RESOLUTION OF THE CITY COUNCIL OF SANTA
ANA UPHOLDING THE DECISION OF THE PLANNING
COP~4ISSION AND GRANTING VARIANCE APPLICA-
TION 72-45 FILED BY ARNOLD B. GASSER
BE IT RESOLVED: That based upon "Finding of Fact VA-
72-45" of the Planning Commission, the City Council of the City
of Santa Ana does hereby grant VA 72-45 filed by Arnold B.
Gasser, to construct 39 townhouse units in the C 1 District at
1426 South Sullivan Street, Sance Ana, subject to the following
conditions:
That all conditions of the Building and Fire Departments
be met.
That a landscape plan, including the provisions of Sec.
41-618 of the zoning Ordinance, be submitted to and
approved by the Planning Department and that said
landscaping plan be implemented and continuously main-
tained.
That any trash areas be enclosed in accordance with the
Planning Department standards.
That there be a minimum 15 feet between main dwellings,
clear of balconies, landings or stairways.
Submit to the Department of Public Works, for their
approval, an acceptable final grading plan or an on-site
drainage plan or both, showing the direction and means
of flow to the adjacent street(s) or channel(s) when
this property is developed. Plan is to include existing
and proposed elevations at the property lines. Applicants
should check with the Department of Public Works for
extent of study needs.
6. Provide construction plans for:
a. required street improvement.
7. Pay City water main charges.
8. Pay water service connection charges.
9. Pay street lighting deposit for future street lights.
10. Pay street tree charges.
11. Construct necessary street improvements:
a. paving,
b. curb and gutter,
c. sidewalk,
d. driveway.
12. Repair or replace existing street improvements to City
standards:
a. sidewalk.
13. Construct necessary storm drain facilities as required
by the Department of Public Works.

Ail plans and surveys for required public improvements
shall be prepared under the direction of a registered
Civil Engineer and shall be submitted to the Department

of Public Works for approval.
Ail public improvement construction shall be subject
to inspection and approval by the Department of Public
Works.
Ail elevations shall be referenced to the 1958 Orange
County Survey Datum.
The following requirements must also be met:
That a revised plot plan be submitted to and
approved by the Planning Department except for
minor modifications to be approved by the
Planning Department.
That the revised plot plan show the following
changes or additions:
That a 6' high masonry wall be constructed
along the northerly property line, as well
as along the south and west property lines.
That the applicant arrange for a permanent
recorded ingress and egress easement over
the property to the south or west for
emergency use by the Fire Department.
The following requirements are also to be co~-
plied with prior to the issuance of a building
permit:
(1)
File a parcel map with the City and comply
with all Council approved conditions, (if
the original plot plan is approved).
(2) Plug the existing water well to City stan-
dards.
D. Details of requirements:
(1) Improvement plans:
(a) Sullivan Street
(2) Improvements:
(a)
Sullivan Street with pavement to meet
existing pavement, curb and gutter at
20 feet west of the center line and
sidewalk.
NOTE: To be no curbside parking on Sullivan Street.
NOTE:
The applicant should investigate standard
fees for street improvement, future ornamen-
tal street lights, etc.
PASSED AND ADOPTED by the City Council of the City of
Santa Aha at its regular meeting held on the 18th
day of September , 1972.
