In Re Rearing Paul B. Anderson 0rd~ n~nce Thi~ b~ing the d~te set for heari~ and no protests having been received, the amend- ment application of Paul B. Anderson was considered for the reclassification of proper~t~ located south of West First Street, between Pacific Avenue and Hesperian Street, if extended south, frc~ the R-1 District to the R-2 District. On motion of Counc~lm~n Ret~y, seconded by Jerc~e and carried, the following Ordt~a-ce entitled: "Ordinance =-~nding Article ~X of the Santa Aha Municipal Code creating c~s in district boundaries ~-~ amendAng Sheet No. 37 of the Districting M~p to show the reclassification" In Re Rearing "School and Park ~nex No. 2" Ordinance was intr~luced, considered and placed on file for second reading. ~his being the date set for hearing protests on ~--*x~tion to the City of certain uninhabited territory desisted "School and Park Annex No. 2" and there being no protests, on motion of Councilman Reinly, seconded by Marhel and carried, the fol- lowing Or~-ce entitled: 511 Delinquent Sales Tax Accounts In Re Variance Ferdinand Lavelle "Or~a-ce declarix~ the ---~xation of that certain territory designated 'School ~ Park ~x No. 2'" was introduced, considered and placed on file for second reading. This being the date set for heart~ on delinquent sales tax accounts of seven person~ or firms, it w~s moved by CouncilmA~ Neinly, seconded by Markel and carried, i that the matter be refe~:£~d to the Attorney to enforce collection. On motion of Councilman Jerome, seconded by D~bl and carried, the rec.~..=~ndation the Pl-~-ing Cc~zlsei~n was approved and the variance of Fer~!~d J. and Nazel Lavelle gz~ted to l~rmit the use of property at 1515 D~raut Street for constructio~ of a duplex, to be located ~0 feet east of existing house, facing north; also, con- str~ction of five garages at rear of lot, with two one-bed_~ocm and bath apartments In Re Variance Richfield Oil Co~p. above, subject to conditions. On motion of Councilman Jerome, seconded by D=hl and carried, the rec~-mendation of the Planning C~=""~ ssion was approved and the variance of Richfield Oil Corporation granted to install and operate stansawd Richfield signs, on steel poles, over each pump island and at 90° angle to each street, on property at the northwest corner of In Re Variance Eugene P. Schaefer Fairview Avenue and Bristol Street, subject to conditions. Communication was read from the Pl--ning C~ission rec~nding approval of varianc of Eugene P. Miller, on behalf of property owners of the 1~00 block South Sycamore Street and petition signed by forty-two persons objecting tO the variance for the reason that it will change their properties from the presen~ R-2 zone to a c~*---rcl~al ~se and as Syc~re ~treet is used by large numbers of children going to and frc~ the Spurgeon School and Julia Lathrop School, as well as the Parochial School, it would create a hazardous condition if the used cars are driven in and out of ~se premises onto Sycamore Street. Petition was read signed by 689 parents of children attending St. ~'s School protesting the granting of the variance for the reason that the proposed business wt.l] constitute a nuisance in that it will hinder +.h~ operation of the school and the exhaust pipes of the cars, during their daily warm-up period, would pour D-m-s into the enclosed and overcrowded playground and also into the classro~, affecting the health of the children~ Mm.. Davis, representing the applicant, stated that the property is within the plans of the Council to provide business zoning betmeen C~presS asd Sycamore Streets and no additional traffic hazards would be created and requested that the variance be granted as recommended. Father Qminn of St. ~-~-'s ~hurch said the traffic I~oblem should be considered. David ~eller said the traffic would bec~,e a problem and requested'that the ~atter beheld in abeyance~ Numerous persons gave their reasons" for opposing the used car lot such as traffic conditions, creating a hazard to the school children and permitting co~ercial uses in a residential Eone. On motion of Councilman Jer~m~, seconded by D=hl amd carried, Map of Tract No. 2323 submitted by Reach Cities Develol~nent Company, for the dedication of Willits .Street, Myrtle Street, Raitt Street, Artesi& Street, .Nottimgham Avenue, Camile Place and +.~ alley a~d bond in the amount of $34,000,00 were approved, license pe~ment fee in the sum of $2,100.00 accepted and the agreement covex~-S improvements was ordered signed.
