HomeMy WebLinkAbout73-127RESOLUTION NO. 73-127 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA OVERRULING THE DECISION OF PLANNING COMMISSION AND GRANTING APPEAL NO. 323 ON CONDI- TIONAL USE PERMIT NO. 73-13 FILED BY THE HARLEQUIN DINNER PLAYHOUSE BE IT RESOLVED: That, based upon "Findings of Fact" of the Planning Commission and testimony presented before the City Council, the City Council of the City of Santa Ana hereby overrules the decision of the Planning Commission and grants Appeal #323 on Conditional Use Permit No. 73-13 filed by the Harlequin Dinner Playhouse to convert an existing warehouse to a combination restaurant and commercial theatre in the M 1 District subject to the following conditions: 1. That the "CUP" is approved for a ten year period. 2. That the "CUP is subject to annual review. e That development be according to the approved plot plan, except for minor modifications approved by the Planning Department. 4. That all conditions of the Building Department be met. That a landscape plan be submitted to and approved by the Planning Department, including the provisions of Sec. 41-618 of the Zoning Ordinance (prior to issuance of a building permit) and that said landscaping be implemented (prior to utility release) and be con- tinuously maintained. 6. That any trash areas be enclosed in accordance with the Planning Department standards. That a screening plan for mechanical equipment or appurtenances be submitted to and approved by the Planning Department. 8. That all conditions of the Fire Department be met. 9. Pay street tree charges. 10. The following requirements must also be met: ae One free standing or pole sign shall be permitted on Juniper Avenue in front of the theatre build- ing. Said sign shall not approach within 10' of the property on Juniper Avenue and shall not be blinking, flashing, or rotating. The free stand- ing pole sign shall meet with the approval of the Planning Department and the Sign Ordinance except where herein modified. Lounge shall not be operated as a separate enter- tainment area when performances are being held in the main theatre. One sign shall be permitted on the exterior of the theatre building and shall be attached to the wall. Said sign shall not exceed the height of the ex- terior wall of the building and shall meet with RESOLUTION NO. 73-127 PAGE TWO the approval of the Planning Department as to size. de Only one marquee sign shall be permitted on the subject property for the theatre. Helicopter landing facility shall meet all applicable regulations of the Building and Fire Departments. (See Section 2 F "Present Use" for clarification). fe Emergency access, on-site hydrants, and water flow capacities shall be in accordance with UFC-71 Article and Section 13.301 and 13.208. The hydrants shall be installed to conform to Improve~ent Standard 403 and 423 and painted chrome yellow. This system plan, including calculations shall be submitted to us for approval. Five copies of the hydrant system plan, includ- ing calculations shall be submitted to us for approval. Commercial cooking facility shall have plans approved for automatic dry chemical extin- guishing system in accordance with UFC-71 Article and Section 13.315. The building and its use shall conform to regulations of Title 19, California Adminis- tration Code (Public Safety) and the Uniform Fire Code pertaining to a Group B, Division 2 occupancy. ke 2A-10BC rated dry chemical fire extinguisher (portable) shall be provided in conspicuous and accessible locations within 100 feet of travel distance from any area of the building. That they be placed in break-glass cabinets to deter tampering. Ail drapes, drops, and other decorative materials, including Christmas trees, shall be made from a non-flammable material or shall be treated and maintained in a flame-retardant condition. That the building be protected with an automatic fire sprinkler system which would provide maxi- mum fire protection at a minimum fire insurance cost. System to conform with NFPA pamphlet 913. Plans of the above 9 conditions shall be sub- mitted to the Department for approval. The following requirement must be complied with as a condition of approval: 1. Submit a revised plot plan showing no new drive approach on Juniper Avenue.
