HomeMy WebLinkAbout71-102 RESOLUTION NO. 71-102 RESOLUTION DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE IMPROVEMENT WORK ASSESSMENT DISTRICT NO. 225 SANTA ANA, CALIFORNIA WHEREAS, the City Council of the City of Santa Ana, California did, on the 7th day of September, 1971, in adopting its Resolutions No. 71-82 and 71-83 in this assessment district, order that a public hearing be held on the 1st day of November, 1971 at 7:30 o'clock P.M. in the council chambers in the City Hall Annex in said City of Santa Ana concurrently with the pro- test hearing under its Resolution of Intention No. 71-83 for the purpose of finding and determining whether the public convenience and necessity require the improvements proposed to be constructed as described in said Resolution of Intention No. 71-83; and WHEREAS, notice of the adoption of said Resolution No. 71-82 and of said Resolution of Intention No. 71-83 by mail- ing, posting and publication was given in the time, form and manner as required by law, as shown by the affidavits of mailing, posting and publication on file in the office of the Clerk of the Council of said City of Santa Ana; and WHEREAS, protests or objections, in writing, were made by 62.6% of the owners of real property within the assessment district proposed under said Resolution of Intention No. 71-83 to the formation of said assessment district; and WHEREAS, said City Council received testimony from the Director of Public Works of said City of Santa Ana, owners and residents of real property, both within and without said assess- ment district, and interested organizations, both public and private, that said proposed work and improvement is required for the public convenience and necessity; and WHEREAS, the oral protests against the formation of said assessment district were limited primarily to the cost thereof as distinguished to the necessity therefor. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Aha, California, in regular session assembled this 1st day of November, 1971, that said City Council hereby finds and determines that said proposed work and improvement is feasible, and that the public interest, convenience and necessity require such improvement, and that all protests, both oral and in writing, to the doing of said work be and the same hereby are overruled and denied.
