Susan Street and the Pacific Electric Railway Crossing is unnecessary for present or prospective street purposes and does hereby make its order abandoning and vacating for street purposes that certain right of way in the City of Santa Ana, County of Orange, State of California, described as follows: Those portions.of Alton Avenue, formerly Talbert Avenue, as described in instruments recorded in Book 4074, Page 556 and Book 4105, Page 241 of Official Records, County of Orange, State of California, lying within Lot 3 of the Williams Tract in the City of Santa Ana as per map recorded in Book 30, Page 14 of Deeds, Records of Los Angeles County, California and within Section 27 of that portion of land allotted to James McFadden in said City of Santa Ana, as described in the Final Decree of Partition of the Rancho Santiago de Santa Ana, which was entered September 12, 1868 in Book "B", Page 410 of Judgments of the District Court of the 17th Judicial District in and for Los.Angeles County, California, and those portions of Alton Avenue as shown on a map of Tract 1013 in said City of Santa Ana as per map recorded in Book 33, Page 36 of Miscellaneous Maps in the office of the County Recorder of said Orange County, bounded westerly by the Easterly line of the land described in the deed to Pacific Electric Railway Company recorded July 28, 1958 in Book 4364, Page 69 of said Official Records and bounded Easterly by a line parallel or concentric with and 30.00 feet Westerly and Northwesterly measured at right angles, from the following described line: Beginning at the intersection of the North line of said Alton Avenue, 50.00 feet wide, as shown on said map of Tract 1013 with the center line prolongation of Susan Street as granted to said City of Santa Ana by deed recorded March 13, 1961 in Book 5654, Page 468 of said Official Records; thence along the Southerly prolongation of the center line of said Susan Street, a distance of 20.00 feet to the intereection of the surveyed center line of Alton Avenue as shown on said map of Tract 1013 with the easterly line of a strip of land 30.00 feet in width, as granted to said City of Santa Ana by deed recorded July 9, 1964 in Book 7126, Page 393 of said Official Records, said intersection being the beginning of a tangent curve concave Northwesterly having a radius of 348.36; thence Southwesterly along the arc of said curve through a central angle of 30° 21' 41" an arc distance of 184.60 feet; Reserving from the above described land an easement for public utilities. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 6th day of July, 1971.
