HomeMy WebLinkAbout74-153RESOLUTION NO. 74-153 Recorded 10/16/74, 9'.'05 AM Book 11265 Page 1708 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ORDERING THE VACATION OF A PORTION OF AN ALLEY LOCATED BETWEEN MAIN AND BUSH STREETS, SOUTH OF TWELFTH STREET, AND RESERVING AN EASEMENT FOR UTILITY PURPOSES WHEREAS, on recommendation of the Department of Public Works and the Planning Commission of the City of Santa Ana, Resolution No. 74-137 was adopted giving notice of intention to vacate a portion of an alley located between Main and Bush Streets, south of Twelfth Street; and WHEREAS, Resolution No. 74-137 was published and notice of intention to vacate was posted as required by law; and WHEREAS, on October 7, 1974, a public hearing was duly held on said vacation; and WHEREAS, the Department of Public Works has deemed it essential to the health, safety, and welfare that an easement be retained over said right of way for the Pacific Telephone and Telegraph Company for utility purposes. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Santa Ana hereby finds that the abovementioned street is unnecessary for present or prospective street pur- poses and does hereby make its order abandoning and vacating for street purposes that certain right of way located in the City of Santa Ana, County of Orange, State of California, described as follows: Ail of the 12 foot alley as set forth in "Smith and Bishops Addition to Santa Ana" recorded in Book 13, Page 63, Miscellaneous Records of Los Angeles County, California, bounded on the East by the West line of Bush Street 50 feet wide. Except the West 12 feet in Main Street. ~serving an easement for Pacific Telephone and Telegraph Company to con- struct, place, operate, inspect, maintain, repair, replace and remove such aerial and underground telephone, telegraph and co~tuL~unication structures as the Company may from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, markers and necessary fixtures and appurtenances. BE IT FURTHER RESOLVED that the public convenience and necessity require the reservaion of an exclusive permanent easement over a portion of said alley by the Pacific Telephone and Telegraph Com%pany for Utility purposes.
