T~E PLANNING COMMISSION AND CONDITIONALLY
GRANTING VARIANCE APPLICATION 71-34
BE IT RESOLVED: That, the City Council of the City of Santa
Ana does hereby overrule the decision of the Planning Commission
and does hereby grant Variance Application 71-34, filed by Joe
Serna to move two apartment buildings onto a lot with existing
dwellings in the R 2 District (4625-4631 W. McFadden Avenue, Santa
Ana); said variance is granted subject to the following conditions:
That development be according to the approved plot
plan, except for minor modifications approved by
the Planning Department.
2. That all conditions of the Building and Fire De-
partments be met.
That a landscape plan be submitted to and approved
by the Planning Department, including t~ne provisions
of Sec. 41-618 of the Zoning Ordinance, and that said
landscaping be implemented and be continuously main-
tained.
4. That any trash areas be enclosed in accordance with
the Planning Department standards.
5. That there be a minimum 15 feet between main dwel-
lings, clear of balconies, landings or stairways.
6. Prior to the Issuance of a Buildinq Permit - Submit
to the Department of Public Works, for their approval,
an acceptable final grading plan or on on-site drain-
age plan or both, showing the direction and means of
flow to the adjacent street (s) or channel (s) when
this property is developed. Plan is to include exist-
ing and proposed elevations at the property lines.
Applicants should check with the Department of Public
Works for extent of study needs.
7. Dedicate required street or alley right of way.
8. Dedicate vehicular access rights.
9. Pay drainage assessment fee.
10. Pay street lighting deposit for future street lights.

Ail plans and surveys for required public improvements
shall be prepared under the direction of a registered
civil Engineer and shall be sumbitted to the Depart-
ment of Public Works for approval.
12. Ail elevations shall be referenced to the 1958 Orange
county Survey Datum.
13.
Required property dedications shall be initiated by
the owner, through the Department of Public Works,
at least four weeks prior to application for a build-
ing permit, or use as applicable, to avoid delay.

The following requirements must also be met:
1. Landscape entire property.
2. If Santa Ana water service is desired, water main
and service connection charges will be due.
Deposit a cash bond with the City for future side-
walk and trees. City will construct street improve-
ments in the future.
Dedication:
1. McFadden Avenue
a. Street easement for a width of 40 feet
from center line to property line.
Vehicular access rights to McFadden
Avenue except at the east 26 feet of
westerly 83 feet.
The development shall be surrounded by a solid redwood or
cedar fence or solid masonry wall or combination thereof,
the height of which shall be in accordance with Section
41-610 of the Zoning Ordinance. No fence or gate is re-
quired at the driveway opening.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 4th day of October, 1971.
