PLANNING COMMISSION AND CONDITIONALLY GRANTING
CUP ~71-17 FILED BY ERNEST & LILLIAN R. CAPP
BE IT RESOLVED: That, based upon the Findings of Fact of the
Planning Commission and testimony presented before the City Council,
the City Council of the City of Santa Ana hereby upholds the deci-
sion of the Planning Commission, and Conditional Use Permit ~71-17
filed by Ernest & Lillian R. Capp, to allow a pre-school and day
care center in the R 2 District (1630 E. Palm Ave., Santa Ana) is
granted subject to conditions of approval contained in the Commis-
sion Report which are as follows:
1. That all conditions of the Building and Fire
Departments be met.
That a landscape plan be submitted to and ap-
proved by the Planning Department, including
the provisions of Sec. 41-618 of the Zoning
Ordinance, and that said landscaping be im-
plemented and be continuously maintained.
Submit to the Department of Public Works, for
their approval, an acceptable final grading plan
or an on-site drainage plan or both, showing the
direction and means of flow to the adjacent street
or channel when this property is developed. Plan
is to include existing and proposed elevations at
the property lines· Applicants should check with
the Department of Public Works for extent of study
needs.
4. Dedicate required street or alley right of way.
5. Pay drainage assessment fee.
6. Pay street lighting deposit for future street
lights.
7. Repair or replace existing street improvements
to City standards: Driveway.
Ail public improvement construction shall be
subject to inspection and approval by the De-
partment of Public Works.

Required property dedications shall be initiated
by the owner, through the Department of Public
Works, at least four weeks prior to application
for a building permit, or use as applicable, to
avoid delay.
The following requirements must also be met:
1. The number of students shall be limited to a
maximum of 60.
That a revised plot plan be submitted and ap-
proved by the Planning Department except for
minor modifications to be approved by the
Planning Department.
That the revised approved plot plan show all
but the most southerly open parking space at
90° angles to the side property line.

Dedications:
1. Alley for a width of ten feet from center
line to property line.
Improvements:
1. Replace existing AC drive approach to City
standards.
2. Move existing fence back of proposed right
of way for alley.
NOTE:
The applicant should investigate standard
fees for drainage assessment, street im-
provements, etc.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 4th day of October 1971.
