Present: Councilmen Absent: Councilmen Dale H. Heialy, J. Ogden Markel, Willi~a Jerome, Milford W. Dahl, Courtney R. Chandler None Each member of the City Council having received copies of the Minutes of July 16th and July 30th, 1956, reading of the ~nut~s was dispensed with and approved on motion of Councilman Heioly, seconded by Jerome and carried. Hear£ng Counci~n Heinly disqualified himself on the amendment application of Rand ~ne nd~e nt Rand Properties, Inc. et al Properties~ Inc. 'i'nis being the date set for hearing protests on the amendment application of Rand Properties, Inc. for the reclassification of 33 acres of land shown as Tract No. 2954 located on the easterly side of Bristol Street 1540' south of the northwest corner of Section 25~ from the R-1 to the C-2-PK District. Communication was read from J.M.Miller explaining that only a nine acre parcel of the property located at the northwest corner of Tract No. 2954 and lying 780' on Bristol Street by approximately 500' deep, will be used for the hospital, conva- lescent home, etc. and requested that portion of the property be rezoned at this time. Hearing declared closed. ~ouncilman Heinly disqualified himself on the variance appligation of Rs~ad Properties, Inc. Communication was read from the Planning Commission recommenaing approva~ to permiv the construction and operation of a general hospital, convalescent home and medical center on property on the east side of Bristol Street, beginning at a point approx- imately 1540' south of Delhi Road with approximately 1440 foot frontage on Bristol Street and a depth of approximately 500' subject to conditions. J.M.Miller stated that the variance is for the nine acres and submitted a legal description of the property, t~ken from the escrow instructions, which is as follows: That pora~on of the West half of Section 25, Township 5 South, Range 10 West, S.B.B.&.M., described as follows: Beginning at a point on the center line of Bristol Street, 80.00 feet in width, as described in Deed to Orange County, recorded June l, 1949 in Book 1851, page 303 of Official Records, distant South Oo 53' 33" ~est ~5~,02 feet from the Northwest corner of said Section 25; thence South 89 22 lO~ East 415.71 feet to the beginning of a tangent curve, concave Northerly having a radius of 600.00 feet; thence easterly along said curve through a central angle of 7° 42' 10" a distance of 80.66 feet; thence South 0° 38' 16" West 785.77 feet; thence North 89° 22' 10" West 495.24 feet to the center line of said Bristol Street; thence Nor~ 0© 53' 33" East 780.00 feet to the point of beginning. No. 56-210 Budget 1956-1957 On motion of Councilman Jerome, seconded by Markel and carried, the variance w~s granted coverf~ the nine acres of land as described in the amended legal of the property,' subject to the conditions that a 10' alley be dedicated, improved and paved on the north side, that a 30' street be dedicated on the south side and a bond filed to insure improvements at such time as they are installed, and subject to the further conditions as imposed by the Planning Cc~m, tssion. On motion of Councilman Jern-~, seconded by Markel and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Ann M~uicipal Code creating changes in district bounR~ies and amending Sheets No. 52 amd No. 6~ of the distriettng map to show the reclassification" frc~ the R-1 to the C-2-PK District, of the ntne acre parcel of property,/reference amendment application of Rand Properties, Inc., was considered and placed on file for second reading. This being the date set for hearing and no protests having been received, the merit application of Orange County Development Company was considered for the re- classification of property located on the south side of Fairview Avenue, begf~ning at a point 892' west of the center line of Bristol Street and Fairview Avenue, with 170' frontage on Fairview Avenue and extending south for a depth of 1027', from the R-1 to the R-3 District. On motion of Counc~mau Jerome, seconded by Markel and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Aha Municipal Code creating cb~mes in district boundaries and amending Sheet No. 5B of the districting map to show the reclassification" was introduced, considered and placed on file for second reading. This being the date set for hearing and no protests having been received, the merit application of Anton H. Segerstrom et al was considered for the reclassifi. of property located on the north side of Talbert Avenue, with a frontage of 3610', between Bristol Street and Fairview Road, from the R-1 to the M-1 District. On motion of Councilman Heinly, seconded by Dahl and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Ann Municipal Code creating cb_--n~mes in district boundaries and adding new Sheet No. 64 to the districting map to show the reclassification" was introduced, considered and placed on file for second reading. Hockaday, owner of a lot on the west side of Bush Street being the third lot south of 16th Street, for the weed assessment charg of $12.00; from Iva Carl for cleaning a lot 44' x 100' located at the northeast corner of West Pine and South Ross Streets, billed for $4B.20, and from J.C.Greuerd~ 2024 W. Eighth Street, for cleaning a lot 50' x 60', in the amount of $24.00, and o: motion of Councilm~n Je~, seconded by Markel and carried, the protests were received and filed. Walter C. Collins verbally protested the weed cleaning charge of $72.00 on two pieces of properties located on the north and south sides of East Sixth Street and described as a portion of Section 7, Township 5, Range 9. It was Cou~ci 1 mOved by~Heinly that an adjustment be made in the weed assessment bill of Iva C~rl to the extent of 50~, or $21.00. Motion lost for lack of a second. On motion of Councilman Heinly, seconded by ~ and carried, the matter was referred to the Manager and Attorney for appropriate action and to register a protest to the City of Orange. On motion of Councilman Reinly, seconded by Mm~'kel and ca~ried, the communication dated July 9, 1956, with Resolution No. 1379 from the City of Or-~e a~vising of proposed ~n~exation of certain real property, Annexation No. 83, was received and filed. On motion of COIA~C~1m~n Heinly, seconded by Jerome and carried, the communication from the Cb-tuber of Commerce rec...~.~nding that the Council draft an Ordinance pro- hibiting begging on City streets, was received and filed. On motion of Cou~e~]man ~hl, seconded by Heinly and carried, the matter was referred to the Attorney to determine if such an Ordinance is in effect and to so advise the Chamber and if not to prepare the Ordinance for presentation at the next meeting. On motion of Councilm~n Heinly, seconded by Markel and carried, the communication from the Chamber of Corem-fcc recommending that the Council draft an 0r~inance prohibiting the display of merchandise for sale and/or storage of merchandise on sidewalks was received and filed. On motion of Counc~lm-n Heinly, seconded by Markel and carried, the matter w~s referred to the Attorney to prepare an Ordinance prohibiting the display of merchandise on sidewalks. On motion of Counc~m~u Markel, seconded by Jerome and carried, the request of the Chamber of Comm"rce for poxmission to conduct a motorcade at 1 P.M. August 11, 1956, to transport the Little Lesgue Baseball players to the Municipal Bowl, was granted. On motion of Councflman Jerome, seconded by Markel and carried~ the communication fre~ the Boundary Con~ission reference proposed annexation of territory to the City of Tustin, designated "Andrew R. Morris AnnexatiOn", located east of Tustin and north of First Street, was received and filed. On motion of councilman Jere~e, seconded by Markel and carried, the from the Santa Aha City ~ptoyees Association expressing gratitude for the action taken by the Council in adopting the new salaz-y and wage schedule, was received and filed. On motion of Councilman Markel, seconded by Je ~rom~e and carried, the resignation of Thomas W. M~rkham, as a member of the Personnel Board, was accepted with regret and the Clerk instructed to address a communication to Mr. Markham cnm~ending him for his services. On motion of Cou~cilr,-n Jero~,e, seconded by Dshl and carried, check in the s~ of $14,000.00 submitted in lieu of bond by Thomas Shoen, for off-site improvements on property known as Tract No. 2678, was ordered released and improvements accepted as completed. On motion of Councflman Dabl, seconded by Markel and carried, the Purchasing Agent was authorized to advertise for bids for fifty fire hydrants, Specification N6. bids to be opened August 2Otb, 1956.
