Present: Absent: Councilmen Councilmen William Jerome, Thomas F. Lateen, Milford W. Dahl, Courtney R. Chandler. J.L.McBride. A previous meeting having been scheduled in the Council Chamber, the'City Council adjourned its me,ting to the Mayor;s Office on motion of Councilman Dahl, seconded by Jerome and carried. In Re Withdrawal of petition Sewage facilities north to West Orange Street Councilman McBride arrived at ?$40 P.M. On motion of Councilman Dahl, seconded by Larsen and carried, the petition signed by eleven property owners requesting withdrawal of petition for proceedings under Improvement Act of 1911 to extend the City sewage facilities north to West Orange Street, was received and In Re Resol. No. 55-37 Declaring no action to be taken on petition for sewage facilities north to West Orange Street filed. , The Council having unanimously waived the r~ading of the Resolution, on motion of Councilman Dahl, s econ~ed by Lar,~en and carried, the following Resolution entitled: "Resolution No. 55-3? declaring no action to be taken on Petition under Improvement Act of 1911" to extend the City sewage facilities north to West Orange Street, was considered and passed by the following vote: In Re Map of Trac~ No. 2325 D.& .... (Orson Hunter 830 So. ilMain St.) Santa Ama has no objection to the proposed annexation. Councilman McBride requested permission to be excused at 8:00 P.M. Councilman McBride made the fo]lowing statements with reference to Orson Hunter's building at 850 South Main Street. "This afternoon at 5:QO P.M. I talked to a gentleman in regard to this estimate and this bullying had been built according to the Code it would not be tno,~e steps do not comply ~%,~h the necessary to do this now; also, ' o '~ Code - this is irrespective of the encroachment and % feel that the City should have a determination on these things before we act hastily] and pay out money, which in my Opinion is illegal. Also, as to the necessary cement work for the red curb - I c~estloned Mr. Anderson's figures and the cement work which he did could not have been included in the bill for the platform and the steps. The estimate given originally was for red curb and I requested Mr. Foreman to refigure the cost of the cement work done in 1936". Orson Hunter protested, publicly the treatment he receiw~d from Councilman McBride and referre~ to the estimate on file and submittad his cancelled check in full pay- merit of V.J.Anderson~s bill in the ~ * a~.oun~ of ~899.65. Councilman McBride requested to be excused from the meeting at 8:15 P.~.~. The Clerk read the letter from V.J.And,er~on st~tlng that in 19~6 he obtained a building perm, it for ~500.00 to remodel the two-story build- !nE at 830 South Main Street and referred to the work involved. The Manager stated he had an appraisal from Stanley E. Coeds in the sun of: ~3,35h.00. It was moved by Co:~ncilman L r,,,n, seconded by Dahl and carried, that the City agree to settle with Orson Hunter on the basis of $4,000.00 for dama~jes to his property at 830 South Main Street, provided Mr. Hunter agrees to sign an affld~,vit to ali. the facts and figures which he has pr,~sented on the alteration work of the store building; said figure not to include the price of the land as Mr.HunteP agreed to deed a 5' easement in front of the proi~erty for the widening of South Main Street. On motion of Councilman Ds]al, seconded by Larsen and carried, proper officials were authorized to execute agreement dated February 14th, 1955, with Douglas Edwards, reference construction of laterals and other facilities to be used in the disposal of sewage from property in Tract No. 2068 .and permitting the City to collect from any person connecting into said sewerage facilities for a period of t~n years. Communication was read from the Dep~rtment of Public York~ advising that improvements within Tract No. 2194 have been completed and on motion of Councilman Jerome, .seCOnded by Dahl.and carried, bond filed by Honer Development Company, in ~the aum of $35,000.00, was ordered released and improvements accepted as completed. On motion of Councilman Dahl, seconded by Jerome and carried, the request of Thomas F.
