HomeMy WebLinkAbout72-107RESOLUTION NO. 72-107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA FINDING THAT CERTAIN MODIFICATION AND CHANGES IN THE REGULATIONS CONTAINED IN THE UNI- FORM BUILDING CODES AND THE UNIFORM PLUMBING CODE, 1970 EDITIONS, ARE REASONABLY NECESSARY BECAUSE OF LOCAL CONDITIONS WHEREAS, the City Council of the City ofSanta Aha will consider the adoption of proposed Ordinance NS-1147 , which would adopt by reference into the Santa Ana Municipal Code the 1970 Editions of the Uniform Building Code, including Volume 1, the "Standards" Voltune, Volume II, "Uniform Mech- anical Code" and Volume III, "Housing," and the Uniform Plumbing Code; and WHEREAS, said proposed Ordinance NS-1147 includes certain modifications and changes in the regulations contained in said uniform codes; and WHEREAS, Section 17958.7 of the California Health and Safety Code requires that a governing body before making any such modifications or changes shall make an express finding that such modifications or changes are needed, NOW THEREFORE BE IT RESOLVED, the City Council finds that the modifications and changes in the regulations contained in said Uniform Codes, as such modifications and changes are set forth in proposed Ordinance NS-l147 are reasonably necessary because of local conditions. BE IT FURTHER RESOLVED that a copy of this resolution shall be filed with the City Clerk and available as a public record. BE IT FURTHER RESOLVED that the City Council finds that said changes are necessary for the following reasons: A. UNIFORM BUILDING CODE, Volume I, 1970 EDITION 1. Sections 8-100, 8-101, 8-102, 8-109, 8-110, and 8-111 are administrative amendments which provide for fees and refunds which are commensurate with the services provided by the B~ilding Department and designed to produce revenues for services per- formed. 2. Section 8-112 amends the use and occupancy provisions in order to insure compliance with all other applicable City ordi- nances and laws related to construction. 3. Section 8-156 adds requirements for fencing of swimming pools, etc., in order to reduce the potential hazards to small children. 4. Section 8-200 incorporates into the 1970 Edition modifica- tions which have already been approved for the 1973 Edition of the Uniform Building Code. The modifications reduce the limi- tations upon the enclosing of patio covers. B. UNIFORM PLUMBING CODE - 1970 EDITION 1. Section 8-329 accomplishes editorial correction. 2. Section 8-337 modifies provisions with respect to viola- tions and penalties to be consistent with provisions in the Santa Aha Municipal Code. 3. Sections 8-342, 8-354, 8-355, and 8-356 are administrative amendments which provide for fees and refunds which are commen- surate with the services provided by the Building Department and designed to produce revenues for services performed. 4. Section 8-398 deletes a specification which is no longer necessary under present standards. 5. Section 8-400 modifies the limitations with respect to water piping in or under a concrete floor slab resting on the ground. To clarify that there is no current approval of a non- metallic water piping for this use and to preclude damage due to the adverse affects of soil incompatibility with ferrous piping. 6. Sections 8-401 and 8-402 are modified to provide a greater capacity for water supply required in our "semiarid" region. C. UNIFORM MECHANICAL CODE - 1970 EDITION 1. Section 8-560 incorporates administrative amendments which provides for fees and refunds which are commensurate with the services provided by the Building Department and designed to produce revenues for services performed.
