HomeMy WebLinkAbout74-122RESOLUTION NO. 74-122 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA RECOMMENDING APPLICATION FOR THE EX- TENSION FOR THE DEADLINE FOR ADOPTION OF THE SEISMIC SAFETY ELEMENT, SAFETY ELEMENT, NOISE ELEMENT, AND SCENIC HIGHWAY ELEMENT OF THE GEN- ERAL PLAN OF THE CITY OF SANTA ANA TO THE STATE OF CALIFORNIA COUNCIL ON INTERGOVERNMENTAL RE- LATIONS. WHEREAS, Section 65302 of the California Government Code requires the General Plan of the City of Santa Ana to contain a Seismic Safety Element, a Safety Element, a Noise Element, and a Scenic Highway Element not later than one (1) year follow- ing the adoption of guidelines for the preparation of these var- ious elements, with the State of California Council on Inter- governmental Relations; and WHEREAS, said guidelines were adopted on September 20, 1973, making September 20, 1974, the deadline date by which said elements must be adopted; and WHEREAS, the State of California Council on Intergovern- mental Relations may extend the date of adoption for said ele- ments for a reasonable length of time on the grounds specified in said guidelines. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana as follows: SECTION I. That an extension of time be applied for for the preparation of the Noise Element of the General Plan, up to and including December 31, 1974, for the following reasons: 1. That the City of Santa Ana is involved in an intergovern- mental program involving several jurisdictions in order to ade- quately and efficiently prepare the element. 2. That the review procedures in the Santa Ana Municipal Code require an extended public review process, and would cause the proposed elemen~to be considered by the City Council after the deadline date. SECTION II. That an extension of time be applied for, for the preparation of the Seismic Safety Element and Safety Element up to and including April 7, 1975, for the following reasons: vided by provided. SECTION IV. An additional reason for supporting the application for extension of time specified in Sections I, II, and III above, is that the City of Santa Ana has had severe financial constraints placed upon it by increasing operating expenditure, and as a re- sult thereof the Santa Ana Planning Department has been affected through the loss of professional staffing, breaking the conti- nuity of the work program for the mandated General Plan Elements. SECTION V. That the City Council hereby advises that the above stated reasons for the extensions of time requested in Sections I, II and III, and the reason stated in Section IV above, are found to be true, and that those reasons are specifically sup- ported by the reasons specified in the "Request for General Plan Element Extensions" application attached to this Resolution, labeled Exhibit "A", and made a part hereof.
