Bk 11249 Pg 1092 RESOLUTION NO. 74-115 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ORDERING THE VACATION OF A PORTION OF A NORTH-SOUTH ALLEY LOCATED BETWEEN CENTRAL AVENUE AND HEMLOCK WAY AND RESERVING EASEMENTS OVER THE SAME WHEREAS, on recommendation of the Department of Public Works and the Planning Commission of the City of Santa Ana, Resolution 74-113 was adopted giving notice of intention to vacate a portion of a north-south alley located between Cen- tral Avenue and Hemlock Way and reserving easements over the same; and WHEREAS, Resolution No. 74-113 was published and Notice of Intention to Vacate was posted as required by law; and WHEREAS, on 1974, a public hearing was duly held on said vacation; and WHEREAS, the Department of Public Works has deemed it essential to the health, safety, and welfare that an exclusive permanent easement over a portion of the north-south alley located between Central Avenue and Hemlock Way be retained for utility purposes for the Pacific Telephone and Telegraph Com- pany and the Southern California Edison Company. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Santa Aha hereby finds that the above mentioned alley is unnecessary for present or prospective alley purposes and does hereby make its order abandoning and vacating for alley purposes that certain right-of-way located in the City of Santa Ana, County of Orange, State of California, described as follows: That portion of that certain alley as shown on a Map of Tract No. 2392 recorded in Book 108, pages 15 and 16 of Miscellaneous Maps, records of Orange County, California, lying Westerly of the Westerly lines of lots 44 to 57, inclusive, of said Tract No. 2392, bounded Northerly by the Westerly prolonga- tion of the Southerly line of the Northerly 25.00 feet of said Lot 53 and bounded South- erly by the Easterly prolongation of the Northerly line of that certain parcel of land described in the Deed to Bristol Convalescent Hospital, recorded July 18, 1962, in Book 6181, page 294, of Official Records. Reserving an easement and right-of-way to the Pacific Telephone and Telegraph Company over the westerly 4.00 feet of the above described alley to construct, place, operate, inspect, maintain, repair, replace and remove such aerial and underground telephone, telegraph and communication structures as the company may from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, markers and necessary fixtures and appurtenances. P~ESOLUTION NO. 74-115 PAGE TWO Also reserving an easement and right of way to Southern California Edison Company over the Westerly 10.00 feet of the above described alley to construct, lay, install, use, maintain, alter, add to, repair, replace, inspect and/or remove, at any time and from time to time, aerial and underground electric lines and communication lines, consisting of Doles, guys, and markers and other fixtures and appliances, for conveying electric energy to be used for light, heat, power, telephone and/or other related uses, in, on, over, and under and through as the Southern California Edison Company may require. BE IT FURTHER RESOLVED that the vacation of said portion of a north-south alley located between Central Avenue and Hemlock Way shall not take effect until the following actions occur: Approval of a variance to expand Mercy General Hospital; e Removal of a number of apartment houses which now use the alley; Dedication of new alleys to a width and align- ment to satisfy traffic requirements; and 4. Improvement of new alleys to City standards. BE IT FURTHER RESOLVED that the public convenience and necessity require the reservation of an exclusive permanent easement over a portion of the north-south alley located bet- ween Central Avenue and Hemlock Way for utility purposes for the Pacific Telephone and Telegraph Company and the Southern California Edison Company. BE IT FURTHER RESOLVED that these proceedings are taken subject to said utility easement rights retained for the Pacific Telephone and Telegraph Company and the Southern Cali- fornia Edison Company.
