RESOLUTION OF THE CITY COUNCIL OF SANTA
ANA OVERRULING THE DECISION OF THE
PLANNING COMMISSION AND GRANTING APPEAL
NO. 306 AND APPROVING VARIANCE APPLICA-
TION 72-46 FILED BY SUBURBIA, INC.
BE IT RESOLVED: That, based upon "Findings of Fact VA 72-46"
of the Planning Commission and testimony presented before the City
Council, the City Council of the City of Santa Ana hereby re-
verses the decision of the Planning Commission and grants Appeal
No. 306 on Variance Application 72-46 filed by Suburbia, Inc.
to construct a 22 unit apartment development in the R 2 B District
subject to the following conditions:
That all conditions of the Building and Fire Departments
be met.
That a landscape plan be submitted to and approved by the
Planning Department, including the provisions of Sec. 41-618
of the Zoning Ordinance, and that said landscaping be imple-
mented and be continuously maintained.
That any trash areas be enclosed in accordance with the
Planning Department standards.
That there be a minimum 15 feet between main dwellings,
clear of balconies, landings or stairways.
Submit to the Department of Public Works, for their approval,
an acceptable final grading plan or an on-site drainage plan
or both, showing the direction and means of flow to the
adjacent street(s) or channel(s) when this property is deve-
loped. Plan is to include existing and proposed elevations
at the property lines. Applicants should check with the
Department of Public Works for extent of study needs.
6. Pay drainage assessment fee.
7. Pay street lighting deposit for future street lights.
8. Pay street tree charges.
Repair or replace existing street improvements to City
standards:
a. sidewalk.
10. Construct necessary sewer facilities as required by the
Department of Public Works.
11. Close existing driveways as required to City standards.
12. Ail public improvement construction shall be subject to
inspection and approval by the Department of Public Works.
13. The following requirements must also be met:
Submit a revised plot plan to the Planning Department
indicating revisions as required by the following
conditions:
~1~ Parking meet Ordinance requirement.
(2) 6' high ~ masonry wall be constructed on the
north, south, and west property lines.
(3)
Ail units to have private open space with minimum
balcony size of 45 square feet and minimum patio
size of 72 square feet.
(4) There be a minimum of 44.5% open space.

2A rated fire extinguisher shall be located on each
story and within 100 feet of travel from exits and
carports.

Driveway shall be paved the total width to support 30,000
pounds fire apparatus.
Plans shall be submitted to the Fire Department for
approval.
E. Details of Requirements
(1) Improvements
(a) Cypress Avenue
replace all sidewalk to City standards
remove broken sidewalk from parkway area
construct the proposed drive approaches
with a width of 30 feet.
PASSED AND ADOPTED by the City Council of the City of
Santa Ana at its regular meeting held on the 18%h
day of September , 1972.
