A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA DENYING APPEAL NO. 301 FILED BY
WESTERN UNION REALTY COMPANY AND GRANTING
VARIANCE APPLICATION ~-18 FILED BY PRUDENTIAL
OVERALL SUPPLY .l~-
BE IT RESOLVED: That, based upon the Findings of Fact of the
Planning Commission and new testimony presented before the City
Council, the City Council of the City of Santa Ana hereby reverses
its decision and denies Appeal No. 301 filed by Western Union
Realty Company and upholds the decision of the Planning Commission
granting VA 72-18 filed by Prudential Overall Supply to operate
an automobile repair garage and impound yard in the M1 and M2
Districts, subject to the following conditions:
1. That all conditions of the Building and Fire Departments
be met.
That a landscape plan be submitted to and approved by the
Planning Department, including the provisions of Sec. 41-
618 of the Zoning Ordinance, and that said landscaping be
implemented and be continuously maintained.
3. That any trash areas be enclosed in accordance with the
Planning department standards.
Submit to the Department of Public Works, for their approval,
an acceptable final grading plan or an on-site drainage plan
or both, showing the direction and means of flow to the
adjacent street (s) or channel(s) when this property is
developed. Plan is to include existing and proposed eleva-
tions at the property lines. Applicants should check with
the Department of Public Works for extent of study needs.
5. Dedicate required street or alley right of way.
6. Provide construction plans for:
a. required street improvement,
b. sewer system
7. Pay drainage assessment fee.
8. Pay City sanitary sewer main assessment fee.
9. Pay City water main charges
10. Pay water service connection charges.
11. Pay street lighting deposit for future street lights.
12. Construct necessary street improvements:
a. paving,
b. curb and gutter
13. Install approved protective fencing along flood control
channel.

All plans and surveys for required public improvements shall
be prepared under the direction of a registered Civil
Engineer and shall be submitted to the Department of Public
Works for approval..

inspection and approval by the Department of Public Works.

All elevations shall be referenced to the 1958 Orange
County Survey Datum.
Required property dedications shall be initiated by the
owner, through the Department of Public Works, at least
four weeks prior to application for a building permit,
or use as applicable, to avoid delay.

Submit a revised plot plan showing:
(1) an additional five offstreet parking spaces.
(2) entire auto storage area paved.
The impound portion of the yard shall be screened from ad-
jacent properties and public streets by a masonry wall and
solid gates to a height of not less than eight (8) feet,
nor more than twelve (12) feet. Gates shall be kept closed
when not in use.
The storage of wrecked vehicles and salvage materials shall
not be piled higher than the wall or gate at any point on
the site.
Elevations and construction plans of the walls and gates
shall be submitted to the Planning Dept. for approval prior
to construction.
No salvage materials, wrecked automobiles or impound vehicles
shall be temporarily or permanently stored outside the solid
fences or walls surrounding the vehicle storage yard.
There is to be no wrecking or dismantling of vehicles or
sale of vehicle parts.

building within 75' of travel.
Fence gates shall be locked only with padlocks.
The following requirements are also to be complied with prior
to the issuance of a building permit:
(1) Submit a parcel map on the total property and comply
with all Council approved conditions.
(2) Provide storm drain easement.
J. Details of requirements:
(1) Dedications
(a) Hathaway Street
Street easement for a width of 30 feet from
center line to property line and to include
an elbow as required by the Department of
Public Works at the southwest corner of
Hathaway Street and Hunter Street.
Drainage easement over the southerly ten feet
of this property.

Improvement Plans
(a) Hathaway Street
(To include elbow at Hunter Street as
required).
NOTE: Sewer plans may be required.
(3) Improvements
(a)
Hathaway Street with industrial street section.
Entire frontage (220') along Hathaway Street is
to be improved in order to avoid the traffic
congestion which would be caused by trucks tow-
ing cars constantly over the 30' half streets.
(b) If required: Extend sewer main.
That a letter be furnished by Ben Warner Garage agreeing
to abandon the 3 sites they presently operate.
