HomeMy WebLinkAbout73-031RESOLUTION NO. 73-31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA OVERRULING THE DECISION OF THE PLANNING COMMISSION AND GRANTING APPEAL NO. 316 ON VARIANCE APPLICATION 73-3 FILED BY RAY MADRID BE IT RESOLVED: That based on the Findings of Fact of the Planning Commission, the City Council of the City of Santa Ana does hereby overrule the decision of the Planning Commission and Grants Appeal No. 316 on Variance Application No. 73-3 to construct a 16 unit apartment complex in the R 1 District subject to the following conditions: 10. 11. That all conditions of the Building Department be met. That a landscape plan be submitted to and approved by the Planning Department, including the provisions of Sec. 41-618 of the Zoning Ordinance (prior to issuance of a building permit) and that said landscaping be implemented (prior to utility release) and be continuously maintained. That any trash areas be enclosed in accordance with the Planning Department standards. That there be a minimum 15 feet between main dwellings, clear of balconies, landings or stairways. That there be no after-hours operation (between 2:00 A.M. and 6:00 A.M.). That a screening plan for mechanical equipment or appurtenances be submitted to and approved by the Planning Department. That all conditions of the Fire Department be met. Submit to the Department of Public Works, for their approval, an acceptable final grading plan or an on-site drainage plan, or both, showing the direc- tion and means of flow to the adjacent street(s) or channel(s) when this property is developed. Plan is to include existing and proposed elevations at the property lines. Applicants should check with the Department of Public Works for extent of study needs. Dedicate required street or alley right of way. Dedicate vehicular access rights. Provide construction plans for required street improvement. 12. Pay drainage assessment fee. -1- RESOLUTION NO. 73-31 13. Pay City water main charges. 14. Pay water service connection charges. 15. Pay street lighting deposit for future street lights. 16. Pay street tree oharges. 17. Construct necessary street improvements: a. paving, b. curb and gutter, c. sidewalk, d. driveway, 3. tree wells. 18. Construct necessary sewer facilities as required by the Department of Public Works. 19. Ail plans and surveys for required public improve- ments shall be prepared under the direction of a registered Civil Engineer and shall be submitted to the Department of Public Works for approval. 20. Ail public improvement construction shall be subject to inspection and approval by the Department of Public Works. 21. Ail elevations shall be referenced to the 1958 Orange County Survey Datum. 22. Required property dedications shall be initiated by the owner, through the Department of Public Works, at least four weeks prior to application for a building permit, or use as applicable, to avoid delay. 23. Submit a revised plot plan to the Planning Department indicating revisions as required by the following conditions: (a) Number of units be limited to 10 units on the entire property 1.06 acres, including the single family unit that is to remain. (b) 6' high block wall be required on all interior property lines - reduced in height to 4' within 20 feet of street property lines. (c) Swimming pool be constructed at time units are constructed. (d) Ail units to have private open space with minimum balcony size of 45 square feet and minimum patio size of 72 square feet. (e) There be a minimum of 50% open space. (f) Parcel Map be recorded on entire 1.06 acres combining it into one parcel. In addition, a covenant to run with the land shall be recorded indicating the property cannot be divided in the future. The City shall be a party to the covenant. -2- RESOLUTION NO. 73-31 24. The following requirements are also to be complied with prior to the issuance of a building permit: (a) File a parcel map with the City showing the total property which includes adjacent easterly property (145' x 90'). (b) Obtain water service from the City of Santa Ana from McFadden Avenue. 25. Details of Requirements: (a) Dedications Street easements (1) Newhope Street for a width of 40 feet from center line to property line. (2) McFadden Avenue for a width of 40 feet from center line to property line. Vehicular access rights (1) To Newhope Street except at the northerly 30 feet. (2) To McFadden Avenue except at the west 18 feet of the east 21 feet. (b) Improvement Plans (1) Newhope Street (2) McFadden Avenue (b) Improvements (1) Newhope Street with pavement to meet existing pavement, curb and gutter at 32 feet east of the center line and full width sidewalk with tree wells and trees. (2) McFadden Avenue with pavement to meet existing pavement, curb and gutter at 32 feet south of the center line and full width sidewalk with tree wells and trees. NOTE: The applicant should be advised that curbside parking on Newhope Street and McFadden Avenue will not be permitted at the subject location. 26. 2A rated fire extinguishers shall be located on each story and within 100 feet of travel distance from any area of each building. 27. Planter in west driveway shall be removed to provide at least twenty (20) feet in clear width. 28.
