HomeMy WebLinkAbout72-004RESOLUTION 72-4 APPROVING MAP AND DECLARING INTENTION TO VACATE ALLEY SOUTH OF ~ARNER AVENUE AND EAST OF BRISTOL STREET RESERVING EASEMENT FOR SOUTHERN CALIFORNIA GAS COMPANY AND SOUTHERN CALIFORNIA EDISON COMPANY WHEREAS, the Department of Public Works and Planning Commission have recommended a public hearing be set on the question of said vacation, a request for the vacation of that certain alley south of Warner Avenue and east of Bristol Street, has been received by the City Council; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby approves the map attached hereto and orders the same filed with the original of this Resolution in the office of the Clerk of the Council, and reference is hereby made to said map for the exterior boundaries of the right of way proposed to be vacated; BE IT FURTHER RESOLVED: That the City Council hereby declares its intention to proceed under the provisions of the Street Vaca- tion Act of 1941 (Sections 8300 through 8374 of the California Streets and Highways Code) to vacate that alley south of Warner Avenue and east of Bristol Street; said right of way proposed to be vacated lies within the City of Santa Ana, County of Orange, State of California, described as follows: Ail that portion of the West half of Section 25, Township 5 South, Range 10 West in the land allotted to James McFadden in the City of Santa Ana as described in the Final Decree of Partition of the Rancho Santiago de Santa Aha, which was entered September 12, 1868 in Book "B", Page 410 of Judgments of the District Court of the 17th Judicial District in and for Los Angeles County, California, described as follows: The Northerly 10.00 feet of the following described property. Beginning at a point on the center line of Bristol Street, 80.00 feet in width, as described in deed to Orange County, recorded June 1, 1949 in Book 1851, Page 303, Official Records, Orange County, California, distant South 0° 53' 33" West 1540.02 feet from the Northwest corner of said Section 25; thence South 89° 22' 10" East 415.71 feet to the beginning of a tangent curve, concave Northerly having a radius of 600.00 feet; thence Easterly along said curve through a central angle of 7° 42' 10", an arc distance of 80.66 feet; thence South 0° 38' 16" West 785.41 feet; thence North 89° 22' 10" West 499.60 feet to said center line of Bristol Street; thence North 0° 53' 33" East 780.00 feet to the point of beginning. Excepting therefrom that portion lying Westerly of a line parallel with and distant 50.00 feet Easterly, measured at right angles, from said center line of Bristol Street. Reserving from the above described land an easement and right of way to construct, place, operate, insepct, main- tain, repair, replace, remove, and enlarge lines of pipes and other structures, equipment and fixtures at any time and from time to time, for the operation of gas lines as the Southern California Gas Company may required; Also reserving from the above described land an easement and right of way to construct, lay, install, use, maintain, alter, add to, repair, replace, inspect and/or remove, at any time and from time to time, aerial and underground electric lines and communication lines, consisting of poles, guys, and markers and other fixtures and appli- ances, for conveying electric energy to be used for light, heat, power, telephone and/or other related uses, in, on, over, under and through as the Southern California Edison Company may require. BE IT FURTHER RESOLVED: That February 7th, 1972, at the hour of 7:30 p.m., in the Council Chambers, City Hall Annex, 530 North Rosst Street, Santa Ana, California, is hereby fixed as the time and place for hearing all persons interested in or objecting to said proposed alley vacation; BE IT FURTHER RESOLVED: That the Clerk of the Council of the City of Santa Ana is hereby ordered to publish this Resolution one time in the Register, and the Director of Public Works is ordered to post notices of street vacation conspicuously along the line of said street, stating the passage of this Resolution of Intention to Vacate and the time and place of hearing thereon. Said notices shall be posted not more than 300 feet apart and at least three (3) such notices shall be posted. Both publication and posting shall be completed at least ten (10) days before the date of hearing.
