Dahl Each m~mber of the City Council having received copies of the Minutes of February 4, 1957, reading of the Minutes was dispensed with and approved on motion of COunc~lm~ Neinly, seconded by ~arkel and carried. Presentation of trophies won by the Pony League Phil Sannes presented to the City trophies won by the Pony League at the 1956 Regional and District Meets given by the Riverside Press-Enterprise, Riverside, California, Santa Aha Ail Stars and Basebal 1 C~,m~ions Region VIII, which w~re Hearing "Vehicle Parking District No. 1" accepted with thanks, by the Vice-Mayor. This being the date set for hearing pretests on assessments in the proceeding kuown as "Vehicle Parking District No. 1", the Clerk read pretests from Roy J. Lyon, Esther MacFarlane, Eatherine and George Dry~r, N. Walter Steiner, for First Congregatio~e! Church of Santa Ama, Everard L. Stovall, J.S.Talcott, Jr., Willis J. Clemens, for Church of the Messiah, and Gertrude M. Bruns. On motion of Neinly, seconded by Narkel and carried, the emigrated protests were received and filed. It was moved by Counc~lm~n M~rkel, seconded by Heinly and carried, that the hearing be continued until the next regular meeting and referred to the Nearing Amendment John L. Nobles for report. This being the date set for hearing on the amendment application of R. J. Nobles for the reclassification of an irregular shaped parcel of land containing 6.83 acre on the east side of King Street between 9th and 10th Streets, from the R-1 to the R-~ District, on motion of Councilman ~fnl y, seconded by Markel and carried, the Hearing Plann. This being the date set for hearf~g and no protests having been received, the amend- ment initiated by the Planning Comm~ ssion for the modification Of the existing C-1 and C-2 Districts abutting t~e north and south sides of East and West Seventeenth Street, between the east corporate limits at Wright and Mabury Streets, and the west corporate limits at the Santa Aha River, by the addition thereto of PK, was On motion of Councilmau Markel, seconded by Neinly and carried, the following entitled: "Ordinance amending Article IX of the Santa Ana~mtcipal Code creating chan~mes in district boundaries, and amending Sheets No. 2, 5, 6, 8, 9, 14, 15, 18, 19, 22, 23 and 25 of the Districting Map to show the reclassification" Hearing Amendment B. L.Metcalf~ was introduced, considered and p~aced on file for second reading. This being the date set for hearing on the amendment application of B.L.Metcalf for the reclassification of property on the west side of North Main Street, near b,~ock's property, frc~ the R-1 and R-2 Districts to C-2 District, on motion of Councilman Heinly, seconded by Markel and carried, the matter was continued until Hearing Amen~,~nt Orange County Development~ C9 the next regular meeting. This being the date set for hearing on the amen&-~nt application of Orange County Development Company for the reclassification from R-1 District to C-1 and R-~ Districts of property located on the north side of Wilshire Avenue Just west of Bristol Street, with a frontage of 1022.02 feet on Wilshire Avenue and a depth of approximately 271.92 feet, Kenneth Pruitt and No,man Law protested the reclassifi- cation. On motion of Councilm-n Markel, seconded by Heinly and carried, the matter was continued until the next regular meeting. On motion of Councilman Reinly, seconded by Markel and carried, the recommendation of the Planning C;-=-ission was approved and the variance of Lemuel B. Rlett granted to permit construction of a building, 25' x 70', on property at the northeast corner of Kilson Drive and Anahurst Street, to be used for a Children's Day Nursery School to accommodate thirty children, subject to condition for off-street parking and the parking area to be blacktopped. On motion of Cou~cllm~n Neinly, seconded by Markel and carried, the recommendation of the Planning Com, ission was approved aud the variance of Paul E. Davis granted to permit the use of property at 115 North McOlay Street, for a five-unit motel, at this tt-~ and for future expansion. Co~m-uication was read from the Planning Commission rec.=...~uding approval to part of variance of G. Roward Robertshaw the_/application~permitting the use of existing building for a real estate office on property located at 1518-1520 North Grand Avenue, with a double-faced sign, 5' x 8' or ~O square feet, with the stipulation that access be made to the rear yard and sufficient off-street parking area be made available at the rear, for ten cars, the entire parking area to be blacktopped, subject to condition of Public Works Depart- ~ent. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Helnly, seconded by Markel and carried, the following Resolutic entitled: "Resolution No. 57-25 granting a Variance where the Planning Commission recommended denial of a part" was considered and passed by the followim~ vote: Ayes, Councilmen Dale R. Dahl It was moved by Counc~lm-~ ]{einly, seconded by Markel and carried, that the Council declare the office of Councilman from the Fifth Ward vacant as of February 18, 1957. It was moved by Counc~m~- Neinly, seconded by Markel and carried, that the Council declare its intention not to fill the vacancy of Councilm~n fro~ the Fifth Ward. On motion of Counc~lm-u Markel, seconded ~y Heinly and carried, the recommendation of the Plezming C~mmission was ~pproved and the variance of Virgil Orvid Shields granted to permit the use of existing build~ at 8~8 North Birch Street, for an insurance agency office, with three offices and lecture room, including storage for the various forms required of au agency, the west 52' of lot to be surfaced to pro- vide off-street parking space for ten cars or more, and subject to the condition as imposed by the Department of Public Works. The Manager reported that the signatures on the petitions had been checked an~ it was found that 59.64% of the area signed the petitions for an assesm--nt district to provide For certain improvements on Rousselle, Oak, Cedar, Stan~awd, St. Andrew, et al, and it was also reported that additional petitions will be filed to bring the percentage up to more than 60% of the area in order to waive the 1931 "Debt Limit- ations Act". Taxicab Driver ' s Communication State Division of Highways (Freeway) It was moved by Counci]m~ Helnly, seconded by Markel and carried, that the Attorney be instructed to smead, revise or repeal the last paragraph of Section 7417 of the Municipal Code, which reads as follows: "That whenever a water cons~ner sball allow the payment of the water bills, fines or penalties for water used upon any property in the City to become due and delinquent the same shall be a lien a~ainst said real property and said lien shall not be affected by a change in the ownership of said real property'. ~ication was read from Juanita C~nnoy requesting the approval of Fin~l ~ap of Tract No. 3105 subject to the filfng of improvement bond at a later date, and on motion of Councilman Markel, seconded by Heialy and carried, action was deferred until the next regular meeting. Co~mmuuication was read fr~n Frank G. Bouelli, Assemblyman, Fifty-second District, with copies of Assembly Bill AB-64, reference b~ning the sale of crime horror books to minors under 18 years of age and requesting the Council to adopt a Resolution similar to the one adopted by the City of Bakersfield, and on motion of Counc~lm-n Heinly, seconded by Markel and carried, the communications were received and filed. Hastings, to drive taxicabs, were approved and permits granted. Communication was read from Department of Public Works, Division of Highways copy of Resolution adopting the route for a portion of State ~tighway in Oral_me County, between the Santa Ama Freeway (Route 174) and Route 4~ Freeway, VII-Ora-182- Ora, SA, A, and declaring the portion of highway to be a Freeway. On faction of Counc]lm-n Helzh~y, seconded by Markel and carried, the following Ordinance entitled: "Ordinance providing for the holding of a General Municipal Election in the City of Santa Aha, California, on the 9th day of April, 1957, for the election of City Officers of said City, giving notice of.said Election~ designating the polling places, the hours during which the polls shall be opened, the officers to be elected, and appointing Election Officers to serve at said Election" was introduced, considered and placed on file for second reading. Remberg and Lowrey covering architectural services in con~ection with the erection of a bandshell in the Memorial Park. On motion of Councilman Ne~nly, seconded by Markel and carried, the requests of Hurry Tancredi for the vacation of a po~-tion of Poinsettia Street located at the southeast corner of 17th and Poinsettia Streets, lying along the Santa Aha Freeway, and from G.J.Nardulli for the vacation of a 22' ~!!ey located 90.OB' north of the intersection on the west side of Valencia Street and the Santa Aha Freeway, were referred to the Planning Commission for action. On motion of Councilman Heinly, seconded by ~arkel and carried, the Purchasing Agent was authorized to advertise for bids for the construction of nine brick stoves and two double sinks in the Park known as "Fairview and Center PropertffJ in accordance with Specification No. 691-~; bids to be opened ~Iarch ~, 1957. Dahl On motion of Councilman Heinly, seconded by Markel and carried, the petition signed by twenty-three persons requesting the establishment of a two-hour parking limit in the 800 block North Birch Street, was referred to the Council as a committee of the whole. On motion of Councilman Eeinly, seconded by Markel and carried, the request of Rlmer S. Sullivan for a twenty-minute zone in front of his place of business at 1232 South Main Street was re-submitted to the curb usage cummlttee for further investigation between the hours of 4:00 p.M: and 6:00 P.M. It was moved by Counc~lm~ Heinly, seconded by Markel and carried, that a letter be directed to Ernest G. Wilson, 630 Or~e Avenue, informing him that it is the City'~ intention to acquire the ~.686 acres of land which lies ~m~diately east of Prentic~ Park, with frontage on Lin Street, Tustin, which property is to be added to Prenti¢ Park and developed for park purposes.
