HomeMy WebLinkAbout72-040RESOLUTION 72-40 AUTHORIZING CONDEMNATION OF REAL PROPERTY FOR THE WIDENING OF FIRST STREET BETWEEN TOWNSEND AND HESPERIAN WHEREAS, in order to provide for a more orderly flow of traffic on First Street in the City of Santa Ana, it has become necessary to widen and improve said street from Townsend to Hesperian Street. NOW, THEREFORE, BE IS RESOLVED: That the City Council of the City of Santa Ana does hereby find and declare that the public interest and necessity require that First Street be widened and improved from Townsend to Hesperian Street to provide for a more orderly flow of east-west traffic, and further require that said City do have, take and acquire for street purposes that certain real property in the City of Santa Ana, County of Orange, State of California, des- cribed as follows: PARCEL 1: Lot 12 in Block 4 of the Pacific Electric Subdivision of the Ross Tract, in the City of Santa Ana, as shown on a map thereof recorded in Book 4, Page 14 of Miscellaneous Maps, records of Orange County. PARCEL 2: Lot 9 in Block 4 of the Pacific Electric Subdivision of the Ross Tract, in the City of Santa Aha, as shown on a map thereof recorded in Book 4, Page 14, Miscellaneous Maps, records of said Orange County. PARCEL 3: The Southerly 40 feet of Lots 10 to 16 inclusive, in Block 12 of the Pacific Electric Subdivision of the Ross Tract, in the City of Santa Ana, as per map recorded in Book 4, Page 14, Miscellaneous Maps, in the office of the County Recorder of said Orange County. A spandrel shaped parcel of land bounded Easterly by the Easterly line of said Lot 16; bounded Southerly by the Northerly line of Parcel ~ above described; and bounded Northwesterly by the arc of a curve concave Northwesterly having a radius of 25.00 feet and being tangent to said Easterly and Southerly boundaries. PARCEL 4: A spandrel shaped parcel of land bounded on the North by the North line of Lot 4 in Block "B" of Tract No. 233, in the City of Santa Ana, as shown on a map recorded in Book 13, Page 9, of Miscell- aneous Maps, records of said Orange County, California: bounded on the East by the East line of said Lot 4; and bounded on the Southwest by the arc of a curve concave Southwesterly having a radius of 25.00 feet and tangent to said North and East boundaries. PARCEL 5: That portion of the land allotted to Julian Chavez, in the City of Santa Ana, as described in the Final Decree of Partition of the Rancho Santiago de Santa Ana, which was entered September 12, 1868 in Book "B", Page 410 of Judgments of the District Court of the 17th Judicial District in and for Los Angeles County, California described as follows: - 1 - PARCEL 6: Ail that certain portion hereinafter referred to as Parcel A, lying Southerly of a line parallel with and distant 50.00 feet Northerly, measured at right angles, from the following described line: Beginning at a point on the center line of Daisy Avenue distant 20.00 feet Northerly, measured at right angles, from the center line of First Street as shown on a map of the Fisher Tract recorded in Book 4, Page 90 of Miscellaneous Maps records of Orange County, California; thence Westerly in a straight line to its intersection with said center line of First Street distant 900.45 feet Westerly from the center line inter- section of said Daisy Avenue and First Street. A spandrel shaped parcel of land bounded Southerly by said parallel line that is distant 50.00 feet Northerly in Parcel 5 above described, bounded Easterly by a line parallel with and distant 33.22 feet Westerly, measured at right angles, from the West line of that certain 6.32 foot strip of land shown along the West boundary of the Fisher Tract, as shown on a map recorded in Book 4, Page 90 of Miscellaneous Maps, records of said Orange County and bounded Northwesterly by the arc of a curve concave Northwesterly having a radius of 25.00 feet and tangent to said Southerly and Easterly boundaries. Beginning at a point in the center line of First Street in the City of Santa Ana, California, which said point is distant Easterly measured along said center line of First Street 1675.28 feet from the intersection of said center line of First Street with the center line of Sullivan Street and running thence from said point of beginning North, parallel with said center line of Sullivan Street, 340.43 feet; thence North 0° 25' 30" West 172.00 feet; thence North, parallel with said center line of Sullivan Street, 89.89 feet to a point in the Westerly extension of the center line of Third Street in the City of Santa Ana; thence Easterly along said extension of the center line of Third Street 329.47 feet to a point in the West line of that certain 6.32 foot strip of land shown along the West boundary of the Fisher Tract, as shown on a map recorded in Book 4, Page 90 of Miscellaneous Maps, records of Orange County, California; thence Southerly along said Westerly line and the extension thereof 602.32 feet to a point in said center line of First Street; thence Westerly along the center line of First Street 328.47 feet, more or less, to the point of beginning. That portion of the land allotted to Julian Chavez, in the City of Santa Ana, as described in the Final Decree of Partition of the Rancho Santiago de Santa Ana, which was entered September 12, 1868 in Book "B", Page 410 of Judgments of the District Court of the 17th Judicial Court in and for Los Angeles County, California described as follows: - 2 - Ail that portion of Parcel 6, as shown on a map recorded in Book 9, Page 49 of Parcel Maps, records of said Orange County lying Southerly of a line parallel with and distant 50.00 feet Northerly, measured at right angles, from the following described line; Beginning at a point on the center line of Daisy Avenue distant 20.00 feet Northerly, measured at right angles, from the center line of First Street as shown on a map of the Fisher Tract recorded in Book 4, Page 90 of Miscellaneous Maps, records of Orange County, California; thence Westerly in a straight line to its intersection with said center line of First Street distant 900.45 feet Westerly from the center line intersection of said Daisy Avenue and First Street. BE IT FURTHER RESOLVED: That the City Attorney is hereby ordered to bring an action in the name of the City of Santa Ana to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination That work is to begin immediately, and it is necessary for the City of Santa Ana to have possession of the above described property as soon as possible.
