HomeMy WebLinkAbout72-002RESOLUTION '~2--2~ OVERRULING THE DECISION OF THE PLANNING COMMISSION AND CONDITIONALLY GRANTING VA 71-48 FILED BY ROBERT H. GRANT COMPANY BE IT RESOLVED: That, the City Council of the City of Santa Aha does hereby overrule the decision of the Planning Commission and does hereby grant ~;ariance Application 71-48, filed by Robert H. Grant Company to construct a 493 unit townhouse development in the R 1 zone at 230 W. Segerstrom (Dyer), subject to the following conditions: 1. That development be according to the approved plot plan, except for minor modifications approved by the Planning Department. 2. That all conditions of the Building and Fire Departments be met. 3. That a landscape plan be submitted to and approved by the Planning Department, including the provisions of Sec. 41-618 of the Zoning Ordinance, and that said landscaping be implemented and be continuously maintained. 4. That any trash areas be enclosed in accordance with the Planning Department standards. 5. That there be a minimum 15 feet between main dwellings, clear of balconies, landings or stairways. 6. Pay Sanitation District No. 7 fee. 7. Pay City water main charges. 8. Pay water service connection charges. 9. Provide for installation of approved street lighting with underground service on all street frontages unless otherwise noted. 10. Ail plans and surveys for required public improvements shall be prepared under the direction of a registered Civil Engineer and shall be submitted to the Department of Public Works for approval. The following requirements must also be met: 1. Submit a revised plot plan showing one recreational building within phases V or VI, elevations of said building to be approved by the Planning Department prior to issuance of building permit on recreation building. 2. Construct a masonry wall (6' minimum height both sides) along southerly 210' of east boundry, adjacent to C R zone; along easterly 110' of south boundry, adjacent to single family homes; along west side adjacent to proposed church site. Construct 6' masonry wall or wrought iron fence with extensive landscaping along north side, adjacent to Dyer; along the north side of the sanitary sewer easement, adjacent to Southern Pacific Railroad; along west side, adjacent to flood control channel and along south side, adjacent to Alton Avenue. 3. The Planning Commission initiate amendment proceedings of the C R District along west side of Main Street, between Dyer and Columbine to C 4, excepting those portions to be used for construc- tion of townhouses under VA 71-20 and lots 1-15 in Tract 7408. - 1 - 4. File a parcel map or a revised map for Tract 7161 and comply with all Council approved conditions. 5. Submit a revised plot plan showing no use within the existing 20 foot Sanitation District No. 1 sewer easement. NOTE: A block wall or wrought iron fence with extensive landscaping is required along the north line of the sewer easement. Permission to place any road- way, planting or trees within the sewer easement must be obtained from the Sanitation District since the easement is used for access for main- tenance purposes. 6. Furnish the Department of Public Works the following: A revised runoff study based on a storm of a 25-year frequency by a civil engineer showing existing and proposed facilities and methods of draining this area. b. An on-site drainage flow plan and a final grading plan. c. The interior north-south streets from west to east to be named Bradford Place and Sycamore Street. d. The interior east-west streets from north to south to be named Dyer Road, Carriage Drive and Alton Avenue. Property line spandrels to have a radius of 25 feet at the intersections of Dyer Road and any intersecting street; all other street intersections to have property line spandrels with a radius of 15 feet (except at knuckle). f. Minimum radius of 150 feet for street center lines are required. g. No medians or islands to be in any of the interior streets. (Dyer Road has median.) h. Minimum street grade to be .25% in all streets except Dyer Road and Alton Avenue. i. Interior streets to have 40 feet between curbs. NOTE: The City will require the completion of Alton Avenue crossing over the flood control channel prior to a utilities release on this development. j. Dedicate pedestrian and vehicular access rights to Dyer Road except at street entrances. NOTE: Dedication shall be initiated by owner, through the Department of Public Works at least four weeks prior to application for a building permit to avoid delay. ke Submit street improvement plans by a civil engineer for interior streets, Dyer Road and for Alton Avenue to Flower Street, to be approved by City's Public Works Department. 1. Furnish the Department of Public Works a revised sewer study. m. Provide water main easements as required by the Department of Public Works. n. Ail drive approaches to be to City standards. Provide adequate protection of the existing storm drain in the easement adjacent to the Sanitation District right of way (if a roadway is located over it). Provide sanitary sewer and drainage easements to conform with City design standards as determined by the revised sewer and drainage studies. 7. The following conditions are to be complied with prior to issuance of utilities release by the Department of Building Safety and Housing: a. Provide sanitary sewer facilities in accordance with the approved revised sewer study. b. Provide storm drain facilities as required by the Depart- ment of Public Works. Improve Dyer Road and Alton Avenue with paving, curb and gutter, full width sidewalk and tree wells with trees ($17.50 per tree). NOTE: Forty-four feet between curbs required on Alton Avenue. I~rove Carriage Drive, Bradford Place, and Sycamore Street as required with six foot sidewalks adjacent to curb or as otherwise approved by Department of Public Works. ee Complete the crossing of Alton Avenue across the Orange County Flood Control right of way to Flower Street at no cost to the City. Comply with all applicable conditions set by Council for approval of Tentative Tract 7161 as determined by Public Works. g. Provide on-site underground utility connections per Ordinance NS-903.
