Pre sent: Councilmen Absent: Councilmen Dale H. Heinly, J. Ogden Markel, William Jerome, Tilghman A. Taylor, Milford W. Dahl None Each member of the City Council having received copies of the Minutes of December 17th, 1956 and December 28, 1956, reading of the ~5nutes was dispensed with and approved on motion of Councilman Heinly, seconded by Jerome and ca, tied. Hearing This being the date set for hearing and no protests having been received, the amendment Amendment Planning Commission Ordinance Ne.side W~mzt St. from Maple to Cedar initiated by the Planning Comztission for the reclassification of property located on the north side of Walnut Street from Maple Avenue to Cedar Street, from the R-3 District to P-PK District, was considered. On motion of Councilman Jerome, seconded by Markel and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa ~na Municipal Code creating chanA~s in district boundaries, and amending Sheets 4 and 7 of the Districting Map to Show the reclassification" was introduced, considered and placed on file for second reading. Hearing Amendment Nathan Rubaloff et al (Bristol and Walnut Streets) ~ This being the date set for hearing and no protests having been received, the amendment application of Nathan Rubaloff et al was considered for the reclassification of preper~y located on the northwest and southwest corners of Bristol and Walnut Streets, with 145 feet frontin~ on Bristol Street and 170 feet fronting on Walnut Street; and for reclassi- fication from R-2 District to C-1 District of the property situated on the north and sides of Walnut Street, beginning at a point 170 feet %~st of Bristol Street and to Pacific Avenue. It was moved by Councilman ~Markel, seconded by Jerome and carried, that the Attorney be instructed to prepare au Ordinance to reclassify the property on tke northwest corner of Bristol and Walnut Streets, with145 feet fronting on Bristol Street and 170 feet on Walnut Street, from R-2 to C-2-PK District, and to reclassify from R-1 to C-1-PK District, the property situated on the north side of Walnut Street beginning at a point 170 feet west of Bristol Street extending to Pacific Avenue; and the property at the southwest corner of Walnut and Bristol Streets, with 145 feet fronting on Bristol Bid acceptance Five business coupes m ~ $$ Street and 170 feet on Walnut Street. The ~nnager announced there, wero~ s~× members of the Police Department in the audience who had passed the required promotional examinations for Lieutenants and Sergeants. The Clerk administered the oath of office to Lieutenants Fred Hopper, Dwight Gross and Richard Pemberton and to Sergeants Lee Dam/er, Lee Stracner and Charles R~e!. The Chief of Police commended the officers for their efficiency and stated they would assume additional responsibilities in their new positions. The Council having unanimously waived the reading of the Resolution, on motio~ of CounciLman Heinly, seconded by Jerome and carried, the following Resolutio~ entitled: "Resolution No. 57-1 accepting Grant Deed" from Charles C. Brisco, for an easement for road purposes on 19th Street east of College Avenue, without cash consideration, was considered and passed by the following° vote: Aye s, Councilmen Noe s, Councilmen Absent, Councilmen Dale H. Dahl None None It was moved by Councilman Jerome, seconded by Taylor and carried, that the Ordinance amending Part 7, Chapter 3, Article VI of the Santa Aha Municipal ~ode regulating public dances in the City of Santa Aha, be set for hearing at the next regular meeting to be held January 21, 1957, after study by the Council as a committee of the whole. Communication and map were presented from the California Highway Commission advising that a public hearing will be held if the Council wishes in the matter of the relocation and improvement as a freeway of a pOrtion of State Highway Route 182 in Orange County, Road VII-Ora-182-A, SA, Ora, between the Santa Aha Freeway (Route 174) and the proposed Route 43 Freeway. On motion of Councilman Jerome, seconded by Taylor and carried, the communication and map were received and filed. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Jerome, seconded by Taylor and carried, the following Resolution entitled: "Resolution No. 57-5 of the Santa Ana City Council declari~ public hearing unnecessary on portion of State Highway Route 182" was considered and passed by the following vote: Ayes, Councilmen Dale H. Dahl Noes, Councilmen None Absent, Councilmen None Communication was read from The Metropolitan Water District advising of an increas~ in the price 'of water to member ngencies of $2.00 per acre-foot, effective July l, 1957, and the price of Colorado River Water will be $12.00 per acre-foot for unsoftened water and $22.00 per acre-foot for softened water. On motion of Councilman Markel, seconded by Jerome and carried, the communication was received and filed. On motion of Councilman Jerome, seconded by Markel and carried, the communication from the City of Orange advising of proposed anneXation of property south of Collins Avenue and west of Batavia Street, on the northwest side of the City, was received and filed. On motion of Councilman Heinly, seconded by Jerome and carried, the communication from the City of Orange advising of proposed annexation of property north of the central part of the City, east of Batavia Street, west of Taft Avenue and south of Fletcher Street, was received and filed. On motion of Councilman Heinly, seconded by Markel and carried, the communication from the Boundary Cc~mission was received and filed, reference the proposed annex- ation of territory to the City of Huntington Beach "North Annexation". On motion of Councilman Markel, seconded by Jerome and carried, the claim of Lillian Fletcher, in the sum of $20,000.00, for alleged injuries sustained in a fall on a defective sidewalk on Riverine Street, approximately 150' south of the southerly curb of Eighth Street, was referred to the Attorney and Insurance Carrier. On motion of Councilman Heinly, seconded by Markel and carried, the communication from the Board. of Supervisors, dated December ll, 1956, giving the results of the votes cast at the Special Election held December 4, 1956, on the proposition to con~ solidate County Sanitation Districts No.~ i and No. 7 into a District to be known as County Sanitation District No. 17, was received and filed. On motion of Councilman Jerome, seconded by Taylor and carried, the notifications of the Department of Alcoholic Bever~je Control of beverage applications of Frank Ramirez, 2026 W. Fifth Street, Henry B. Ortega, 316 E. Fourth Street, Leonzo B. Fernandez, 2032 N. Main Street and Andres Flores, Jr., 20~6 ~4. Fifth Street, we~ received and filed. On motion of Councilman Jerome, seconded by Taylor and carried, the applications of Rex D. Lowry, Leonard R. Gibbons, Allan G. MacDonald, David G. G~nbert, Hubert L. Rumbaugh, M~%rgaret Northcutt, Wayne E. Lubke, Donald S. f~lmen, Joseph F. Wild, Glenn G. Angley, Donald W. Feagan, Glenn I. Dennis and Charles R. ~;~riott, to drive taxicabs, were granted. On motion of Councilman Jerome, seconded by Markel and carried, the request of Richard H. Kendall, on behalf of the Santiago District, Boy Scouts of ;~erica, for permission to conduct a parade on Saturday, Febrna~y 9, 1957, was granted subject to the approval of the Chief of Police as to the time and route of the parade. On motion of Councilman Heinly, seconded by Jerome and carried, the written recom- mendation of the City Manager, dated January 7, 1957, setting forth salary step increases for two employees, effective January l, 1957, and for three employees, effective February l, 1957, was received, filed and approved. On motion of Councilman Jerome, seconded by Markel and carried, the check of H.M. Neighbour, Jr., in the sum of $157.50, and money order in the sum of $540.00, filed as bonds for sidewalk improvements in Tracts Nos. 1299 and 1502, were ordered re- leased and the improvements accepted as completed. On motion of Councilman Markel, seconded by Jerome and carried, Change Order No. 2 was authorized for the installation of an under-drain system, Specification No. 2, on the construction of the Reservoir at First and Flower Streets, in the amount of On motion of Councilman Heinly, seconded by Jerome and carried, the Manager was authorized to file a Notice of Completion on contract of Elmer E. The Manager orally reported on the petition signed by eighty-one persons requesting relief from the encroachment of the Cai-Va Dairy on Center Street and stated that from a legal standpoint there is no way the City could request the removal of the cattle as it was an existing use at the time the property was annexed to the City; also, according to t~e existing Ordinance the cattle should be at least 75 feet fro any residence and the Company will construct a fence, from the present 20 feet back to 75 feet, from the nearest residence, which should control the situation. On motion of Councilman Heinly, seconded by Markel and carried, the oral report was accepted. It was moved by Couacilman Heinly, seconded by Jerome and carried, that the request of the Excelsior Creamery Company, for three 24-minute zones be reconsidered. On motion of Councilman Heinly, seconded by Jerome and carried, the request was referred to the Council as a committee of the whole for report at the next meeting. Dahl Noes, Councilmen None Absent, Councilmen None It was moved by Councilman Markel, seconded by Heinly and carried, that Lease No. DA-O4-376-NG-251, dated January l, 1955, with the Department of the A_~my, National Guard Bureau, California Air National Guard, be amended to authorize the use of an additional forty feet of property at the Community Center on West Eighth Street, to be used as a parking area for heavy equil~ent, in consideration of the lessee fencing said area with a fence similar to the fence heretofore installed on the land. Dahl None None On motion of Councilman Heinly, seconded by Taylor and carried, the Attorney was instructed to prepare the necessary Resolution for an amendment to the Charter to increase the salaries of the City CounciLmen from $75.00 per month to $125.00 per month, ordering the proposition to be submitted to the electors of the City at the Petitions to repeal Ordinance relating to parking overnight on the streets General Municipal Election to be held April 9, 1957. On motion of Councilman Markel, seconded by Jerome and carried, the petitions signed by approx~Jaately 1500 persons requesting the repeal of the 0r6inanoe relati~ to the parking of vehicles overnight on the streets in the residential areas$ were APPROVED denied.
