C~mmmication was read from the Pl-n~ing Cnmmf ssion rec~nding denial of variance
application of Mar~-~ne Whelan to permit construction of a single-family dwelling on
rear part of lot located at 217 South Baker Street, in addition to single-family
dwelling and duplex existing on front part of the lot. On motion of Councilm-n
Markel, seconded by Heinly and carried, the matter was continued until the next
regular meeting.
On motion of Councilman Reinly, seconded by Markel and carried, the recommendation
of the Planning C;-=-ission was approved and the variance of Lemuel B. Rlett granted
to permit construction of a building, 25' x 70', on property at the northeast corner
of Kilson Drive and Anahurst Street, to be used for a Children's Day Nursery School
to accommodate thirty children, subject to condition for off-street parking and the
parking area to be blacktopped.
On motion of Cou~cllm~n Neinly, seconded by Markel and carried, the recommendation
of the Planning Com, ission was approved aud the variance of Paul E. Davis granted to
permit the use of property at 115 North McOlay Street, for a five-unit motel, at
this tt-~ and for future expansion.

It was moved by Counc~lm-~ ]{einly, seconded by Markel and carried, that the Council
declare the office of Councilman from the Fifth Ward vacant as of February 18, 1957.
It was moved by Counc~m~- Neinly, seconded by Markel and carried, that the Council
declare its intention not to fill the vacancy of Councilm~n fro~ the Fifth Ward.
On motion of Counc~lm-u Markel, seconded ~y Heinly and carried, the recommendation
of the Plezming C~mmission was ~pproved and the variance of Virgil Orvid Shields
granted to permit the use of existing build~ at 8~8 North Birch Street, for an
insurance agency office, with three offices and lecture room, including storage for
the various forms required of au agency, the west 52' of lot to be surfaced to pro-
vide off-street parking space for ten cars or more, and subject to the condition as
imposed by the Department of Public Works.
The Manager reported that the signatures on the petitions had been checked an~ it
was found that 59.64% of the area signed the petitions for an assesm--nt district
to provide For certain improvements on Rousselle, Oak, Cedar, Stan~awd, St. Andrew,
et al, and it was also reported that additional petitions will be filed to bring the
percentage up to more than 60% of the area in order to waive the 1931 "Debt Limit-
ations Act".

It was moved by Counci]m~ Helnly, seconded by Markel and carried, that the Attorney
be instructed to smead, revise or repeal the last paragraph of Section 7417 of the
Municipal Code, which reads as follows: "That whenever a water cons~ner sball allow
the payment of the water bills, fines or penalties for water used upon any property
in the City to become due and delinquent the same shall be a lien a~ainst said real
property and said lien shall not be affected by a change in the ownership of said
real property'.

School Tax Increase Election to be held the same day as the Municipal Election,
9, 1957, and to use the same polling places and election boards and offering to pay
its proportionate share of *.b~ cost of the polling places and election boards. On
motion of Collucilm~ Neinly, seconded by Markel ~ud carried, the request was granted
with the provision that the Board of Education contribute $8.00 for each
precinct to compensate election officers for the additio~l work.

with copies of Assembly Bill AB-64, reference b~ning the sale of crime horror
books to minors under 18 years of age and requesting the Council to adopt a
Resolution similar to the one adopted by the City of Bakersfield, and on motion of

Communication was read from Department of Public Works, Division of Highways
copy of Resolution adopting the route for a portion of State ~tighway in Oral_me
County, between the Santa Ama Freeway (Route 174) and Route 4~ Freeway, VII-Ora-182-

trash and garbage cans of Chef's Hut and Markham Appliance Company, which are' left,
for long periods of time, on the sidewalk on the west side of Bush Street, at the
M~krkham Parking Lot, and also that Markham Appliance Company have not complied with
conditions imposed on their variance for the Parking Lot. On motion of Councilman

On motion of Councilman Ne~nly, seconded by Markel and carried, the requests of
Hurry Tancredi for the vacation of a po~-tion of Poinsettia Street located at the
southeast corner of 17th and Poinsettia Streets, lying along the Santa Aha Freeway,
and from G.J.Nardulli for the vacation of a 22' ~!!ey located 90.OB' north of the
intersection on the west side of Valencia Street and the Santa Aha Freeway, were
referred to the Planning Commission for action.
On motion of Councilman Heinly, seconded by ~arkel and carried, the Purchasing Agent
was authorized to advertise for bids for the construction of nine brick stoves and
two double sinks in the Park known as "Fairview and Center PropertffJ in accordance
with Specification No. 691-~; bids to be opened ~Iarch ~, 1957.

The Council having unanimously waived the reading of the Resolution, on motion of
Counctlm~u Eeinly, seconded by Markel and carried, the following Resolution entitle.
"Resolution No. 57-~6 concerning parking limitations and curb
m~kings in accor~-n~e therewith"
establishing a green zone on the south side of East First Street between Eathaway
and Santa Fe Streets, was considered and passed by the following vote:

On motion of Councilman Heinly, seconded by Markel and carried, the petition signed
by twenty-three persons requesting the establishment of a two-hour parking limit in
the 800 block North Birch Street, was referred to the Council as a committee of the
whole.
On motion of Councilman Eeinly, seconded by Markel and carried, the request of
Rlmer S. Sullivan for a twenty-minute zone in front of his place of business at
1232 South Main Street was re-submitted to the curb usage cummlttee for further
investigation between the hours of 4:00 p.M: and 6:00 P.M.
On ree.--.-~ndation of the Department of Public Works and on motion of Counctlm~n
Reinly, seconded by Markel and carried, the Director of Finance was authorized to
issue a warrant in the amount of $441.0Oto the State of California, Division of
Highways, to be placed on deposit with the property disposal agents pending receipt
of a proposed sewer easement over State owned property located between the Santa
Aha Freeway and Main Street~ Tustin, comprising an area of 0.084 acres.

Department was authorized to use the facilities of the Fire Stations for polio

It was moved by Counc~lm~ Heinly, seconded by Markel and carried, that a letter be
directed to Ernest G. Wilson, 630 Or~e Avenue, informing him that it is the City'~
intention to acquire the ~.686 acres of land which lies ~m~diately east of Prentic~
Park, with frontage on Lin Street, Tustin, which property is to be added to Prenti¢
Park and developed for park purposes.
