UPHOLDING THE DECISION OF THE PLANNING
COMMISSION DENYING APPEAL 9294 AND GRANTING
VARIANCE APPLICATION 72-8 SUBJECT TO THE
PLANNING COMMISSION CONDITIONS OF APPROVAL
FILED BY ROBERT EWING ASSOCIATES
BE IT RESOLVED: That the City Council of the City
of Santa Ana does hereby uphold the decision of the
Planning Commission to deny Appeal ~294 and grant V.A.
72-8 filed by Robert Ewing Associates, subject to the
following conditions:
The development be according to the approved
plot plan, except for minor modifications
approved by the Planning Department.
2. That all conditions of the Building and Fire
Fire Departments be met.

That a landscape plan be submitted to and approved
by the Planning Department, including the provisions
of Sec. 41-618 of the Zoning Ordinance, and that
said landscaping be implemented and be continu-
ously n~intained.
4. That any trash areas be enclosed in accordance
with the Planning Department standards.
Submit to the Department of Public Works, for
their approval, an acceptable final grading plan
or an on-site drainage plan or both, showing the
direction and means of flow to the adjacent street(s)
or channel(s) when this property is developed. Plan
is to include existing and proposed elevations at
the property lines. Applicants should check with
the Department of Public Works for extent of study
needs.
6. Dedicate required street or alley right of way.
7. Pay drainage assessment fee.
8. Pay Sanitation District No. 7 fee.
9. Pay water service connection charges.
10. Pay street tree charges.
11.
Comply with applicable conditions of previously
approved tract map or parcel map pertaining to this
site.
12. Construct necessary street improvements:
a. paving
b. curb and gutter
c. sidewalk
d. driveway
e. cross-gutter
f. tree wells
13. Construct necessary sewer facilities as required by
the Department of Public Works.

14. Construct necessary storm drain facilities as
required by the Department of Public Works.
15. Construct necessary water system facilities as
required by the Department of Public Works.
16. Dedicate water system to the City.
17.
Provide for installation of approved street
lighting with underground service on all street
frontages unless otherwise noted.
18.
Ail plans and surveys for required public improve-
ments shall be prepared under the direction of a
registered Civil Engineer and shall be submitted
to the Department of Public Works for approval.
19.
Ail public improvement construction shall be
subject to inspection and approval by the
Department of Public Works.
20.
Required property dedications shall be initiated
by the owner, through the Department of Public
Works, at least four weeks prior to application
for a building permit, or use as applicable, to
avoid delay.
21.
In certain cases, the City will reimburse owner
for eligible street improvements costs. Owner
is advised to contact the Department of Public
Works for information regarding this reimbursement
policy.
22. No additional openings in existing median island
will be allowed except as approved on the plot plan.
The following requirements must also be met:
Architecture of entire development shall be inte-
grated in a manner meeting the approve of the
Planning Department.
Architecture of the House of International Pancakes
shall be the same or similar as adjacent buildings
including color.
An integrated sign program shall be submitted to
and approved by the Planning Department for the
entire development. Pole signs shall conform to
the Sign Ordinance and shall be no closer than
10 feet to any property line and there shall be no
sign projection into the 10 feet. All other signs
shall conform to the Sign Ordinance. Said sign
program shall be approved by the Planning Department
prior to the issuance of permits for any signs in
the development.
Modifications to the submitted plot plan shall be
allowed subject to the review and approval of the
Planning Department; however, if the change is of
a magnitude that the staff feels that it is not a
minor modification the revision shall be referred
to the Planning Commission for consideration.
5. If sidewalks are not required; 8-foot wide landscaped

planters shall be placed in the public right of way
in place of sidewalks, except at approved driveways.
Said landscaping shall be implemented according to
the landscape plan, be permanently maintained
by the property owner and be provided with
automatic irrigation devices.
6. Dedication
MacArthur Boulevard - small wedge at the
southeast corner of main driveway entrance
to provide full 59 feet right of way south
of center line of MacArthur Boulevard east
of the driveway.
7. Improvement Plans
a. Bristol Street
b. MacArthur Boulevard
c. Plaza Drive
8. Improvements
Bristol Street: To include paving to meet
existing pavement, curb and gutter varying
from 52 feet to 62 feet west of center line
and full width sidewalk with tree wells and
trees.
b. MacArthur Boulevard - Full width sidewalk with
tree wells and trees.
c. Plaza Drive - Full width sidewalk with tree
wells and trees.
NOTE:
It is noted that eight foot wide landscaped strips
in place of sidewalks was granted in Resolution
71-13 which granted Variance 70-68 for this
property; however, it is still this department's
opinion that sidewalks should be provided on these
perimeter streets.
PASSED AND ADOPTED by the City Council of the City of
Santa Aha at its regular meeting held on the 20th day of
March, 1972.
