HomeMy WebLinkAbout75-063RESOLUTION NO. 75-63 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AFFIRMING THE ACTION OF THE PLANNING COMMISSION ON CONDITIONAL USE PERMIT 75-2, DENYING SAID CONDITIONAL USE PERMIT AND DENYING APPEAL NO. 348 FILED THEREON BY PACIFIC OUTDOOR ADVERTISING COMPANY WHEREAS, a public hearing was duly held on May 5, 1975, on appeal No. 348, filed by Pacific Outdoor Adver- tising Company in opposition to the Planning Commissions' denial of Conditional Use Permit 75~; NOW, THEREFORE, BE IT RESOLVED that, based on the public hearings held by the City Council of the City of Santa Ana, the oral testimony and real evidence submitted, the City Council of the City of Santa Ana does hereby affirm the action of the Planning Commission denying Con- ditional Use Permit 75-2, and does hereby deny said Condi- tional Use Permit 75-2, and does hereby deny appeal number 348 filed thereon in opposition to the Planning Commissions' action. BE IT FURTHER RESOLVED that the City Council hereby adopts as its Findings of Fact and Conclusions for denial of Conditional Use Permit 75-2, those "Findings of Fact and Conclusions of the City Council of the City of Santa Ana Regarding Conditional Use Permit 75-2" set forth in Exhibit A which is attached hereto and by this reference made a part hereof as though fully set forth herein. The proposed project is the erection of an outdoor sign for the purpose of off-premise advertising. The sign is proposed to be in dimensions of 48 feet by 14 feet, freestanding, with the bottom of the sign 20 feet above grade and a total height of 34 feet above grade. It would have a total area of 672 square feet. The sign is proposed to be erected on the southeast cor- ner of a vacant 1.85 acre parcel which is bounded on the north by First Street and on the east by Harbor Boulevard. The parcel is rectangularly shaped with 255 feet of frontage on Harbor Boulevard and 301 feet of frontage on First Street. The parcel is presently zoned C-2. Section 41-619.55 of the Santa Ana Municipal Code pro- hibits the construction of off-premise advertising signs in a C2 use district except pursuant to an approved conditional use permit. Another off-premise advertising sign presently exists on the northwest corner of the same parcel. The proposed sign would be visible to both northbound and southbound traffic on Harbor Boulevard. Property to the north of the subject parcel has been developed for retail auto sales and pump and drilling supplies. Property to the east of the subject parcel has been developed for bar and retail stores and auto sales. Property to the south of the subject parcel is vacant except for a bank. Property to the west of the subject parcel has been developed as a plumber's local. The General Plan designates the area in which the sub- ject parcel is located as a special study corridor and community shopping center. Both Harbor Boulevard and First Streets are designated as planned arterial high- ways. There have not been any comparable applications or cir- cumstances in the immediate area of the subject parcel. The Scenic Corridor's Element of the City's General Plan identifies Harbor Boulevard as a "select scenic corri- dor'' and states that select scenic corridors should have preferential consideration for scenic amenities and improvement. The Element also states, "Emphasis for select scenic corridors shall be to improve the visual impact through increased buffering, landscaping, effective architectual controls and reduction in signing." There are presently approximately thirty off-premise advertising signs along Harbor Boulevard between 17th Street and Edinger Avenue. In addition, there are numerous on-premise signs of varying nature along the entire length of Harbor Boulevard in the City of Santa Ana. The result is a conglomeration of signing creating an undesirable scenic vista and image for the City. Exhibit A - Page 1 12. 13. 14. 15. 16. 17. The proposed sign, if erected, would add to the al- ready undesirable visual image along Harbor Boulevard and would therefore have an adverse effect on the General Plan of the City. The numerous off-premise advertising signs in the area of the subject parcel, among which is included one such sign already on the subject parcel, adequately serve the advertising needs of the area. The proposed sign, therefore, is neither necessary nor desirable to pro- vide a service or facility which would contribute to the general well being of the neighborhood or community. The proposed sign would be near the intersection of First Street and Harbor Boulevard. Such intersection has the highest traffic volume of all intersections within the City of Santa Ana with over 50,000 vehicles per day passing through, and has one of the highest vehicle accident rates among accident location points within the City of Santa Ana. The proposed sign would be a large outdoor advertising sign with a distractive effect upon passing vehicle traffic which is likely to contribute to an increase in traffic accidents at the intersection of Harbor Boulevard and First Street. For the reasons specified in findings 13 and 14 above, the proposed sign may be detrimental to the health, safety, or general welfare of persons residing or working in the ~icinity thereof. For all of the above reasons, the proposed sign does not satisfy the requirements set forth in section 41-638 of the Santa Ana Municipal Code for a grant of a conditional use permit.
